Part I Of The Order - Reconstruction Of The Retention Reservoir In Udorpie. The Scope Of Works Of Part I Of The Order Includes, Among Others: • Desilting The Reservoir, • Spreading The Excavated Material, • Making Fascine Bands, • Planing The Surface Of Slopes And The Bottom Of Excavations, • Topsoiling And Sowing The Slopes, • Sodding The Slopes , • Arrangement Of Gabion Baskets, • Construction Of A Fence And Installation Of A Gate And Wicket, • Purchase And Installation Of An Information Board - 1 Set. According To The Template In Annex No. 12 To The Swz. The Detailed Scope Of Works Was Included In The Design Documentation And Technical Specifications For The Execution And Acceptance Of Construction Works, Which Constitute Annex No. 9 To The Swz. The Bill Of Quantities Constitutes Illustrative Material For The Valuation. The Contractors Obligations Include: A. Taking Over The Work Site From The Employer; B. Securing And Fencing The Work Area; C. Locating And Preparing The Construction Site Facilities According To Your Needs And At Your Own Expense; D. Providing A Safety And Health Protection Plan In Accordance With Art. 21A Of The Construction Law Act;E. Providing A Material And Financial Schedule Of Works; F. Ensuring Supervision Of Property At Its Own Expense; G. Ensuring The Consumption Of Electricity And Water At Their Own Expense; H. Bearing Full Responsibility For The Use And Safety Of All Activities Carried Out On And Outside The Work Site And Related To The Execution Of The Construction Object, Also In The Case Of Third Parties Who Will Use The Area During The Works;I. The Contractor Is Obliged To Mark Out The Main Points By An Authorized Surveyor And Is Responsible For Protecting The Marked Measuring Points Until The Final Acceptance Of The Works. Damaged Or Destroyed Geodetic Signs Will Be Restored And Preserved By The Contractor At His Own Expense.J. The Contractor Is Obliged To Provide Access And/Or Access To The Property, And In The Event Of Temporary Closure Of The Access/Access, Inform The Interested Parties In Advance; K. If Protected Species Are Found During The Work, An Environmental Supervision Authority Should Be Immediately Appointed And The Fact Reported To The Appropriate Institutions. The Contractor Will Be Obliged To Provide Supervision In Order To Meet All Environmental Requirements Related To The Implementation Of The Investment At Its Own Expense And Efforts. Tidying Up The Construction Site After The Completion Of The Works, The Construction Facilities And Adjacent Areas Occupied Or Used By The Contractor, Including Renovation Of Structures, Roads Or Their Fragments, Surfaces Or Installations Destroyed Or Damaged As A Result Of The Works At Their Own Expense; M. Immediately Informing The Ordering Party (Investor Supervision Inspector) About Technical Problems And Circumstances That May Affect The Quality Of The Works Or The Date Of Completion Of The Works;N. Providing The Ordering Party With All Documents Necessary To Settle The Investment And Report The Completion Of Construction To The Appropriate Construction Supervision Inspector. The Contractor Undertakes To Perform The Subject Of The Contract In Accordance With The Attached Documentation, Principles Of Technical Knowledge And Construction Practice, Applicable Regulations And Standards, On The Terms Specified In The Contract And Swz. Before Commencing Works In Built-Up Areas, The Contractor Will Notify The Owners Of The Property And Buildings. Before Commencing The Works, The Contractor Will Also Notify The Interested Institutions And Owners Of Underground Utilities About The Commencement Of Construction. When Carrying Out Earthworks In Very Close Proximity To Buildings, Special Caution Should Be Exercised And Construction Law Regulations Must Be Strictly Observed. During The Execution Of The Works, The Contractor Will Provide, Install And Operate All Temporary Safety Devices, Thus Ensuring The Safety Of Vehicles And Pedestrians. The Contractor Will Ensure Constant Visibility Conditions During The Day And At Night For Those Devices For Which It Is Necessary For Safety Reasons. All Safety Devices Require The Approval Of The Supervision Inspector Before They Are Installed Or Set Up. The Contractor Is Obliged To Prepare And Approve The Temporary Traffic Management Design For The Works That Will Be Provided For In The Construction Documentation And Swz During Their Implementation. The Contractor Is Not Obliged To Submit Contracts To The Ordering Party For Subcontracting, The Subject Of Which Are Supplies And Services With A Value (Based On All Contracts) Not Exceeding Pln 45,000 (Say: Forty-Five Thousand Zlotys 00/100) Gross From One Subcontractor. The Ordering Party Specifies The Deadline For Payment Of The Subcontractors Remuneration Provided For In The Contract, Not Longer Than 21 Days From The Date Of Delivery To The Contractor Of An Invoice Or Bill Confirmed By The Performance Of The Ordered Service Or Construction Work As A Requirement For Subcontracting Agreements The Subject Of Which Are Construction Works, Supplies And Services, Failure To Comply With Which Will Result In The Ordering Party Reporting Reservations Or Objections, Respectively. The Contractor Will Recover Demolition Materials That May Be Used By The Investor In The Future And Will Deposit Them In The Place Indicated By The Ordering Party. The Contractor Will Dispose Of The Remaining Demolition Materials. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Documentation Describing The Subject Of The Order, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Documentation Describing The Subject Of The Contract, It Means That They Are Provided As Examples And Specify Only The Minimum Expected Quality Parameters And Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate: During The Execution Of The Order, That The Equipment And Materials Used By Him Meet The Requirements Specified By The Ordering Party. The Use Of A Label In The Documentation Describing The Subject Of The Order Means That The Ordering Party Accepts All Labels Confirming That The Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party. If The Contractor, For Reasons Beyond His Control, Cannot Obtain The Label Or Equivalent Label Specified By The Contracting Authority, The Contracting Authority, Within The Time Limit Set By Him, Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Construction Works , Deliveries Or Services To Be Performed By Him Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. The Use In The Documentation Describing The Subject Of The Contract Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Report On Tests Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Features Specified In The Description Of The Subject Of The Contract, The Offer Evaluation Criteria Or The Terms Of Contract Execution Means That The Contracting Authority Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, In The Event That A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In An Appropriate Time, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor. , And Provided That The Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Contract, The Offer Evaluation Criteria Or The Requirements Related To The Implementation Of The Contract. If The Description Of The Subject Of The Order Includes A Provision Resulting From Knr Or Knnr Indicating The Need To Use Specific Equipment With Specific Parameters In The Execution Of The Order, The Ordering Party Allows The Use Of Other Equipment Provided That It Will Ensure The Achievement Of The Assumed Design Parameters And Will Not Cause The Risk Of Non-Compliance Of The Work Performed With The Technical Documentation.
