Description Of The Subject Of The Order1. The Subject Of The Order Is The Supply Of Granite Grits Of The Following Fractions - Grits Of The 16/25 Mm Fraction - Quantity 1189 Tons - Grits Of The 8/11 Mm Fraction - Quantity 714 Tons - Grits Of The 2/5 Fraction - Quantity 595 Tons (1 Ton = 1 Mg) 2. The Aggregate In Question Will Be Used For Surface Consolidation Of Sections Of District Roads.3. The Amounts Of Aggregate Specified Above Are Estimated Amounts. The Ordering Party Reserves The Right To Increase Or Reduce The Amount Of Aggregate Depending On The Needs, Provided That It Has Financial Capacity, After Prior Consultation With The Contractor. Reducing The Number Of Deliveries Cannot Be The Basis For Any Claims From The Contractor.4. The Aggregate Should Be Clean, Must Not Be Dusty And Must Not Contain Any Admixtures Of Undesirable Materials Such As Metal, Plastic, Wooden Or Clay Waste. In The Event Of Delivery Of Aggregate Of Inappropriate Quality (I.E. Not Meeting The Requirements Specified In The Above-Mentioned Standards), The Contractor Will Replace It At His Own Expense Within 2 Days From The Date Of Notification By The Ordering Party, Along With Taking Away The Delivered Batch That Does Not Meet The Requirements.5. The Supplied Grit Fractions Must Meet The Requirements Of The Pn-En 13043:2004 Standard Aggregates For Bituminous Mixtures And Surface Treatments Used On Roads, Airports And Other Traffic Surfaces.6. The Contractor Will Deliver The Aggregate In Question Each Time At The Written Request Of The Ordering Party Within The Time Specified In The Offer. The Place Of Delivery Will Be The Registered Office Of The Ordering Party - I.E. 17-200 Hajnówka, Ul. Bielska 41 Or The Place Indicated By The Ordering Party Located In The Hajnówka District. A Single Delivery Of Aggregate Will Not Be Less Than 1,000 Tons And Not More Than 1,300 Tons.7. In Order To Confirm Compliance Of The Offered Supplies With The Requirements And Features Specified In The Description Of The Subject Of The Order, The Contractor Should Attach To The Offer The Results Of Laboratory Tests Of The Offered Aggregate Confirming The Fulfillment Of Quality Requirements In Accordance With Applicable Standards Or Technical Specifications.8. The Offered Price Is A Lump Sum, I.E. It Will Include The Cost Of Aggregate, Its Transport And Unloading, As Well As All Other Costs Related To The Execution Of The Subject Of The Order.9. Aggregate Deliveries Will Be Received Between: 7.00-15.00 By A Person Authorized By The Ordering Party. A Protocol Signed By The Ordering Party And The Contractor Will Be Prepared Upon Receipt Of The Delivery.10. Payment For The Delivered Deliveries Will Be Made On The Basis Of A Correctly Issued Invoice For The Aggregate Actually Delivered Within No Longer Than 14 Days From The Date Of Its Receipt, By Transfer To The Contractors Bank Account.11. The Ordering Party Does Not Allow The Submission Of Partial Offers. Reasons For Not Dividing The Order Into Parts [Art. 91 Section 2 Of The Public Procurement Law]: - The Order Does Not Limit The Participation Of Small And Medium-Sized Enterprises In It. - Dividing The Order Into Parts Causes Its Too Great Fragmentation, Which Could Discourage Entrepreneurs From Participating In It.11. The Ordering Party Does Not Allow The Submission Of Variant Offers12. Contractors Are Obliged To Indicate In Their Offer The Scope Of Supplies The Implementation Of Which They Intend To Entrust To Subcontractors [Declaration Required In The Above-Mentioned Scope Is Included In The Offer Form].13. Entrusting The Performance Of Part Of The Subject Of The Order To A Subcontractor Or Subcontractors Requires The Conclusion Of A Subcontracting Agreement, Which Should Be Understood As An Agreement In Written Form Of A Paid Nature, Concluded Between The Contractor And Another Entity (Subcontractor), As Well As Between The Subcontractor And A Further Subcontractor Or Between Further Subcontractors, Pursuant To Which The Subcontractor Or Further Subcontractor, Respectively, Undertakes To Perform Part Of The Order.14. The Ordering Party Does Not Allow The Submission Of Offers In The Form Of Electronic Catalogues.
