The Subject Of The Order Includes The Performance Of Construction Works Under The Task Titled: Modernization (Reconstruction) Of The Road In Zakręt Kolonia From Km 0+000 To Km 0+739, Plot No. 931/1, 931/22. The Scope Of Works Includes: A) Preparatory Works, B) Execution Of A Leveling Layer Of Crushed Aggregate C90 / 30 / 31.5 Mm With The Addition Of Cement In The Amount Of 3%, Thickness. 10 Cm On The Section From Km 0 + 300 To Km 0 + 739, C) Surface Consolidation Of The Surface With Double Scattering Of Grit, Stone Chips With Dimensions Of 5-8 Mm - Stone Chips With A Fraction Of 2-8 Mm Are Allowed On The Section From Km 0 + 000 Up To Km 0 + 739, D) Construction Of Both-Sided Roadsides Made Of Crushed Aggregate With A Thickness Of 10 Cm After Embanking And 0.5 M Wide On The Section From Km 0 + 300 To Km 0 + 739, E) Performing An As-Built Geodetic Inventory. Note: On The Road Section From Km 0+000 To Km 0+300, It Was Carried Out As Part Of The Stage And A Leveling Layer Of Crushed Aggregate C90 / 30 / 31.5 Mm With The Addition Of Cement In The Amount Of 3% And Both Sides Of The Roadsides Hardened With Aggregate. 3. A Detailed Description Of The Subject Of The Order Is Described In: 3.1. Design Documentation, Annex No. 7 To Swz. 3.2. Stwior - Annex No. 8 To Swz.4. Bill Of Quantities - Annex No. 9 To Swz - Supporting Document. Due To The Fact That The Contractors Remuneration Indicated In The Offer Will Be A Lump Sum, When Pricing The Offer, The Contractor Should Rely On The Scope Indicated In The Technical Documentation Referred To In Point 3 Of Chapter Iii Of The Swz. The Bill Of Quantities Is Of An Auxiliary Nature. The Occurrence, During The Implementation Of The Contract, Of Works Not Included In The Bill Of Quantities Or Works In A Larger Quantity Than That Accepted In The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration - If These Works Were Included In The Technical Documentation Referred To In Point 3 Of Chapter Iii Of The Swz And Stwior. Any Lack Of Necessary Works Resulting From The Technical Documentation In The Bill Of Quantities Does Not Release The Contractor From The Obligation To Perform Them Based On The Design At The Contract Price. The Contractor Has The Right To Adjust The Amount Of Work Given In The Bill Of Quantities To The Amount According To His Own Calculations Based On Technical Documentation And Other Technical Documentation In Accordance With The Principles Of Construction Practice.5. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Design Documentation, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Design Documentation Or Technical Specification For The Execution And Acceptance Of Works, It Means That They Are Provided As Examples And Only Define Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation Equivalent Will Be Obliged To Demonstrate During The Execution Of The Order That The Equipment And Materials Used By Him Meet The Requirements Specified By The Ordering Party. The Use Of A Label In The Design Documentation Means That The Ordering Party Accepts All Labels Confirming That The Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Specified By The Ordering Party. Labels. If The Contractor, For Reasons Beyond His Control, Cannot Obtain The Label Or Equivalent Label Specified By The Contracting Authority, The Contracting Authority, Within The Time Limit Set By Him, Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Construction Works , Deliveries Or Services To Be Performed By Him Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. The Use In The Design Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Report On Tests Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Features Specified In The Description Of The Subject Of The Contract, Offer Evaluation Criteria Or Contract Performance Conditions Means That The Contracting Authority Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, In The Event That A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In An Appropriate Time, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor. , And Provided That The Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Contract, The Offer Evaluation Criteria Or The Requirements Related To The Implementation Of The Contract. If The Description Of The Subject Of The Order Includes A Provision Resulting From Knr Or Knnr Indicating The Need To Use Specific Equipment With Specific Parameters In The Execution Of The Order, The Ordering Party Allows The Use Of Other Equipment As Long As It Ensures The Achievement Of The Assumed Design Parameters And Does Not Cause The Risk Of Non-Compliance Of The Work Performed With The Technical Documentation. The Ordering Party Does Not Requires The Means Of Evidence In Question In These Proceedings.
