The Subject Of The Order Are Construction Works Entitled: Maintenance And Renovation Of The Fence Of The Municipal Hospital In Giżycko - Along Warszawska Street, Plots No. 255/32, 255/34, 255/35, District 0002 City Of Giżycko, Giżycko Municipality.2 . The Basic Scope Of Works Includes In Particular: A) Cleaning Of The Façade Surface And Removal Of The Secondary Painting Layer, B) Removal Of Degraded, Destabilized Ceramic Elements And Secondary Cement Fillings As Well As Degraded Or Crumbling Grouting And Secondarily Made Of Strong Cement Mortars, C) Masonry Reconstruction Of Defects, D) Filling The Gaps, E) Color Blending The Brick Surfaces Of The Fence And Carrying Out Hydrophobization, F) Cleaning The Surfaces Of The Steel Spans, G) Replacing The Missing Decorative Elements Of The Steel Fence And Straightening The Bent Elements Of The Steel Fence. The Contractor Is Obliged To Obtain A Certificate From The District Construction Supervision Inspector Confirming The Lack Of Grounds For Raising An Objection Referred To In Art. 30 Section 5Aa Of The Act Of July 7, 1994 - Construction Law (If Required). 4. The Contractor Will Receive A Power Of Attorney To Represent The Ordering Party In Activities Related To Obtaining Appropriate Decisions. 5. The Subject Of The Order Includes The Performance Of All Necessary Works In Accordance With: A) The Provisions Of The Swz Together With Annexes, Questions And Answers Provided During The Public Procurement Procedure, B) Technical Documentation, C) Technical Specification For The Execution And Acceptance Of Works, D) Technical Conditions , Standards, Regulations, Administrative Consents, E) Draft Provisions Of The Contract, F) Bills Of Quantities, G) Decision Of Approval Of The Construction Design And Building Permit No. 281.2023 Of July 31, 2023, H) Conservation Recommendations Of The Provincial Conservator Of Monuments Of January 17, 2023, Reference Number: Wuoz-Elk.5183.7.2023.Js. The Above-Mentioned Documents Should Be Treated As Mutually Complementary And Explanatory.6. The Contractor Will Perform The Subject Of The Order On The Basis Of Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb), Swz Together With Annexes, Questions And Answers Provided During The Public Procurement Procedure And Bills Of Quantities, As Well As Applicable Detailed Regulations And Construction Practice, And Will Provide The Necessary Surveying Services Along With The Warranty Period. 7. The Ordering Party Requires Special Care In Carrying Out The Works, In Particular Ensuring Appropriate Security And Protection, Keeping The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Expose People Using The Given And Neighboring Properties To The Scope Of The Investment Task. Due To The Above, The Contractor Must Include The Costs Of Securing The Performance Of Works In The Offer Price. This Cost Should Be Included In Indirect Costs. 8. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing Activities Related To The Execution Of The Order, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (Consolidated Text: Journal Of Laws Of 2023, Item 1465, As Amended). The Above Requirement Of Employment Under An Employment Relationship Applies To Manual Workers Directly Performing Construction Works Covered By The Subject Of The Contract In Scope Of: A) Renovation Works, B) Renovation Works, C) Concrete Works, D) Insulation Works, E) Masonry Works, F) Painting Works. The Above Requirement Does Not Apply To Freelancers, Including Designers, Construction Managers And Works Managers. 9. By The Date Of Signing The Contract, The Contractor Is Obliged To Submit A List Of These Persons Along With A Statement Confirming Their Employment Under An Employment Contract, And, At The Request Of The Ordering Party, Evidence Indicating Their Employment Under An Employment Contract. After Concluding The Contract, The Contractor Is Also Obliged, At Each Request Of The Ordering Party, To Submit A List Of Persons Along With A Statement Confirming Their Employment Under An Employment Contract And That They Are Not In Arrears With The Payment Of Remuneration As At The Date Of Submitting The Statement. At Each Stage Of The Implementation Of The Subject Of The Contract, The Ordering Party Has The Right To Demand That The Contractor Prove That People Are Employed Under An Employment Contract. 10. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 11. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On An Employment Relationship Are Specified In The Draft Provisions Of The Contract, Constituting Annex No. 6 To Swz.12. The Ordering Party Does Not Reserve The Right To Apply For The Contract Only By Contractors Referred To In Art. 94 Of The Act And Does Not Provide For The Requirements Referred To In Art. 96 Of The Act.
