The Subject Of The Order Is The Performance Of Construction Works Within The Meaning Of The Act Of July 7, 1994, Construction Law (Consolidated Text: Journal Of Laws Of 2023, Item 682, As Amended) As Part Of Post-Consolidation Development Works Within The Scope Of The Project Under The Name Consolidation Of Land Located In The Area Of ​​The Village Of Boratyn, Chłopice Commune Implemented Under The Rural Development Program For 2014-2020, In Order To Prepare Newly Designated Plots For Rational Agrotechnical Works.2. Construction Works Constituting The Subject Of The Order Include: 1) Construction And Reconstruction Of Agricultural Transport Roads And Access Roads To The Farm Buildings Of The Participants Of The Consolidation Procedure, Including The Installation Of Culverts And Bridges; 2) Construction Of Culverts Under Roads With Reinforcements At The Entrances And Exits To The Plots; 3) Construction And Renovation And Correction Of The Route Of Water Drainage Devices, I.E. Drainage Ditches And Drainage And Water Drainage Systems, As Well As Improvement Of Their Technical Parameters; 4) Land Reclamation, Including The Removal Of High And Unnecessary Balks, Slopes And Fallow Land, Ravines And Old Roads By Fertilizing Soil, Plowing And Harrowing, Anti-Erosion Protection And Removal Of Trees And Bushes; 5) Other Works, Including: Fertilizing Soil And Strengthening The Slope, Leveling The Plot / Eliminating The Old Ditch, Clearing / Leveling The Area, Correcting The Course Of The Slope Along With Its Strengthening, Removing The Hardening Of The Old Road , Lining A Deep Water Drainage Channel.3. A Detailed Description Of The Subject Of The Order And The Scope Of Construction Works Necessary To Be Performed Are Specified In The Design And Technical Documentation, Which Includes: 1) Construction Design: Reconstruction Of Roads, Construction Of Ditches And Recultivation As Part Of The Task: Post-Consolidation Development Of Land In The Area Of ​​The Village Of Boratyn, Chłopice Commune, In The Scope Project Regarding Land Consolidation Under The Rural Development Program For 2014-2020: A) Land Development Design, B) Architectural And Construction Design, C) Technical Design; 2) Executive Design Reconstruction Of Roads, Construction Of Ditches And Reclamation Under The Task: Post-Consolidation Development Land In The Area Of ​​The Village Of Boratyn, Chłopice Commune, In The Scope Of The Project Regarding Land Consolidation Under The Rural Development Program For 2014-2020;3) Decisions, Opinions, Arrangements, Technical Conditions;4) Maps;5) Geotechnical Documentation;6) Bioz;7) Bills Of Quantities Prepared For Individual Industries/Works.8) Technical Specifications For The Execution And Acceptance Of Construction Works.4. The Bills Of Quantities Provided By The Ordering Party, I.E. Their Scope, Should Constitute Only The Basis For Preparing An Accurate Valuation Of The Construction Works That Are The Subject Of The Order. All Works Described In The Bill Of Quantities For This Order Should Be Valued, Taking Into Account All Direct And Indirect Costs That The Contractor Deems Necessary To Properly Perform The Subject Of The Order And Achieve The Intended Purpose.5. Both The Scope Of The Bills Of Quantities For Individual Industries/Works And The Measurements Included In Them Should Be Treated As Illustrative And As Auxiliary Materials Intended To Facilitate The Correct Calculation Of The Lump-Sum Offer Price In The Manner Described In The Swz. They Cannot Constitute The Only Basis For Preparing An Accurate Valuation Of The Construction Works That Are The Subject Of The Contract.6. As Part Of The Execution/Execution Of The Order, In Accordance With The Provisions Of The Swz And The Contract Concluded For The Execution Of The Order, The Contractor, With Its Own Efforts And At Its Own Expense: 1) Will Provide A Construction Manager With Appropriate Qualifications To Manage The Construction Site And The Necessary Construction Licenses, In Accordance With The Provisions Of The Act Of July 7 1994 Construction Law And Belonging To The Appropriate Chamber Of Professional Self-Government And Having The Required Civil Liability Insurance; 2) If Necessary Or Required By Law, It Will Provide Managers Of Industrial Works With The Necessary Construction Qualifications, In Accordance With The Provisions Of The Act Of July 7, 1994 Construction Law And Those Belonging To The Relevant Chambers Of Professional Self-Government And Having The Required Civil Liability Insurance;3) Within 30 Days From The Date Of Conclusion Of The Contract For The Execution Of The Order, Submit Appropriate Applications To The Competent Authority For Permission To Cut Down Trees;4) Submit To The Owners Of The Plots. Wood From The Felling Of Trees And Bushes;5) Will Manage Waste Generated In The Course Of Its Own Works And Will Bear The Costs Of Its Removal Together With The Costs Of Storage And Disposal;6) If Necessary Resulting From Legal Provisions, Will Report To The Appropriate Authorities For The Collection Of Completed Works. In The Manner Specified In The Provisions Of The Act Of December 14, 2012 On Waste (Consolidated Text: Journal Of Laws Of 2023, Item 1587, As Amended) And The Act Of 13 September 1996 On Maintaining Cleanliness And Order In Municipalities (Consolidated Text: Journal Of Laws Of 2024, Item 399);3) Bear All Costs Necessary For The Proper Performance Of The Order, Including All Fees Related To The Performance Of The Contract, Previously Unforeseen , And Arising During Or As A Result Of The Implementation Of Works / Works Related To The Execution Of The Order / Contract; 4) In The Event Of The Need To Perform Replacement Works, To Perform Them Without Charging The Ordering Party With Additional Unjustified Costs; 5) In The Event Of The Need To Perform The So-Called Additional Works, To Be Performed On The Basis Of The Same Price Factors (R, S, Kp, Kz, Z) That Will Be Shown In The Bid Cost Estimate, And If There Are No Such Price Factors In The Submitted Bid Cost Estimate And Their Interpolation Is Not Possible, On Based On Price Factors Included In The Current Sekocenbud Price Lists.8.
