The Subject Of The Contract Is Construction Of Sports Infrastructure In Objazd - Stage Ii As Part Of The Task Entitled Construction Of A Complex Of Sports Fields And Running Tracks With Infrastructure Covering The Sanitary, Energy And Construction Sectors Under The Government Fund Polish Order: Strategic Investment Program, Hereinafter Referred To As The Subject Of The Contract Or, Alternatively, The Subject Of The Order In The Contract.2. The Subject Of The Contract, Interchangeably Referred To As The Subject Of The Order, Includes The Implementation Of Construction Works On Plot No. 27/1 At The Primary School In Objazda (In Accordance With The Construction Design For The Above-Mentioned Task Constituting An Annex To The Description Of The Subject Of The Order). 3. The Purpose Of The Construction Works In Question, Stage Ii, Is The Construction Of: 1) The Pumptrak Bicycle Track Along With Elements Of Small Architecture; 2) A Tennis Court With A Pneumatic, Arched Covering And Equipment; 3) Football Pitches With Equipment; 4) Drainage Of The Pitch Area, Drainage Of Rainwater From Paved Areas And Roofing Via A Sewage System To The Existing Reservoir Constructed In Stage I; 5) Single-Track Athletics Track For Long Jump; 6) System Of Communication Routes; 7) Pitch Fences With Ball Handles; 8) Lighting, Monitoring; 9) And Execution Of Works In Accordance With Legal Provisions, Including Relevant Legal Acts And Standards. 4. The Scope Of The Subject Of The Order Includes: 1) Construction Works, Including: • Works Related To Site Preparation, Including: Earthworks For The Construction Of Facilities Such As A Pumptack Track, A Tennis Court With A Pneumatic Roof, A Football Pitch, A Single-Track Long Jump Track And Other Elements Necessary For The Proper Functioning Of The Facility; • Works Related To The Construction Of A Pitch With A Natural Grass Surface With The Parameters Of Sports Grass; • Works Related To The Renovation Of The Existing Fence, Including: Improving The Anchoring Of Fence Posts; • Works Related To The Construction Of Ball Catchers; • Works Related To The Construction Of A Pump Track; • Works Related To The Construction Of A Single-Track Long Jump Athletics Track; • Works Related To The Construction Of A Tennis Court With A Roof Covered With Pneumatic Coating; • Works Related To The Assembly Of Small Architecture; • Other Works Included In The Documentation Attached To The Procedure. 2) Electrical Works, Including: • Works Related To The Construction Of The Electrical Network And Telecommunications Cable Ducting; • Works Related To The Heating Installation Of The Tennis Court; • Works Related To The Installation Of An Electrical Switchboard; • Works Related To The Assembly Of Lighting Masts / Poles; • Works Related To The Installation Of Hoop Iron Connecting All Poles/Masts; • Works Related To Grounding Masts/Lighting Poles; • Works Related To The Installation Of A Lighting Control System For The Pitch, Pump Track And Tennis Court, Along With Laying Control Cables To All Connectors; • Works Related To The Monitoring Installation, I.E. Rotating Camera - Min. 2 Sets And External Ip Camera – 6 Sets; • Other Works Included In The Documentation Attached To The Procedure Related To The Construction Of A Sports Field, Etc. 3) Sanitary Works, Including: • Works Related To The Construction Of A Rainwater Drainage System - Within The Scope Of This Tender Procedure, The Construction Of The Network In The Scope Of The Junction: Ol1 - D1 Should Be Taken Into Account – D1a – Ol1a – D1a – Sp – D4 Ol2 – Ol5 – Ol4 – D2- D4 • Works Related To The Construction Of Linear Drainage; • Works Related To The Construction Of An Irrigation System For A Pitch With A Natural Grass Surface With The Parameters Of Sports Grass; • Works Related To The Construction Of A Drainage System For A Pitch With A Synthetic Grass Surface; 4) Equipment: • Equipping The Pitch With Cabins For Reserve Players; • Equipping The Pitch With Goals; • Equipment With Other Elements Included In The Documentation Attached To The Procedure. 5) A Detailed Description Of The Subject Of The Order Is Set Out In The Terms Of Contract Attached To This Specification: Draft Contract, Description Of The Subject Of The Order, Design Documentation, Technical Specification For The Execution And Acceptance Of Construction Works And, Additionally, The Bill Of Quantities, Which Constitute An Integral Part Of The Contract As Annexes. The Bill Of Quantities Is An Auxiliary Document For The Preparation Of The Offer. 6) The Works Must Be Performed In Accordance With The Construction Documentation, Applicable Regulations, Standards And On The Terms Agreed In The Contract. 