1. The Subject Of The Order Is The Construction Of A Surface On A Municipal Road In The Town Of Przecznia With A Length Of 2,577.43 Meters. Structural Cross-Sections Of The Surface: Layers From The Subgrade: A) Lower Leveling Of The Existing Subgrade With Dolomite Crushed Stone. About Fr. 0/63 Mm Thick 15 Cm, B) Upper Wedging Of The Crushed Stone With A Dolomite Wedge. About Fr. 0/31.5 Mm Thick 5 Cm, C) Closing Layer - Triple Surface Consolidation Of The Surface With Grit And Asphalt Emulsion: I Layer (Bottom) - Sprinkling With Cationic Emulsion In The Amount Of 2.50 And Laying A Layer Of Dolomite Aggregate - Grit With A Fraction Of 8/12 Mm In The Amount Of 20 Kg/M2ii Layer/Intermediate/ - Sprinkling With Cationic Emulsion In The Amount Of 2.0 Kg/M2, And Laying Dolomite Grits With A Fraction Of 5/8 Mm In The Amount Of 19 Kg/M2iii Layer/Running/ - Sprinkling With Cationic Emulsion In The Amount Of 1.50 Kg/M2 And Laying Basalt Grits With A Fraction Of 2/5 Mm In An Amount Of 15 Kg/M2.2. The Subject Of The Order Should Be Performed In Accordance With The Description Of The Subject Of The Order, Design Documentation And The Draft Provisions Of The Agreement, Which Constitute Annexes To The Swz.3. A Detailed Description Of The Subject Of The Order Is Included In The Documentation Attached To The Swz. If The Documents Constituting The Description Of The Subject Of The Contract Indicate The Trade Name Of The Company, Goods Or Product, The Ordering Party - In Relation To The Parameters Or Data (Technical Or Any Other) Indicated Directly In The Tender Documentation, Identifying The Goods Or Product Directly Or Indirectly - Allows Solutions Equivalent In Accordance With The Technical Data And Parameters Contained In The Above-Mentioned Documentation. Equivalent Solutions Should Be Understood As Solutions With Parameters Not Worse Than Those Required And Included In The Documentation. If The Ordering Party Allows Equivalent Solutions Described In The Documentation, But Does Not Provide The Minimum Parameters That Would Confirm This Equivalence - The Contractor Is Obliged To Offer A Product With Similar Properties, Functionally Suitable For The Required Application. Proper Names Are Only Of Auxiliary Nature To Determine The Basic Parameters And Features Of The Materials Used. A Proper Name Is The Name Under Which The Object It Denotes Occurs (Or Would Occur) Both In Poland And In Other Countries.4. The Contractor Should Remember, Notwithstanding Any Limitation Suggested By The Description Of Each Item And/Or The Explanation In The Bill Of Quantities, That The Price Quoted In The Bid Constitutes Payment For Work Performed And Completed In All Respects. The Contractor Shall Be Deemed To Have Taken Into Account All Requirements And Obligations Whether Specified Or Implied In The Bill Of Quantities.5. The Contractor Is Obliged To Start Construction Works Immediately After Handing Over The Construction Site, Provided That The Works Must Not Prevent Access To The Property And Agricultural Crops.6. The Contractor Is Also Obliged, After Completing The Task, To Prepare A Material And Financial Settlement To The Extent Agreed With The Ordering Party, And, If Necessary, To Prepare As-Built Cost Estimates. 7. The Detailed Scope Of Works Was Specified In The Technical Design Documentation, Cost Estimates And Bills Of Quantities And Stwior (Detailed Technical Specification) Constituting Annexes To This Swz. 8. The Removal And Disposal Of Waste Generated As A Result Of The Works Is The Responsibility Of The Contractor.9. The Ordering Party Allows The Use Of Materials Other Than Those Listed In The Swz And Annexes With Parameters No Worse Than Those Specified In The Swz And Annexes.10. All Names Of Products And Manufacturers, If They Appear In The Swz And Annexes (Including Design Documentation), Are For Example Purposes Only. 11. The Ordering Party Allows Standards Equivalent To Those Listed In The Documentation And Swz. 12. The Task Is Carried Out With The Participation Of External Funds, The Contractor Will Be Obliged To Make 3 Information Boards About The Granted Funding (In Consultation With The Ordering Party).13. Payment Terms: The Ordering Party Provides For Partial Payments For The Execution Of The Subject Of The Order.14. The Ordering Party Anticipates The Following Acceptances And Payments For The Execution Of The Subject Of The Order: The Ordering Party Plans Payment In Two Tranches. 1) 1St Payment In 2024 In The Amount (According To The Agreed Schedule) Of Pln 1,754,235.00 Gross Within 30 Days From The Date Of Submission Of A Correctly Issued Invoice At The Registered Office Of The Ordering Party, But Not Earlier Than After Partial Acceptance Of The Works Without Reservations. Application For Acceptance Of Partial Stage I Should Be Made By July 31, 2024. 2) Second Payment In 2024, The Remaining Amount Less Than 20% Of The Remuneration Within 30 Days From The Date Of Submission Of A Correctly Issued Invoice At The Registered Office Of The Ordering Party, But Not Earlier Than After Final Acceptance Of The Works Without Any Reservations. The Completion Of The Task For Final Acceptance Should Be Reported By October 31, 2024.
