Description Of The Subject Of The Order.1. The Subject Of The Procedure And Order Is The Selection Of A Contractor To Act As The Investors Supervision Inspector Over The Implementation Of Construction Works Related To The Implementation Of The Task Entitled: Adaptation And Modernization Of The Badenich Manor In Wadowo, For The Municipal Greenery Board In Krakow. Procedure No. Np.26.2.35.24.Kk4.1.1 Pursuant To Art. 310 Of The Public Procurement Act, The Ordering Party Provides For The Possibility Of Invalidating The Proceedings In Question If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Granted To It. 1.2 As Part Of The Order, Investor Supervision Services Should Be Provided Over The Execution Of Construction Works Related To The Implementation Of The Task Titled .: Adaptation And Modernization Of The Badenich Manor In Wadowo.1.3 A Detailed Description Of The Subject Of The Order Is Presented In Annex A To The Swz - Description Of The Subject And Material Scope Of The Order.1.4 The Ordering Party Reserves The Right To Exercise The Option Right Specified In Art. 441 Of The Public Procurement Law, I.E. Increasing The Scope Of The Subject Of The Contract. Part Of The Subject Of The Order Described In The Swz And The Contract For The Provision Of Supervision Services Is Covered By Option Rights No. 1, No. 2 And No. 3, Therefore The Ordering Party May, But Does Not Have To, Commission The Contractor To Perform The Part Of The Order Covered By The Option Right Or Its Specific Scope. The Contractor Is Not Entitled To Any Claims Due To The Ordering Partys Failure To Exercise The Option Right In Whole Or In A Specific Part. The Ordering Party Guarantees The Execution Of The Basic Order. The Contractor Is Entitled To Remuneration For The Scope Of The Contract Actually Completed. The Option Right Concerns The Provision Of Investor Supervision Services Over The Performance Of Further Construction Works Related To The Implementation Of The Task Adaptation And Modernization Of The Badenich Manor In Wadowo. The Ordering Party Makes The Exercise Of The Option Right In Whole Or In Part Dependent On The Allocation Of Additional Financial Resources For Their Implementation During The Order Execution Period.
