1. The Subject Of The Order Is Renovation Of The Water And Sewage System And Arranging The Central Heating In The Kitchen And Canteen, Together With Works Related To The Renovation Of The Electrical Installation, Replacement Of Wall And Floor Coverings In The Kitchen Of The Dormitory Building.2. The Subject Of The Order In Particular Includes The Following Works: 1) Demolition, Dismantling And Repair Works, 2) Plastering Works On Walls And Ceilings, 3) Covering Floors And Walls With Tiles, 4) Painting Works, 5) Making The Substructure For The Floor Along With Layers Of Insulation And Anti-Moisture Insulation6) Piercings, Drillings And Brickwork,7) Installation Of The Water Supply System With Insulation With Laggings,8) Reinforcement Of The Water Supply System (Including Installation Of Compensators, Fittings, Tees, Valves)9) Installation Of Sink Faucets And Taps,10) Installation Of A Sanitary Sewage System With Connection To The Existing Sewage System,11) Installation Of A Central Heating System (Including Installation Of Pipes, Fittings) Along With Insulation With Laggings,12) Installation Of Radiators With Valves And Thermostatic Heads,13) Cutting Grooves For Cables And Sockets,14 ) Installation Of Cables, Boxes And Sockets,15) Tests And Measurements,16) Disposal Of Rubble And Waste. Attention! The Subject Of The Order Does Not Include: - Performance Of Works Related To Supply And Exhaust Ventilation, - Renovation Of The Canteen, Except For The Installation Of Radiators And Repairs After The Central Heating Installation.3. A Detailed Description Of The Subject Of The Order Is Specified In The Technical Design/Execution Design Constituting Annex No. 8 To The Swz, The Bill Of Quantities Constituting Annex No. 9 To The Swz And The Technical Specification For The Execution And Acceptance Of Construction Works Constituting Annex No. 10 To The Swz.4. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Contract Template Constituting Annex No. 2 To Swz.5. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Parts Of The Order.6. The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S). 7. The Ordering Party Requires That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance It Intends To Entrust To Subcontractors And Provide (If Known To It At This Stage) The Names (Companies) Of These Subcontractors.8. During The Order Execution Period, The Ordering Party Requires The Contractor Or Subcontractor To Be Employed Under An Employment Contract In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465, As Amended) Employees Performing Construction, Assembly And Installation Work, Excluding Management Staff.9. During The Execution Of The Order, The Ordering Party Is Entitled To Carry Out Inspection Activities Towards The Contractor Regarding The Fulfillment By The Contractor Or Subcontractor Of The Requirement To Employ Persons Performing The Activities Indicated In Point 8 Under An Employment Contract. The Ordering Party Is Entitled In Particular To: 1) Request Declarations And Documents Confirming Compliance With The Above-Mentioned Requirements. Requirements And Assessing Them, 2) Requesting Explanations In Case Of Doubts Regarding Confirmation Of Compliance With The Above-Mentioned Requirements. Requirements,3) Carrying Out On-Site Inspections.10. During The Execution Of The Order, At Each Request Of The Ordering Party And Within The Time Specified In The Request, The Contractor Will Submit To The Ordering Party The Evidence Indicated Below In Order To Confirm The Fulfillment Of The Requirement Of Employment Under An Employment Contract By The Contractor Or Subcontractor Of Persons Performing The Activities Indicated In Point 8 During The Execution Of The Order: 1) Declaration Employees Employed By The Contractor Or Subcontractor Containing Information, Including Personal Data, Necessary To Verify Employment Under An Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Responsibilities, As Well As The Signature Of The Employee Submitting Declaration, 2) Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing The Activities Covered By The Ordering Partys Request And To Report Them To The Appropriate Zus Branch. This Declaration Should Include In Particular: Precise Identification Of The Entity Submitting The Declaration, Date Of Submission Of The Declaration, Indication That The Activities Covered By The Request Are Performed By Persons Employed Under An Employment Contract Along With An Indication Of The Number Of These Persons, Names And Surnames Of These Persons, Date Of Conclusion Of Contracts, Type Of Contract. For Work, Scope Of Duties And Full-Time Employment, And The Signature Of The Person Authorized To Submit A Declaration On Behalf Of The Contractor Or Subcontractor; 3) A Copy Of The Employment Contract/Contracts Of Persons Performing The Activities Referred To Above During The Execution Of The Order, Certified As A True Copy Of The Original By The Contractor Or Subcontractor, Respectively . Declaration Of The Contractor Or Subcontractor (Together With A Document Regulating The Scope Of Obligations, If Prepared). A Copy Of The Contract(S) Should Be Provided In A Way That Ensures The Protection Of Employees Personal Data, In Accordance With Regulation (Eu) 2016/679 Of The European Parliament And Of The Council Of 27 April 2016 On The Protection Of Natural Persons With Regard To The Processing Of Personal Data And On The Free Movement Such Data And Repealing Directive 95/46/Ec (General Data Protection Regulation) (Oj Eu L 119 Of 04/05/2016, P. 1), Hereinafter Referred To As Gdpr, (I.E. In Particular Without Addresses, Pesel Number Employees). The Employees Name And Surname Are Not Anonymized. Information Such As: Date Of Conclusion Of The Contract, Type Of Employment Contract, Scope Of Duties And Working Hours Should Be Identifiable.11. Due To The Failure By The Contractor Or Subcontractor To Employ Persons Performing The Activities Indicated In Point 8 Under The Employment Contract, The Ordering Party Provides For A Contractual Penalty Of Pln 5,000 (In Words: Five Thousand Zlotys) For Each Unemployed Person. Failure By The Contractor To Submit The Evidence Requested By The Ordering Party To Confirm That The Contractor Or Subcontractor Has Met The Employment Requirement Under The Employment Contract Within The Deadline Set By The Ordering Party Will Be Treated As The Contractors Or Subcontractors Failure To Meet The Requirement To Employ Persons Performing The Activities Indicated In Point 8 Under The Employment Contract. 12. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate.13. The Specified Materials And Devices Do Not Indicate The Place Of Origin Or Manufacturer, But Serve Only To Determine The Quality Features, Technical Parameters And Aesthetics Of Workmanship. It Is Allowed To Use Materials And Devices Of Brands Other Than Those Specified In The Documentation (I.E. Equivalents), Provided That The Technical Parameters And All Other Quality Features Are Not Worse Than Those Used In The Documentation. The Ordering Party For All Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2(3) Of The Public Procurement Law, Referred To In The Documentation Of This Procedure, Allows The Use Of Equivalent Solutions.14. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Minimum Requirements Specified By The Ordering Party In The Description Of The Subject Of The Contract. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.
