This Order Is Financed Under The Operational Program Cinema Development, Priority Ii. Digitization Of Cinemas By The Polish Film Institute.3. The Scope Of Work For The Implementation Of This Order, Within The Proposed Price, Includes Transport, Unloading And Assembly Of Equipment In The Premises Of The Promień Cinema In Rawicz (63-900), Ul. Przyjemnskiego 35, As Indicated By The Ordering Party, In Particular The Delivery And Assembly Of Individual Devices Constituting The Subject Of The Order And The Provision Of Installation, Configuration And Alignment Services Of The Equipment, As Well As Conducting Training In The Operation Of The Device. 4. The Detailed Scope Of The Order, Constituting The Description Of The Subject Of The Order, Was Determined By Means Of A Tabular Summary Of The Order Constituting A Component Of The Description Of The Subject Of The Order, Constituting An Integral Part Of These Terms Of Reference. The Above-Mentioned Documents Are Posted On The Website Of The Conducted Procedure.5. The Contractor Is Obliged To Deliver Equipment That Is Brand New, Of Full Value, Originally Packed, Manufactured In Accordance With Standards, No Part Of The Equipment May Be Used, Show Signs Of Damage, Etc. All Equipment Must Have Appropriate Certificates Or Declarations Of Conformity And Approvals Allowing For Use, Must Meet The Requirements Contained In The Swz, And Must Also Be Approved For Marketing And Use In Eu Countries.6. The Contractor Will Provide Complete Equipment With All Cables, Components, Etc. Necessary For Its Proper Use Without Additional Costs And Purchases.7. The Subject Of The Procurement Contract Will Be Performed In Accordance With The Provisions Contained In This Specification And The Draft Contract Constituting An Annex To The Swz.8. When Carrying Out The Task, Within The Offered Bid Price, The Contractor Will Also Be Obliged To: 1) Put Into Operation Individual Equipment, 2) Train Employees In The Operation Of The Devices, 3) Upload Appropriate Programs (If Applicable), 4) Comply With Applicable Occupational Health And Safety And Fire Protection Regulations And Secure The Premises In Which The Task Will Be Carried Out Against Dirt, Dust And Damage, 5) Insurance Of The Area Covered By The Order Against Damage That May Occur In Connection With Specific Random Events And Against Civil Liability, Bearing The Costs Of Damage Resulting From The Execution Of Works, As Well As Bearing Liability For Any Events Arising From This Reason (Having A Valid And Paid Insurance Policy During The Order Execution Period And Presenting It To The Ordering Party Upon Each Request Within 2 Days From The Date Of Request), 6) Organization And Development Of The Place Of Assembly Works And, If Necessary, Implementation Of A Safety Plan And Health Protection In Accordance With The Regulation Of The Minister Of Infrastructure Of June 23, 2003 On Information Regarding Safety And Health Protection And The Safety And Health Protection Plan (Journal Of Laws U. Disposal Should Be Carried Out In Accordance With The Provisions Of The Act Of December 14, 2012 On Waste (Journal Of Laws Of 2022, Item 699) And Its Cost Should Be Included In The Offer Price, 8) Maintaining The Place Of Assembly Works (Repairs, Water, Energy Electricity, Telephone, Etc.),9) After Completing The Work To Restore The Area To Its Original Condition, Dismantling Temporary Structures And Tidying Up The Entire Area Occupied For The Work,10) Granting A Warranty And Quality Guarantee For The Delivered And Installed Equipment, In Accordance With The Submitted Offer (From 24 - 36 Months).9. The Ordering Party Orders A Site Visit Before Submitting The Offer.10. The Documents Constituting The Basis For The Implementation Of The Public Procurement In Question Should Be Treated As Mutually Explanatory, In The Order Listed Below, For The Purposes Of Interpreting The Validity Of The Provisions: A) Contract And Swz, B) Tabular Summary Of The Contract. C) The Contractors Offer.11. All Products Listed In The Documentation Should Meet The Requirements Resulting From Polish Standards Translating European Standards Pn-En (Harmonized Standards). If Any Polish Standard Transposing European Standards Is Not Mentioned In These Documents And Applies To The Product Intended For Installation, The Contractor Is Obliged To Apply This Standard.12. Indications Of Trademarks, Patents Or Origin, Source Or Specific Process That May Appear In The Description Of The Subject Of The Contract That Characterize The Products Or Services Provided By A Specific Contractor Were Used Solely To Indicate The Assumed Standard Of The Adopted Solutions And Constitute A Condition Of Equivalence For Alternative Solutions. It Should Always Be Assumed That Such An Indication Is Accompanied By The Words Or Equivalent. The Ordering Party Informs That It Allows The Submission Of Offers Equivalent To The Indicated Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, However, The Following Conditions Must Be Observed: Be Norms, Standards And Technical Parameters Characterized By The Devices Required By The Ordering Party, Which Will Guarantee The Execution Of The Order In Accordance With The Tor And Its Annexes. The Presented Parameters Of The Subject Of The Order Constitute The Technical And Qualitative Minimum Expected By The Ordering Party And Will Constitute The Basis For The Assessment Of Possible Equivalent Offers. Equivalent Devices Offered By Contractors Must Have Parameters No Worse Than Those Indicated In The Order Documents, Which Will Guarantee Proper Delivery. 13. Indications Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, Solutions Equivalent To Those Described Are Allowed, And Such A Reference Is Accompanied By The Words Or Equivalent.
