4.1 The Subject Of The Order Is The Modernization And Retrofitting Of A Playground In The Ołtarzew Estate At Parkowa Street In Ołtarzew.4.2 The Scope Of Construction Works Constituting The Subject Of The Order Includes, Among Others: - Preparatory Works And Earthworks, - Delivery And Assembly Of Toys, - Delivery And Installation Of Small Architecture Elements, - Cleaning Of The Area.4.2.1 A Detailed Description Of The Subject Of The Order Is Included In The Description Of The Subject Of The Order (Appendix No. 1.1 To The Swz), Technical Specification For The Execution And Acceptance Of Construction Works (Appendix No. 1.2 To The Swz) And In The Bill Of Quantities Works.4.3 The Ordering Party Recommends Getting Acquainted With The Area Where The Construction Works Will Be Carried Out - The Contractor Should Visit The Site And, If Necessary, Make Appropriate Additional Measurements To Prepare The Offer. The Costs Of The On-Site Visit Are Borne By The Contractor. 4.3.1 Carrying Out An On-Site Visit And Checking The Documents Necessary To Complete The Order Available On-Site At The Ordering Party Is Not A Necessary Condition For Submitting An Offer. In These Proceedings, The Above Does Not Constitute Grounds For Rejecting The Contractors Offer Referred To In Art. 226 Section 1 Point 18 Of The Public Procurement Law. 4.4 The Ordering Party, In Accordance With Art. 100 Paragraph 1 Of The Public Procurement Act, Requires That The Subject Of The Contract, As A Contract Intended For Use By Natural Persons, Meets The Requirements Regarding Accessibility For All Users, Including Disabled People. The Order Must Be Completed In Such A Way That The Natural Persons Listed Above Can Use It Without Any Difficulties Or Restrictions. Detailed Requirements Are Specified In The Tender Documentation, I.E. Annex No. 1 To The Swz. 4.5 Required By The Ordering Party Min. The Warranty Period Is 36 Months. Ożarów Mazowiecki (Ołtarzew Housing Estate At Parkowa Street)45.10.00.00 -8 Preparation Of Land For Construction45.11.12.00 -0 Works In The Field Of Preparation Of Land For Construction And Earthworks 37.53.52.00 -9 Equipment For Playgrounds45.11.27.23 -9 Works In Scope Of Shaping Playgrounds45.23.32.50 -6 Works On Surfaces, Except Roads4.7 Information On The Use Of Equivalent Products, Materials And Technologies. 4.7.1 If In The Description Of The Subject Of The Order The Ordering Party Refers To Standards, European Technical Assessments, Technical Specifications And Other Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, He Is Obliged To Indicate That He Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words - Or Equivalent. Listed In Any Part Of The Documentation - Annex No. 1 To The Swz: Proper Names, Brands Of Products, Materials, Technologies Are Not Obligatory For Contractors. The Contractor Has The Right To Offer Other Products, Materials And Technologies Provided That Technical Parameters Are At Least Identical To Those Specified In The Order Documentation. If The Documentation Constituting Annex No. 1 To The Swz Indicates Trademarks, Patents In Relation To Certain Materials, Products And Technologies Or The Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, Including In Particular The Proper Name Of The Material, Product Or Technology, Catalog Number Or Manufacturer, This Should Be Treated As An Exemplary Solution Specifying The Standards, Appearance And Technical Requirements. All Materials, Devices And Technologies From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Materials, Devices And Technologies Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order, They Are Not Intended To Privilege Or Eliminate Certain Artists Or Products. Such Provisions Are Only Used In Situations Where The Ordering Party Was Unable To Describe The Subject Of The Contract Using Sufficiently Precise Terms - In These Cases, The Wording Or Equivalent Should Always Be Used. The Materials, Products And Equivalent Solutions Used By The Contractor Must Be At Least: - With The Same Strength And Durability, With The Same Level Of Aesthetics (Products), - With Technical Parameters Described In The Tender Documentation, - Compatible With The Existing And Planned Infrastructure, - Meet: The Same Functions, Construction Safety, Health And Safety And Fire Protection Requirements ,- Have Appropriate Documents Allowing For Use In Construction (Certificates And Technical Approvals). The Contractor Must Prove To The Ordering Party That The Proposed Material, Product, Technology Or Solution Is Equivalent, E.G. By Presenting All Documents, Calculations, Opinions, Etc. Confirming Equivalence.4.8 The Subject Of The Order Should Be Made Of Materials That Will Have Appropriate Certificates, Declarations Of Conformity And Safety Certificates. 4.9 The Subject Of The Order Should Meet The Requirements Of Eu Standards.4.9.1 The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing Activities Specified By The Ordering Party In The Scope Of Contract Execution, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465).4.9.2 Requirements For Employment By The Contractor Or Subcontractor Under An Employment Relationship Regarding Persons Performing Construction Works Directly On The Construction Site, I.E. Manual Workers And Lower Technical Employees Responsible For Organizing And Carrying Out Construction Works. These Requirements Do Not Apply To The Construction Manager, Works Managers And Persons Providing Services On The Construction Site As Part Of Their Own Business Activity Using Their Own Equipment Or Tools, Such As Measurement And Testing Works, Demolition And Earthworks, Transport Of Excavated Material Or Transport Of Construction Materials, Etc. 4.9.3 The Method Of Verification Of Employment, As Well As The Employers Rights To Control The Contractors Compliance With Employment Requirements And The Sanctions For Failure To Meet These Requirements Are Indicated In The Contract Template, Which Constitutes Annex No. 2 To The Swz.
