Tenders Are Invited For Purchase Of Garden Care Equipment: An Agricultural Tractor.

1. The Subject Of The Order Is The Supply Of Garden Care Equipment: An Agricultural Tractor Under Project No. Ltpl00050 Improvement Of Green Infrastructure In The Urban Areas In The Cross-Border Region Under The Interreg Vi-A Lithuania-Poland Cooperation Program 2021-2027.2. The Subject Of The Order And Its Requirements Are Described In Detail In Annex 2 To Swz.3. The Contractor Must, At His Own Expense, Ensure The Delivery Of The Equipment To The Place In Suwałki, Indicated By The Ordering Party.4. The Subject Of The Order Must Have At Least The Technical Parameters And Equipment Specified In Annex 2 To Swz.5. Pursuant To Art. 101 Section 4 Of The Act, In The Place Where The Subject Of The Order Is Described Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. Furthermore, All Such References Should Be Deemed To Be Accompanied By The Words Or Equivalent. Indication Of The Equivalence Of The Offered Solution In Accordance With Art. 101 Section 5 Of The Act And On The Principles Specified Therein Rests With The Contractor, In Which Case The Contractor Is Obliged To Prove, By Attaching To The Offer, The Relevant Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.6. If Trademarks Are Used In The Opz Documentation (Description Of The Subject Of The Order), It Means That They Are Provided As Examples And Define Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Opz Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Materials And Devices Used By Him Meet The Requirements Specified By The Ordering Party. 7. The Use Of Labels In The Opz Documentation Means That The Ordering Party Accepts All Labels Confirming That Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party. If The Contractor, For Reasons Beyond Its Control, Cannot Obtain The Label Specified By The Ordering Party Or An Equivalent Label, The Ordering Party, Within The Deadline Set By Itself, Accepts Other Corresponding Means Of Evidence, In Particular The Manufacturers Documentation, Provided That The Contractor Proves That The Construction Works, Supplies Or Services To Be Performed By Him Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party.8. The Use In The Design Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Report On Tests Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Features Specified In The Description Of The Subject Of The Contract, The Offer Evaluation Criteria Or The Terms Of Contract Execution Means That The Ordering Party Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, If A Given Contractor Does Not Have Access To Certificates Or Test Reports Or The Possibility Of Obtaining Them In A Timely Manner, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor, And Provided That A Given Contractor Proves That The Construction Works, Supplies And Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Order, The Offer Evaluation Criteria Or The Requirements Related To The Implementation Of The Order.9. In The Case Of Description Using Standards, Equivalent Solutions Are Those That Ensure Compliance With The Minimum Requirements Specified In The Standard At A Level Not Worse Than That Described In The Relevant Standards. In The Case Of Standards Referred To In The Swz (Unless Specified In Detail), Current Standards Are Understood. In Other Cases (Description Of The Subject Of The Contract Using Technical Assessments, Technical Specifications And Technical Reference Systems), A Product, Material Or System With Technical, Functional And Quality Parameters Not Worse Than Those Mentioned In The Description Of The Subject Of The Contract Is Considered Equivalent.
