1. The Subject Of The Order Includes The Repair Of Waterproofing Of External Partitions In The Basement Of A Building Used By The Border Guard And The Customs And Tax Service At The Road Border Crossing In Gronowo In The Design And Build System In The Following Scope: 1) Development Of Design Documentation Along With Obtaining All Necessary Opinions, Arrangements And Permits , Including Building Permits, I.E.: A) Development Of A Construction Design, Executive Designs, Information On Health And Safety, Technical Specifications For The Execution And Acceptance Of Works And Other Studies Necessary To Obtain Formal And Legal Documents Necessary When Issuing A Building Permit Decision, Jointly Hereinafter Referred To As Design Documentation In The Terms Of Reference, B) Obtaining A Map For Design Purposes And All Legally Required Conditions, Opinions, Arrangements And Administrative Decisions Necessary For The Contractor To Apply On Behalf Of The Ordering Party To The Competent Authority For Issuing A Building Permit Decision Together With Obtaining On Behalf Of The Ordering Party, The Final Decision On The Building Permit (If Required), C) Carrying Out Authors Supervision By The Authors Of The Construction Design And Detailed Designs During The Execution Of The Works, 2) Carrying Out Construction Works Based On The Developed Design Documentation, Consisting In Repairing The Waterproofing Of The External Partitions Of The Buildings Basement Used By The Border Guard And The Customs And Tax Service At The Road Border Crossing In Gronowo, Together With The Performance Of Necessary Accompanying Works, Including In Particular: A) Excavating The External Walls Of The Basement, B) Dismantling The Perimeter Drainage, C) Cleaning And Drying The External Walls, D) Execution Waterproofing And Thermal Insulation Of External Walls, E) Laying New Perimeter Drainage, F) Waterproofing The Internal Wall Separating The Part Without A Basement, G) Dismantling Sanitary, Electrical And Telecommunications Equipment And Door Joinery Along With Securing Them For Reassembly, H) Demolition Of Partition Walls , Floor Layers And Dismantling Of Damaged Underfloor Installations, I) Construction Of A Reinforced Concrete Underfloor Slab, J) Waterproofing Of The Floor On The Ground, K) Reconstruction Of Heating Of Basement Rooms In The Form Of Underfloor Heating, L) Construction Of Other Floor Layers, Including Elements Of Previously Existing Sanitary Installations, M) Building Partition Walls, N) Carrying Out Finishing Works.4. A Detailed Description Of The Subject Of The Order Is Included In The Functional And Utility Program Constituting Annexes No. 8.1 - 8.16 To The Specifications Of The Terms Of The Order, Hereinafter Referred To As Swz.5. If There Is No Obligation To Obtain A Building Permit For The Performance Of Construction Works Covered By The Subject Of The Contract, The Contractor Will Develop Design Documentation And Obtain All Necessary Opinions, Arrangements And Permits, To The Extent Necessary To Notify Construction Works Referred To In The Act Of July 7, 1994 Construction Law (Journal Of Laws Of 2024, Item 725).6. The Functional And Utility Program May Indicate Trademarks Or Origins For Certain Materials Or Devices. The Ordering Party Allows The Offer Of Materials Or Devices Equivalent To Those Indicated In The Functional-Utility Program, Provided That They Will Ensure That Parameters Are At Least At The Same Level As Those Assumed In The Functional-Utility Program And Will Be No Worse In Terms Of: 1) Functional Nature (Identity Functions),2) Technical Parameters (Strength, Durability),3) Safety Parameters Of Use.7. The Contractor Will Prepare Design Documentation In Accordance With The Requirements Of: 1) The Act Of July 7, 1994 Construction Law (Journal Of Laws Of 2024, Item 725), 2) The Regulation Of The Minister Of Development Of September 11, 2020 On The Detailed Scope And Form Of The Construction Design (Journal Of Laws Of 2022, Item 1679, As Amended),3) Regulation Of The Minister Of Development And Technology Of December 20, 2021 On The Detailed Scope And Form Of Design Documentation, Technical Specifications Of Execution And Acceptance Of Construction Works And The Functional And Utility Program (Journal Of Laws Of 2021, Item 2454).8. The Ordering Party Requires The Contractor To Include In The Offer Price Waterproofing And Moistureproofing With Products From One Manufacturer.9. By Providing The Ordering Party With The Design Documentation, The Contractor Will Also Transfer To The Ordering Party The Copyrights To The Above-Mentioned Work Resulting From The Act Of February 4, 1994 On Copyright And Related Rights (Journal Of Laws Of 2022, Item 2509), The Remuneration For The Transfer Of Copyrights Will Be Included In The Offer Price.10. The Contractor Is Obliged To Agree On The Adopted Design Solutions With The Ordering Party And To Obtain The Ordering Partys Approval Before Preparing The Design Documentation.11. If, During The Implementation Of The Subject Of The Order, There Is A Change In Legal Provisions Resulting In The Need To Adapt The Design Documentation In Order To Obtain A Building Permit, The Contractor Will Make Appropriate Changes To The Design Documentation Without The Right To Additional Remuneration.12. In Each Case When The Ordering Party Refers To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems In The Swz, Solutions Equivalent To Those Described Are Allowed.13. All Materials Used During The Execution Of The Subject Of The Order (Excluding Dismantled And Re-Assembled Equipment) Must Have A Certificate Allowing For Use In Construction.14. The Subject Of The Order Will Be Performed By The Contractor At An Active Border Crossing, Therefore The Method Of Its Implementation Requires Agreement With The Ordering Party In Order To Ensure The Proper Functioning Of The Border Crossing During This Period.15. The Contractor Is Obliged To Perform The Order In Accordance With The Principles Of Contemporary Knowledge, Applicable Regulations And With Respect For Occupational Health And Safety Principles.16. In The Event Of Interpretation Discrepancies Between The Provisions Of The Swz And The Draft Provisions Of The Contract And The Content Of The Remaining Annexes To The Swz, The Provisions Of The Swz And The Draft Provisions Of The Contract Shall Prevail.
