When Calculating The Offer Price, The Contractor Should Take Into Account All Requirements And Conditions Required For The Proper Performance Of The Subject Of The Order;9) As Part Of The Order, The Contractor Is Also Obliged To: A) Organize And Manage The Construction Facilities; B) Ensuring Ongoing Geodetic Services By Authorized Geodetic Services, Preparing As-Built Documentation, Including Geodetic Documentation (Post-Construction Inventory) Of All Works, Approved By The Office Of Geodesy And Cartography Appropriate To The Location Of The Works; C) Developing A Safety And Health Protection Plan, Provided That Is Required; D) Marking Of The Construction Site; E) In The Event Of Damage Or Destruction During Works - Repairing Them And Restoring Them To Their Original Condition; F) Ensuring Supervision As Well As Appropriate Occupational Health And Safety Conditions; G) Keeping The Construction Site Free From Traffic Obstacles And Removing Unnecessary Materials, Waste And Garbage On An Ongoing Basis; H) Providing A Warranty For Physical And Legal Defects And A Quality Guarantee For The Completed Construction Works And Built-In Devices For A Period Of Min. 36 Months, Counting From The Day Following The Final Acceptance Of The Task (Regardless Of The Guarantees Issued By Device Manufacturers); I) Participating In Warranty Inspections Requested By The Ordering Party (During The Period Covered By The Guarantee/Warranty); J) After The Completion Of The Works, The Construction Site Must Be Brought To The Condition Primary, Dismantle Temporary Structures, Tidy Up The Area And Hand It Over To The Ordering Party No Later Than The Date Of Final Acceptance.2. Equivalent Solutions.1) When Used In Swz Or Annexes, I.E. Wherever In The Design Documentation And Other Documents For The Execution Of The Order And Acceptance Of Construction Works In Relation To The Standards Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Contracting Authority Allows Solutions Equivalent To Those Described And Such Reference Is Accompanied By The Words Or Equivalent.2) If Trademarks Are Used In The Swz Or Annexes, It Means That They Are Given As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard And Aims To Clarify The Level Of The Ordering Partys Expectations In Relation To A Specific Solution. When Describing The Subject Of The Order, The Ordering Party, When Indicating A Specific Marking Or A Specific Product, Allows Equivalent Products With Quality Parameters And Functional Features At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Parameters Or Better. The Contractor May Use Equivalent Materials Or Devices, But With Technical And Quality Parameters Equal To Those Of The Indicated Product Or Better, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation. Before Construction, The Materials And Devices Will Be Presented To The Ordering Party For Acceptance, Specifying Equivalence.3) Wherever The Subject Of The Order Is Described By Indicating Trademarks, Origin, Source Or Specific Process That Characterizes The Products, Materials, Devices Or Solutions Or A Reference To European Standards Technical Assessments, Approvals, Other Documents, The Ordering Party Allows The Contractor To Use Products, Materials, Devices Or Solutions Equivalent To Those Described In The Design Documentation Or Technical Specification, Provided That They Have At Least The Same Or Better Technical And Functional Parameters And Do Not Reduce Standards Specified In The Design Documentation And Will Have The Required Appropriate Approvals, Certificates Or Approvals For Use And Will Ensure The Execution Of The Order In Accordance With The Ordering Partys Requirements Specified In The Design And Swz.
