Pursuant To Art. 95 Of The Public Procurement Law, The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Construction Works (Indicated In The Bill Of Quantities) Related To The Implementation Of The Subject Of The Contract, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465).6. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. The Ordering Party Expects To Pay The Remuneration In Parts On The Terms Described In The Draft Provisions Of The Contract (Appendix No. 8 To The Swz). The Ordering Party Does Not Provide For Advance Payments For The Execution Of The Order. 8. The Ordering Party Does Not Allow The Submission Of Partial Offers. Justification: The Order Was Not Divided Into Parts Due To The Small Scope Of Individual Works. Dividing The Order Into Parts Would Generate Additional Costs For Individual Contractors In Organizing Construction, Transporting Equipment, Purchasing And Transporting Materials. Carrying Out Works On Several Separate Parts Could Cause Difficulties In Supervising The Works As Well As Difficulties In Access To Forest Management Sites. The Scope Of The Order Does Not Affect Competition And Does Not Limit The Ability Of Smaller Entities To Apply For The Order Because The Qualification Criteria Do Not Limit The Participation Of Small And Medium-Sized Enterprises.
