1. The Subject Of The Order Is The Modernization Of Cultural Infrastructure And The Construction Of Lighting Infrastructure In The Town Of Jelna - Modernization Of The Cultural Center In Jelna Carried Out As Part Of An Investment Co-Financed By The Polish Government Fund: Strategic Investment Program No. Edycja6pgr/2023/4238/Polskilad. The Scope Of Works For The Planned Investment Includes: 1) Renovation And Modernization Of The Surface In The Building, Including: - Cutting Tiles, - Making A Leveling Screed, - Laying A New Tile Surface, According To The Design Documentation (Before Starting The Work, The Type Of Tiles Should Be Presented For Approval To The Ordering Party) ,2) Adapting The Stage For Comfortable Use, Including: - Reconstruction Of The Stage Structure, - Construction Of Entrance Stairs To The Stage, - Construction Of A Partition Wall, 3) Equipping The Cultural Center With Modern Equipment And Furnishings, Including: - Lighting, - Banner. Detailed The Scope Of The Order Is Presented In The Attached Documentation.2. The Scope Of The Order Also Includes: 1) Preparation Of The Construction Site, 2) Securing The Construction Site, 3) Purchase And Delivery Of Materials Necessary To Complete The Task, 4) Tidying Up The Construction Site.3. Other Obligations And Costs Of The Contractor The Scope Of Obligations And Costs Of The Contractor Also Includes: 1) Securing, At Its Own Expense And Effort, The Utilities Necessary To Perform Construction Works, 2) Costs Related To The Acceptance Of Completed Works, 3) Waste Disposal, 4) Reporting To The Ordering Party For Acceptance Of Disappearing Works (If Any), 5) Preparation Of An As-Built Cost Estimate. The Above-Mentioned Studies Should Be Added To The Costs Of The Task. 4. Materials And Devices Used To Complete The Order Should: 1) Meet The Requirements And Be Compliant With: A) Polish Standards Transposing European Harmonized Standards, Technical And Construction Conditions, Occupational Health And Safety And Fire Protection Regulations, B) Applicable Provisions Of The Act Of July 7, 1994 Construction Law (Journal Of Laws Of 2023, Item 682, As Amended), Hereinafter Referred To As The Construction Law Act And The Act Of April 16, 2004 On Construction Products (Journal Of Laws Of 2021 R. Item 1213), C) Implementing Provisions Of The Above-Mentioned Acts, D) Provisions Of This Contract, E) Ce Declaration Of Conformity (Conformité Europénne), F) Technical Knowledge And Construction Skills; 2) Meet The Functional And Technical Requirements Specified In Swz And The Act Of April 16, 2004 On Construction Products (Journal Of Laws Of 2021, Item 1213).5. The Offer Cost Estimate Must Be Fully Consistent With The Provisions Included In The Bill Of Quantities (Material, Description, Quantity) And Should Include Unit Prices For Individual Items. Each Item In The Offer Cost Estimate Should Be Priced Separately. All Values (Except Dimensions) Should Be Calculated To Two Decimal Places In Accordance With Mathematical Rounding Rules.6. The Contractor Is Obliged To Transfer Waste Generated During The Implementation Of The Subject Of The Contract To An Entity Authorized To Dispose Of Waste And To Provide The Ordering Party With A Document Confirming This Activity (Waste Transfer Card).7. Reasons For Not Dividing The Order Into Parts: The Ordering Party Did Not Divide The Order Into Parts Because This Procedure Covers The Same Subject Matter Of The Order That Was Invalidated As Part Of Part 1 Of The Procedure Published By The Ordering Party On April 30, 2024 Entitled Modernization Of Cultural Infrastructure And Construction Of Lighting Infrastructure In The Town Of Jelna. Moreover, Dividing The Contract Into Lots Is Not Justified Due To The Small Scope Of Work Covered By The Contract. The Division Of The Contract Into Lots Was Introduced By The Legislator In Order To Increase The Share Of The Small And Medium-Sized Enterprises (Sme) Sector In The Public Procurement Market And To Increase Competitiveness. According To The Ordering Party, The Scope Of This Order Is Adapted To The Needs Of The Sme Sector Without The Need To Expand It Further. Dividing It Is Therefore Pointless. In Addition, Such A Division Could Have Effects On The Competitiveness Of The Procedure And The Rationality Of Expenditures That Are Different From Those Intended By The Legislator, Because If The Contract Were Too Fragmented, It Could No Longer Be Attractive Also For Smes.
