4.1 The Scope Of The Order Includes The Supply Of Electricity To 50 Electricity Consumption Points. The Expected Energy Consumption Over A 12-Month Period Is: 1,161,310 Kwh. A Detailed List Of Points Is Included In Annex No. 5 To The Swz.4.2 The Estimated Demand For Electricity Is Indicative Only And In No Case Constitutes An Obligation On The Part Of The Ordering Party To Purchase Energy In The Given Amount. The Amount Of Electricity Consumed By The Ordering Party Will Be Determined Based On Direct Readings Of Measurement And Billing Systems. Any Change In The Expected Estimated Consumption Will Not Result In Any Additional Costs For The Ordering Party, Apart From The Settlement For The Actual Amount Of Energy Consumed According To The Prices Specified In The Price Form. The Contractor Will Not Be Entitled To Any Any Claim For Failure To Collect The Expected Amount Of Energy By The Ordering Party. The Execution Of The Order Is Subject To Polish Law, In Particular The Act Of April 10, 1997 Energy Law (Journal Of Laws Of 2024, Item 266, As Amended) And The Provisions Implementing Regulations To This Act. Electricity Should Meet Technical And Commercial Parameters In Accordance With The Provisions Of The Energy Law And The Implementing Regulations To This Act And Polish Standards, I.E. The Subject Of The Order Was Defined Using Quality Standards Relating To All Its Essential Features. The Selected Contractor Will Prepare And Complete And Will Send, Via The Appropriate Information Exchange Platform (Belonging To The Local Distribution System Operator), Electricity Sales Reports For All Electricity Intake Points To The Distribution System Operator - In Order To Obtain Their Positive Verification On January 1, 2025. The Ordering Party Will Grant The Contractor An Appropriate Power Of Attorney To Report In Concluded A Contract For The Sale Of Electricity To The Dso On Behalf Of The Ordering Party And Perform The Activities Necessary To Carry Out The Process Of Changing The Supplier To The Dso According To The Template Commonly Used By The Contractor. The Supply Of Electricity Should Also Take Into Account The Function Of The Entity Responsible For Commercial Balancing, Resulting From The Energy Law Act, As Well As Implementing Acts And Related Documents, In Particular Iriesp Pse Operator Sp. Z O. O., As Well As Iriesd Enea Operator. In Order To Implement The Subject Of The Order, The Contractor Must Have A Valid Contract Concluded, I.E. The So-Called General Distribution Agreement With The Local Distribution System Operator (Hereinafter Referred To As The Dso, On The Basis Of Which It May Sell Electricity Through The Distribution Network Of This Dso To The Consumption Points Listed In Annex No. 6). The Ordering Party Will Use The Electricity For Its Own Business Purposes As A Consumer Final. The Ordering Party Reserves The Right To Increase The Total Amount Of Purchased Electricity Using The Option Right To 20% Of The Basic Order. The Ordering Party Is
