1) The Subject Of The Order Is The Provision Of Catering Services With Waiter Service To The Ordering Party In A Restaurant Room With An Area Of 104.1 M2 Located In The Building Of The Training And Recreation Center Wołosań, Located In Cisna, Address: 38-607 Cisna 87 In And In Other Places Indicated By The Ordering Party. These Are Services In The Field Of Preparation And Serving Of Meals Consisting In The Delivery Of Ready-Made Food And Waiter Service In The Restaurant Room At The Wołosań Training And Recreation Center. The Service Will Be Provided Using The Ordering Partys Property, I.E.: Terrace, Kitchen, Cafeteria, Dishwashing Room. Catering Services Will Be Provided During Wołosań Training Courses, Meetings, Conferences And Other Events Organized By Osw. 2) The Contractor Must Offer Sets Of Meat, Vegetarian And Fish Meals At The Following Levels: Basic, B) Intermediate, C) Other Sets In Accordance With Annex No. 10 To This Tor. Type And Quantities: A-Basic Level: Breakfast 4500; Lunch 3000; Dinners 1000; Coffee Break 5000; Gala Dinners 350; Outdoor Event 250; B-Medium Level: Breakfast 6,000; Lunch 4000; Dinners 3000; Coffee Break 3000; Gala Dinners 350; Outdoor Event 250; C-Other Sets: Colonies 1200; School Groups700; Tourist Groups 2,500; Sandwiches 500; Provisions 500; Game Dishes 100; Regional Dishes 400. 3) The Place Of Implementation Of The Subject Of The Order Will Be: Training And Recreation Center Wołosań, 4) A Detailed Description Of The Provision Of Services That Are The Subject Of The Order Is Included In Annex No. 9, And In Annex No. 10 Sample Sets Of Dishes (Meals) For The Valuation Of The Offer. Annex No. 9 And Annex No. 10 Constitute Integral Parts Of This Swz. 5) The Ordering Party Reserves, In The Draft Contract Constituting An Integral Part Of This Swz, The Possibility Of Introducing A Significant Change In Relation To The Offer Submitted By The Contractor, In Such A Way That In The Event Of A Special Request Of The Guests Of Osw Wołosań Regarding The Type Of Meal, The Ordering Party Will Be Able To Order The Preparation Of Meals Non-Standard, Not Specified In The Offer, Which Will Result In Additional Remuneration For The Contractor. 6) The Contractor Is Obliged To Provide The Services Covered By The Order In Accordance With The Act Of August 25, 2006 On Food And Nutrition Safety (Consolidated Text: Journal Of Laws Of 2023, Item 1448), Regulation Of April 17, 2007. On The Collection And Storage Of Food Samples By Closed Type Mass Catering Establishments (Journal Of Laws Of 2007, No. 80, Item 545).7) The Contractor Will Bear All Responsibility For Maintaining The Appropriate Level Of Nutrition And Compliance Of The Nutritional And Qualitative Composition Of Meals Resulting From The Recommendations Of The Food And Nutrition Institute. During The Execution Of The Contract, The Ordering Party Reserves The Right To Access Post-Inspection Reports And All Certificates For Raw Materials, Devices, Equipment, Dishes, And Transport Packaging Used In The Process Of Preparing And Transporting Meals. 8) The Ordering Party Reserves The Right To Assess And Verify All Parameters Of Meals Prepared As Part Of The Ordered Service At Every Stage And At Any Time At The Place Of Meal Preparation And Delivery. 9) The Contractor Will Be Obliged To Implement The Subject Of The Contract In Compliance With The Principles Of The Haccp System, I.E. The Principles Of Good Hygienic Practice And The Principles Of Good Manufacturing Practice. 10) As Part Of The Service, The Contractor Must Ensure The Availability Of A Certain Number Of Dishes For People Who Cannot Use The Basic Menu Due To Religious Or Philosophical Beliefs, Diet, Medical Recommendations Or Other Reasons, In An Amount Of Approximately 2% Of The Entire Menu. Ordering Non-Standard Dishes Referred To In The Preceding Sentence Will Be Made Under The Option Law. 11) Due To The Fact That The Ordering Party Presented The Subject Of The Order In The Maximum Possible Size, It Envisages The Possibility Of Reducing The Subject Of The Order In Terms Of Value, I.E. By A Maximum Of 50% In Relation To The Price Given In The Contractors Offer. Completion Of The Order At A Minimum Level Of 50% Of The Price Given In The Offer Will Not Constitute Non-Performance Or Improper Performance Of The Contract By The Ordering Party, And The Contractor Will Not Have Any Claims In This Respect. 