The Subject Of The Order Is The Modernization Of The Road Network In The Janowiec Kościelny Commune In The Design And Build Form, Which Includes: 1) Preparation Of Complete Design Documentation Along With The Execution Of Construction Works (In The Design And Build System) For The Following Tasks: A) Task 1 - Modernization Of The Municipal Road In Msc. Napierki,B) Task 2 - Modernization Of The Municipal Road In The Section Szczepankowo - Sołdany,C) Task 3 - Modernization Of The Municipal Road In Msc. Foresters - Stage I, D) Task 4 - Modernization Of The Municipal Road In Mc. Foresters - Stage Ii, E) Task 5 - Modernization Of The Municipal Road In Mc. Crushes,F) Task 6 - Modernization Of The Municipal Road In The Section Szypułki -Zapowiedzki,G) Task 7 - Modernization Of A Municipal Road In The City. Pokrzywnica, To The Extent Specified In Detail In The Subject Of The Order, Offer, Bill Of Quantities, Functional And Utility Programs (Hereinafter Referred To As Pfu) And Swz.2. As Part Of The Implementation Of The Subject Of The Contract Referred To In Section 1 Point 1, The Contractor In Particular: 1) Will Prepare Complete Design Documentation, In Accordance With The Scope And Guidelines Indicated In The Fup For Design Documentation, Including: Obtaining All Types Of Decisions, Permits, Consents And Arrangements And Obtaining, On Behalf Of The Ordering Party, Final Decisions On A Building Permit Or Valid Notifications Of The Intention To Perform Construction Works For The Entire Investment Required By Law, Including The Act Of July 7, 1994, Construction Law (Consolidated Text: Journal Of Laws Of 2024, Item 725, As Amended) (Hereinafter Referred To As The Construction Law) Necessary To Execute This Contract ;2) Will Exercise Authors Supervision Over The Prepared Documentation In Accordance With The Principles Specified In The Fup;3) Will Perform Construction Works Consisting In The Modernization Of Municipal Roads Referred To In Section 1 Point 1 Letter A) - G), In Accordance With The Approved Design Documentation Referred To In Point 1; 4) Will Prepare As-Built Documentation; 5) Will Transfer To The Ordering Party The Economic Copyrights To The Design Documentation Referred To In Point 1 And To The As-Built Documentation Referred To In Point 1 Referred To In Point 4, Under The Conditions Specified In § 22 Of The Draft Provisions Of The Contract (Hereinafter Referred To As Ppu);6) Concludes An Insurance Contract For Liability Related To The Performance Of The Subject Of The Contract Under The Conditions Specified In § 5 Section 2 Point 14 Of The Ppu;7) Will Provide A Guarantee For The Construction Works Referred To In Point 3 Under The Conditions Specified In § 13 Of The Ppu;8) Will Provide A Guarantee For The Accompanying Infrastructure Under The Conditions Specified By The Manufacturer.3. A Detailed Description Of The Subject Of The Order Can Be Found In The Pfu And Bills Of Quantities, Which Constitute Appendix No. 7 To The Swz, As Well As In The Ppu, Which Constitute Appendix No. 6 To The Swz.4. If The Materials Describing The Subject Of The Order Contain Trademarks, Patents Or Origin, Source Or Detailed Process That Characterizes The Products Delivered By A Specific Contractor, The Ordering Party Allows Materials And/Or Solutions Equivalent To Those Described, Provided That The Technical, Quality And Operational Parameters Are Not Worse Than Those Indicated. In Documentation And Not Leading To A Change In Technology. The Names Indicated In The Documentation Should Be Treated As Examples. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate In The Offer That The Construction Works And Materials Used/Delivered As Part Of The Subject Of The Order Offered By Him Meet The Requirements Specified By The Ordering Party.5. The Contractor Will Perform The Subject Of The Order On The Basis Of: Developed Design Documentation, Swz Together With Annexes, Questions And Answers Provided During The Public Procurement Procedure, As Well As Applicable Detailed Regulations And Construction Practice.6. The Execution Of The Order Is Subject To Polish Law, In Particular The Construction Law, The Provisions Of The Civil Code And The Public Procurement Law. The Contractor Will Be Obliged To Perform Design Services And Construction Works In Accordance With Polish Law, In Particular With Technical And Construction Regulations, Regulations Regarding Independent Technical Functions In Construction And Regulations Regarding Products And Materials Used In Construction.7. The Ordering Party Does Not Allow The Possibility Of Submitting Partial Offers. Justification: For Organizational Reasons, In Particular Due To The Method Of Settling Investment Co-Financing, The Ordering Party Did Not Allow The Submission Of Partial Offers. The Investment Is Co-Financed By The Polish Governance Fund Government Program: Strategic Investment Program - Edition 8/2023/528/Polskilad. In Accordance With The Regulations Of The Above-Mentioned Program And The Preliminary Promise Received By The Ordering Party, Full Settlement Of The Investment, And Therefore Payment Of The Remuneration Due To The Contractor(S), Is Possible After The Ordering Party Submits A Declaration On The Completion Of A Given Stage Of The Investment Or Completion Of The Investment, In The Case Of Investments Implemented Over A Period Longer Than 12 Months. If The Possibility Of Submitting Partial Offers Is Allowed, The Investment Could Be Carried Out By At Least 2 (Or More) Contractors. The Above Division Could Lead To A Situation In Which The Payment Of Remuneration To One Contractor Who First Completes Part Of The Investment Will Depend On The Completion Of Part Of The Investment By Another (Other) Contractor(S). In Turn, If One Of The Contractors Fails To Complete Part Of The Investment Or Withdraws From Its Implementation, The Ordering Party Would Not Be Able To Use The Funds From The Promise, Which In Turn Would Lead To A Situation In Which The Remaining Contractors Would Not Receive Their Remuneration For The Completed Parts Of The Investment, Because The Ordering Party Does Not Have Own Funds For Its Implementation.10. The Contractor Or Subcontractor Undertakes To Provide Employment Under An Employment Contract Within The Meaning Of Art. 22 §1 Of The Act Of June 26, 1974, Labor Code, In Working Hours Adequate To The Assigned Tasks, Throughout The Period Of Implementation Of The Assigned Tasks, All Persons Performing Activities Involving Physical Work During The Implementation Of Construction Works, In Particular Activities Related To: Performance Of Works Earthworks, Assembly And Installation Works (Electrical), Construction Of Hardened Surfaces (E.G. Roads, Sidewalks), Operation Of Construction Machines And Equipment (E.G. Operation Of Excavators, Bulldozers, Loaders, Trucks, Etc.), Covered By The Scope Of The Order Indicated In § 1 Of The Ppu . The Requirement Of Employment Under An Employment Contract Does Not Apply To Natural Persons Running A Business On The Basis Of An Entry In The Ceidg Or Other Equivalent Registers And Performing Personally And Independently The Activities Entrusted To Them In The Scope Of The Execution Of The Subject Of The Contract, As Well As Persons Managing The Construction Site And Persons Performing Independent Technical Functions In The Construction Industry. Detailed Requirements Regarding Employment Under An Employment Contract And Sanctions For Non-Compliance With The Above-Mentioned The Requirement Is Described In § 3 And 17 Of The Ppu.
