The Detailed Scope Of Works And The Method Of Their Implementation Are Specified In The Design Documentation And Detailed Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb), Constituting Annex No. 9 To The Specification Of The Terms Of The Contract (Swz), Taking Into Account Explanations And Changes Made By The Ordering Party During The Contract Award Procedure Public - If They Took Place. All Works Performed And Materials Delivered Will Be Consistent With The Design Documentation And Stwiorb. Accessibility Requirements. The Length Of The Quality Warranty Period For The Completed Construction Works And The Materials/Devices Used/Delivered, Which The Contractor Provides To The Ordering Party, Is One Of The Offer Evaluation Criteria, Which Will Be Assessed In Accordance With Chapter Xxi Point 2.2 Of The Tor. The Ordering Party Sets The Minimum Required Period For The Quality Guarantee Granted By The Contractor For The Construction Works Performed And The Materials/Equipment Used/Delivered For A Period Of 60 Months (5 Years), Counting From The Date Of Final Acceptance Of The Works.11. Equivalent Solutions. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Design Documentation, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Design Documentation Or Technical Specification For The Execution And Acceptance Of Works, It Means That They Are Provided As Examples And Only Define Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation Equivalent Will Be Obliged To Demonstrate During The Execution Of The Order That The Materials And Devices Used By Him Meet The Requirements Specified By The Ordering Party. If The Contractor, For Reasons Beyond His Control, Cannot Obtain The Label Or Equivalent Label Specified By The Ordering Party, The Ordering Party, Within The Deadline Set By Him, Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Construction Works , Supplies Or Services To Be Performed By Him Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. The Use In The Design Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Test Report Carried Out By This Body As A Means Of Evidence Confirming Compliance With The Requirements Or Features Specified In The Description Of The Subject Of The Order, Offer Evaluation Criteria Or Terms Of Order Execution Means That The Ordering Party Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Units. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, In The Event That A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In An Appropriate Time, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor. , And Provided That A Given Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Order, The Offer Evaluation Criteria Or The Requirements Related To The Implementation Of The Order.
