1. The Subject Of The Order Are Construction Works Within The Meaning Of Article 7 Point 21 Of The Public Procurement Law And Article 3 Point 8 Of The Act Of July 7, 1994. Construction Law, Consisting In The Design And Strengthening Of Damaged Load-Bearing Beams Along With Repair Works Of The Road Viaduct Over The Railway Tracks Along Ul. Szubińska In Bydgoszcz, To The Extent And Under The Terms Of Contract Performance, Specified In Detail In: 1) The Draft Provisions Of The Agreement - Annex No. 1 To The Swz, 2) Functional And Utility Program (Ffu) - Annex No. 2 To The Swz, 3) Template Of The Offer Form - Annex No. 3 To The Swz,4) Template Of The Offer Valuation Of The Basic Order - Annex No. 4-1 To The Swz And Template Of The Offer Valuation Of Options - Annex No. 4-2 To The Swz.2. The Order Includes The Design And Implementation Of, Among Others: 1) Reinforcement Of Damaged T-Beams Of The Supporting Structure, 2) Repairs Of The Existing Reinforcement Of Beams With Carbon Tapes, 3) Repairs Of Bearing Blocks And Grout, 4) Repairs Of Abutments, 5) Repairs Of The Supporting Structure - Beams, Cross Beams (The Entire Surface From The Bottom And On The Side Surfaces), 6) Repairs Of Intermediate Supports, 7) Repairs Of Concrete Stairs, 8) Replacement Of Sidewalk Surfaces In The Facility. 3. The Order Will Be Implemented In Stages: Stage I - Preparation Of Design Documentation Along With Obtaining An Administrative Decision Enabling The Implementation Of The Task And Authors Supervision Over Stages Ii - V, Stage Ii - Strengthening And Repair Of The Eastern Span And The Eastern Abutment, Stage Iii - Strengthening And Repair Of The Span Middle And Intermediate Supports, Stage Iv - Strengthening And Repair Of The Western Span And The Western Abutment, Stage V - Replacement Of Sidewalk Surfaces With Authors Supervision.4. Stages I And Ii Will Be Implemented As Part Of The Basic Order. The Scope Of Work And Works Covered By The Basic Order Is Specified In Annex No. 4-1 To The Swz. The Ordering Party Determines The Minimum Value Of The Parties Performance To Be No Less Than 85% Of The Contract Value For The Basic Order. 5. The Ordering Party Provides For The Possibility Of Implementing Stages Iii, Iv And V Under The Option Referred To In Art. 441 Section 1 Pzp - Description Of The Options In Point 4.2.9 Of This Announcement.6. The Ordering Party Informs That The Description Of The Subject Of The Order (Pfu) Was Prepared Taking Into Account The Requirements Regarding Accessibility For Disabled People Referred To In Art. 100 Section 1 Of The Pzp And Meets The Minimum Requirements To Ensure Architectural Accessibility Specified In Art. 4 And Article 6 Point 1 Of The Act Of July 19, 2019 - On Ensuring Accessibility For People With Special Needs. When Performing The Order, The Contractor Is Obliged To Comply With These Requirements.7. The Ordering Party Does Not Impose An Absolute Requirement To Carry Out An On-Site Visit Referred To In Art. 131 Section 2 Of The Public Procurement Law, In The Time Preceding The Submission Of The Offer, But Suggests Carrying It Out In The Interest Of The Contractor Without The Participation Of The Ordering Party In Order To Properly Determine The Scope Of The Contract. 8. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law. 9. The Ordering Party Does Not Divide The Order Into Parts. Therefore, It Does Not Allow The Submission Of Partial Offers Referred To In Art. 7 Point 15) Pzp. Reasons For Not Dividing The Contract Into Parts: The Subject Of The Contract Is Indivisible Into Parts Because, For Technical, Organizational And Economic Reasons, It Creates An Inseparable Whole. The Lack Of Division Into Lots Does Not Limit Access To The Contract For Contractors From The Small And Medium-Sized Enterprises (Sme) Sector.
