All Construction Works Should Be Performed In Accordance With Construction Practice And Technical Conditions To Be Met By The Buildings And Their Location. 2. A Detailed Description Of The Subject Of The Order And The Requirements For The Execution Of The Order Are Included In The Annexes To The Swz, I.E. - Annex No. 6 To The Swz - Description Of The Subject Of The Contract Along With The Bill Of Quantities, - Annex No. 7 To The Swz - Draft Provisions Of The Contract.3. Requirements Related To The Implementation Of The Order: 1) Guarantee And Warranty: The Contractor Will Provide A Warranty On The Subject Of The Order For A Period Of At Least 24 Months. The Warranty Period Starts From The Date Of Final Acceptance Of The Construction Works. The Warranty Period For The Subject Of The Contract Is The Criterion For Evaluating The Offers. The Method Of Evaluating The Offers In This Criterion Is Described In Part Xviii Of The Swz. The Contractor Will Be Liable To The Ordering Party Under The Warranty For The Subject Of The Contract For A Period Equal To The Warranty Period, Determined On The Basis Of The Contractors Offer (Within The Limits Described Above), But Not Shorter Than The Warranty Period Resulting From The Provisions Of The Civil Code. The Rules For The Use Of Guarantees And Warranties Are Specified In § 14 Of The Draft Provisions Of The Contract - Annex No. 7 To The Swz.2) Insurance: The Ordering Party Requires That The Contractor Has Valid And Paid Civil Liability Insurance For An Amount Not Lower Than The Gross Amount Throughout The Entire Order Execution Period. Remuneration Of The Contractor Under The Conditions Specified In § 13 Of The Draft Provisions Of The Contract, Constituting Annex No. 7 To The Swz.3) The Ordering Party Requires That The Contractor Has A Fleet Of Motor Vehicles (Within The Meaning Of Article 2 Point 33 Of The Act Of June 20, 1997 - Traffic Law Road) Used In The Performance Of A Public Task Had An Appropriate Number Of Electric Or Natural Gas-Powered Vehicles, Thus Meeting The Requirements Arising From The Provisions Of Art. 68 Section 3 In Connection With Art. 35 Section 2 Point 2 Of The Act Of January 11, 2018 On Electromobility And Alternative Fuels, Provided That The Execution Of The Order Requires The Use Of Motor Vehicles. The Share Of The Vehicles Referred To Above Is Calculated Using The Principle According To Which The Amount Of This Share Below 0.5 Is Rounded Downwards, And The Amount Of This Share Equal To 0.5 And Above Is Rounded Up.5. Equivalent Solutions: If The Requirements In The Description Of The Subject Of The Order Refer To A Trademark, Patent Or Origin, Source Or Specific Process That Characterizes Products Or Services Provided By A Specific Contractor, The Ordering Party Shall Indicate The Word Or Equivalent Everywhere And Allow The Possibility Of Submitting Equivalent Offers. If The Contractor Submits Proposals Equivalent To Those Described In The Description Of The Subject Of The Order (If Any), The Contractor Is Responsible For Demonstrating And Providing Proof That The Offered Supplies, Services And Construction Works Are Consistent With The Requirements Of The Ordering Party. Subject Means Of Evidence: The Ordering Party Requires The Contractor To Present In The Offer Proof Of Equivalence Confirming The Fulfillment Of The Criteria Indicated By The Ordering Party In Order To Assess The Equivalence Of The Products Or Services It Offers In Relation To Those Specified In These Studies, E.G. Technical Sheets Or Other Documents. If The Contractor Does Not Will Submit The Above-Mentioned Documents Or The Submitted Documents Are Incomplete (Thus Not Confirming The Equivalence Of The Offer In The Scope Described In The Description Of The Subject Of The Order), The Ordering Party Will Not Request Their Submission/Supplementation. If The Requirements In The Description Of The Subject Of The Order Refer To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Or Other Reference Systems Referred To In Article 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, And Such References Were Not Accompanied By The Phrase Or Equivalent, The Ordering Party Allows Solutions Equivalent To Those Described In Each Such Standard, Technical Assessment, Technical Specification Or Technical Reference System. In Such A Case, The Contractor Will Present Proof Of Equivalence In The Offer In The Manner Specified In Art. 101 Section 5 And 6 Of The Public Procurement Law.