12) As Part Of The Execution Of The Order, The Contractor Undertakes To Lease From The Ordering Party Rooms With A Usable Area Of 338.10 M2, Including: Kitchen And Kitchen Facilities (Area 179 M2); Café Annex And Bar (Area: 32.80 M2); Communication (Area 44.0 M2); Womens/Disabled Toilets, Mens Toilets (Area: 5.3 M2); Administration Room (Area 9.0 M2); Terrace (Area 68.0 M2) Located In The Building Of The Wołosań Training And Recreation Center, Together With Equipment And Devices, In Order To Provide Catering Services With Waiter Service. The Dining Room With An Area Of 104.1 M2 Is Not Available For Rent During Training, Meetings, Conferences And Other Events Conducted By Osw Wołosań. It Is Possible To Lease The Restaurant Room To The Contractor Only Outside The Periods Of Training, Meetings, Conferences And Other Events Conducted By Osw Wołosań, On The Basis Of A Separate Agreement. Lease Terms: A) The Lease Is Intended For The Duration Of The Main Contract (I.E. The Contract For The Provision Of Catering Services With Waiter Service, Concluded In Accordance With Annex No. 11 To The Swz); B) The Rent For 1 M2 Of The Area Of The Leased Premises Is Pln 16.34 Net Per Month; C) Real Estate Tax Will Be Paid Directly To The Commune Office; D) In Addition To The Lease Costs, The Contractor Will Be Charged By The Ordering Party With The Costs Of Utility Supplies And Other Costs Related To Running A Business In The Rented Premises. For The Costs Of Utilities Supplies For Which The Lease Includes Submeters (Measuring Devices), The Settlement Of These Utilities Will Be Based On The Submeter Readings And Rates Applicable To Individual Suppliers With Whom The Ordering Party Has Signed Contracts. In The Case Of Utilities For Which There Are No Submeters, The Settlement Will Be Made On An Index Basis: Central Heating - In Proportion To The Occupied Area, Electricity Supply - According To The Submeter Readings, Electricity Supply - According To The Submeter Readings, Emptying The Grease Separator - Within The Scope Of The Contractor, Fees For Waste And Solid Waste - According To The Rules Established By The Ordering Party, E) The Template Of The Lease Agreement Is Attached As Annex No. 12 To This Tor. 13) The Result Of These Proceedings, The Ordering Party Assumes, Will Be The Conclusion Of Two Contracts, I.E.: A Contract For The Provision Of Catering Services With Waiter Service And A Contract For The Lease Of Premises Indicated In Point 12 Above), Therefore The Ordering Party Requires That The Catering Services Contractor And The Lessee Was The Same Entity. 14) The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Tasks Related To The Subject Of The Order. The Contractor May Entrust The Implementation Of Elements (Parts) Of The Subject Of The Order To Subcontractors. 15) Pursuant To Art. 95 Section 1 Of The Public Procurement Law, The Ordering Party Requires, When Implementing The Subject Of The Order, Employment Under An Employment Contract Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2023, Item 1465), Persons Indicated In The Offer Form, Who Will Be Directed To Direct Execution Of The Order (Catering Staff, Including Cooks And Waiters). In The Case Of Execution Of The Order By The Subcontractor, The Above Obligation Regarding Employment Under An Employment Contract Is Borne By The Subcontractor. In The Content Of The Documents Relating To This Procedure, The Requirement Described Above Is Also Referred To As The Employment Obligation. 16) The Ordering Party Does Not Allow The Submission Of Partial Offers Within The Meaning Of The Provisions Of The Act. Justification: The Goal That The Ordering Party Intends To Achieve By Implementing The Subject Of The Order Is To Guarantee The Highest Quality Of Catering Services Accompanying Business Meetings, Events, Training Courses, Conferences And Stays Organized By The Wołosań Training And Recreation Center. Dividing The Order Into Parts Will Result In Catering Services Being Provided By Different Contractors At The Same Time On The Basis Of Separate Public Procurement Contracts. This Situation May Lead To A Large Discrepancy In The Level Of Services Obtained. These Discrepancies Concern Both The Quality Of Service, The Aesthetics And Taste Of Dishes, As Well As The Logistic Efficiency In Implementing Projects. It Was Therefore Decided Not To Divide The Order Into Lots. It Was Assumed That The Implementation Of The Commissioned Projects By One Contractor Would Not Paralyze Logistic Coordination, The Served Dishes Would Be Uniform In Aesthetics And Taste, And Comments Addressed To The Contractor Would Be Properly Understood And Accepted And Implemented In A Clear Manner. An Important Premise For This Decision Was The Assumption That The Cumulative Value Of The Contract Would Become More Attractive And Arouse The Interest Of A Larger Number Of Potential Contractors. This Will Become An Opportunity To Attract Recognized Companies, Especially Those Whose Potential Focuses On Larger Projects Implemented In The Long Term, Guaranteeing Development And Fair Profit. An Additional Aspect Is That The Contractor Must Lease A Restaurant Premises. One Contractor Means A Lower Price And Lower Costs Of Order Execution. One Contractor Ensures Better Coordination Of Activities To Ensure Proper Execution Of The Order. The Conditions For Participation In The Procedure, The Conditions For Performing The Subject Of The Contract And The Applied Criteria For Evaluating The Offers Do Not Restrict Competition And Participation In The Procedure For Small And Medium-Sized Enterprises.