7) The Contractor Assumes The Obligations Specified In The Contract And Related To The Performance Of Services And Construction Works. The Contractor Undertakes To Perform All Obligations Arising From The Contract For The Execution Of The Order In Good Faith And With Professional Diligence. In Particular, The Contractor Is Obliged To Comply With Legal Provisions. The Contractor Is Fully Responsible For The Performance Of All Services That Are The Subject Of The Contract And For The Persons Or Entities With Whose Help The Contractor Performs His Duties Or To Whom He Entrusts Their Performance. 8) Under The Contract, The Contractor Will Be Obliged To Obtain Documents Necessary To Start The Works. 9) The Contractor Is Obliged To Perform Construction Works Constituting The Subject Of This Order Only Using Brand New Materials And Devices, Approved For Trading And For General Or Individual Use In Construction, Covered By A Certificate In The Field Of The So-Called Safety Mark Indicating Compliance With The Polish Standard, Technical Approval And Relevant Technical Regulations In Accordance With Art. 10 Of The Act Of July 7, 1994 - Construction Law (Consolidated Text: Journal Of Laws Of 2023, Item 682, As Amended). 10) Wherever The Subject Of This Contract Is Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process Or By Reference To European Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows The Contractor To Use Solutions Equivalent To To Those Described By The Ordering Party, Provided That They Have At Least The Same Or Better Technical And Functional Parameters And Do Not Lower The Standards Specified In The Design Documentation. The Offered Equivalent Solution May Not Result In The Need To Redesign The Design Documentation. 11) The Ordering Party Allows The Use Of An Equivalent Solution And Pursuant To Art. 99 Section 6 Of The Public Procurement Act Specifies The Following Criterion For Assessing Equivalence, Which Applies To All Materials (Products) And Devices Specified In The Entire Design Documentation And Other Documents Describing The Subject Of The Contract, Namely, The Condition For Using An Equivalent Material Or Device Is To Meet All Of The Following Requirements: 1 ) The Material (Alternatively, The Product) Or Equivalent Device Must Ensure The Achievement Of The Same Technological, Performance And Functional Level Assumed In The Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works, 2) The Material Or Equivalent Device Must Ensure The Achievement Of Technical Parameters Not Worse Than Those Assumed In The Documentation Design, Technical Specifications For The Execution And Acceptance Of Construction Works, 3) Equivalent Materials And Devices Must Be Approved For Trading And Use In Accordance With Applicable Regulations, 4) The Contractor Who Offers Equivalent Products And Devices Requiring Changes To The Decisions Held Is Obliged To Obtain The Required Decisions Through His Own Efforts And Cost, While Guaranteeing The Execution Of The Order Within The Time Specified In The Swz; 5) The Contractor Is Obliged To Demonstrate The Equivalence Of The Materials Or Devices Used. 12) The Contractor Will Provide The Ordering Party With A 60-Month Warranty For The Entire Subject Of The Contract In Accordance With The Provisions Of Art. 556 – 576 4 In Connection With Of 656 § 1 And Art. 638 Of The Civil Code. The Warranty Will Cover The Performance Of Construction Works, As Well As All Installed Accessories And Other Devices. The Warranty Period Starts From The Date Of Receipt Of The Final Subject Of The Contract. The Required Minimum Quality Guarantee Period For The Completed Subject Of The Order Is 36 Months And Will Be Determined In Accordance With The Contractors Offer (Offer Evaluation Criterion). The Warranty Covers Liability For Defects In The Entire Subject Matter Of The Contract. 13) Employment Requirements Based On An Employment Relationship In The Circumstances Referred To In Art. 95 And In The Scope Of Employment Of Persons Referred To In Art. 96 Section 2 Point 2, If The Ordering Party Provides For Such Requirements: The Ordering Party Requires The Contractor And Subcontractors To Employ, Under An Employment Contract, Persons Performing Works In The Field Of: Preparatory Works, Construction Works, Electrical Works, Sanitary Works, Construction Of Sports Infrastructure In Objazd. These Activities Are Included In Within The Scope Of Art. 22 § 1 Of The Labor Code, Which Reads: By Entering Into An Employment Relationship, The Employee Undertakes To Perform Work Of A Specific Type For The Employer And Under His Management And At The Place And Time Designated By The Employer, And The Employer - To Employ The Employee For Remuneration. Method Of Documentation Employment Of People, The Employers Rights To Control The Contractors Compliance With The Above-Mentioned Requirements And Sanctions For Failure To Meet These Requirements Are Specified In Annex 8 To The Swz - Contract Template.
