1. The Subject Of The Order Is The Performance Of Construction Works As Part Of The Investment Task Entitled: Renovation Of Sanitary Facilities At Primary School No. 1. Tadeusz Kościuszki In Nowy Targ”Main Subject: Cpv 45210000-2 Construction Works In The Field Of Buildings2. Construction Works Include In Particular: 1/ Dismantling Partition Walls Separating Toilets, Cutting Off Tiles, Dismantling Equipment, 2/ Making New Wall And Floor Coverings, 3/ Painting Walls And Ceilings, 4/ Replacement Of Sanitary Installations (Water And Sewage, Central Heating), 5/ Replacement Of Electrical Installations, 6/ Delivery And Installation Of Equipment (Toilet Bowls, Washbasin Faucets, Urinals, Hpl System Toilet Cabins).3. The Detailed Scope Of The Subject Of The Order Is Specified In The Documentation Prepared By The Company: Tebeo-Projekt Firma Projektowo-Budowlana S. C. Marcin Kowalski Tomasz Łach Ul. Szaflarska 124/58, 34-400 Nowy Targ.4. Other Provisions Regarding The Subject Of The Order: 1/ Construction Cost Estimate, With The Price Components Given In The Offer For This Procedure, In An Amount Not Higher Than The Contractual Amount, The Final Settlement Will Be Based On A Cost Estimate After The Order Is Completed, With The Price Components Given In The Offer Cost Estimate. Unit Prices Will Not Be Changed Throughout The Duration Of The Contract. 2/ No Remuneration Is Due For Works Not Performed As Unnecessary, Although Covered By The Offer Cost Estimate And Specification, 3/ The Contractors Remuneration Will Be Paid Based On The Material And Financial Schedule, Including Partial Invoices Issued On The Basis Of Protocols Partial Acceptance, Before Signing The Contract, The Contractor Will Submit A Material And Financial Schedule To The Ordering Party For Approval. 4/ The Works Should Be Performed In Accordance With The Bill Of Quantities, Sst And In Compliance With The Conditions Arising From The Technical Standards For The Execution And Acceptance Of Construction Works And In Accordance With The Requirements Of The Construction Law, 5/ The Contractor Is Responsible For Ensuring Safe Conditions At The Construction Site And Its Surroundings.6/ The Contractor Undertakes To Perform The Full Scope Of Works Specified In The Subject Of The Order, Including Those Not Specified In The Design Or Other Documents, But Necessary For The Execution Of The Order,7/ All Necessary Materials Are Secured By The Contractor ( This Also Means That He Will Incur Related Costs),8/ Renovation Works Should Be Carried Out In Consultation With The Principal Of Primary School No. 1, 9/ The Facilities And Construction Site Should Be Organized In Consultation With The Principal Of Primary School No. 1, 10/ The Contractor Will Secure The Site And Will Bear The Costs Of Removal Of Rubble, Demolition Elements, Etc., Including Their Storage, Management Or Disposal, 11/ The Contractor Is Fully Liable For Damages And Consequences Of Accidents Resulting From Improper Performance Of The Work Or Improper Marking And Securing Of The Work Site, 12/ The Contractor Is Responsible For Ensuring Safe Conditions On The Construction Site And Its Surroundings,13/ The Contractor Is Obliged To Conclude A Civil Liability Insurance Contract For Damage And Consequences Of Accidents,14/ The Contractor Is Obliged To Know And Apply The Regulations On Environmental Protection While Carrying Out The Works. Fees And Penalties For Exceeding The Standards Specified In The Relevant Environmental Protection Regulations During The Implementation Of Works Will Be Borne By The Contractor,15/ The Ordering Party Requires At Least A 5-Year Quality Guarantee Period For The Construction Works And Incorporated Materials, 16/ In The Specifications Of The Contract Terms And In All Documents Constituting Annexes To The Specification Of The Terms Of The Contract (Technical Specification For The Execution And Acceptance Of Construction Works), The Indicated Trademarks, Patents, Origin Or Standards, Specifications, Systems Should Be Understood As Examples And Should Be Considered With The Words Or Equivalent Or Not Worse Than. Ordering Party , Bearing In Mind That If The Manufacturers Name, Proper Names, Trademarks, Patents Or The Origin Of Materials Used To Perform Construction Works That Are The Subject Of The Contract Are Indicated In Any Place In The Specification Of The Terms Of The Contract And Its Annexes, It Allows The Use Of Equivalent Materials. This Means That The Devices And Materials Intended By The Contractor To Be Used At The Stage Of Execution Of The Works Should Meet At Least The Parameters Specified In The Design Documentation And Should Not Be Worse Than Its Assumptions. The Ordering Party Allows Any Market Equivalents With Parameters Equal Or Better Than Those Indicated. The Burden Of Proving That The Material (Product) Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Person Submitting The Offer. In Such A Case, The Contractor Must Submit Appropriate Documents Describing Technical Parameters, Certificates Required By Law And Other Documents Authorizing The Use Of Given Materials (Products) And Allowing It To Be Clearly Stated That They Are Actually Equivalent Or Better. All Materials That Will Be Built Or Installed Must Be Previously Approved By The Ordering Party In Writing.
