As Part Of The Implementation Of The Subject Of The Order, The Contractor Is Obliged To: 1) Secure, Organize And Keep The Area Clean On A Daily Basis After The Completion Of The Works; 2) Ensure The Safe Organization Of The Works; 3) Secure The Work Area During The Duration Of The Task Until The Completion And Final Acceptance Of The Works ;4) Strictly Comply With The Content Of All Arrangements Issued By Persons Authorized By The Ordering Party;5) Know And Apply All Environmental Protection Regulations While Carrying Out The Works;6) Dispose Of Demolition Materials. The Costs Of The Works Referred To In This Point Should Be Included In The Lump Sum Remuneration;7) The Remuneration Should Include The Costs Of Maintaining The Construction Site, The Costs Of Equipment And Maintenance Of The Construction Facilities, The Costs Of Arrangements, Acceptances, Exclusions, Tests For The Execution Of The Order, The Costs Of Surveying And Geotechnical Services , Costs Of Securing The Construction Site And Preparing As-Built Documentation;8) Prepare, At His Own Expense, Diagrams Or Working And Workshop Drawings If He Considers It Necessary For The Execution Of The Works Or Their Parts;9) Notify The Ordering Party Of Any Circumstances Revealed In The Course Of The Works That May Have A Negative Impact On The State Of Preservation Of The Monument And Change The Scope Of Work Specified In The Mwkz Decision;10) Apply The Provisions Arising From The Act On The Protection And Care Of Monuments And All Related Legal Provisions;11) Carry Out Works Resulting From The Recommendations Imposed By The Authorized Bodies At Each Stage Investment Process, Especially By Mwkz;12) Obtain An Investment Acceptance Report From The Masovian Provincial Conservator Of Monuments;13) Ensure, At Its Own Expense, The Service Of Scientific And Research Units, If Necessary For A Given Scope Of Works;14) Provide The Ordering Party With A Declaration On The Day Of Concluding The Contract The Construction Manager To Take Over The Obligation To Manage The Construction Site;15) Ensure That The Works Are Carried Out In A Way That Ensures The Safety Of People Staying In Or Near The Work Site And Moving Around The Place Of Implementation Of The Subject Of The Order.8. As Part Of The Subject Of The Order, The Contractor Is Obliged To Perform Construction Works, And After Their Completion, Obtain And Submit To The Ordering Party An Administrative Decision Granting An Occupancy Permit.9. The Contractor Undertakes To Perform All Construction Works Described In The Documentation Necessary To Implement The Subject Of The Order.10. The Contractor Is Obliged To Secure, Tidy Up And Keep The Area Clean On A Daily Basis After Completion Of The Works.11. The Contractor Is Obliged To Properly Secure The Work Area And The Interests Of Third Parties, Ensure Safety Conditions Related To Their Implementation And Appropriate Environmental Protection.12. The Contractor Is Obliged To Perform The Subject Of The Order In Accordance With Applicable Standards, Legal Provisions And Technical Knowledge, As Well As In A Way That Ensures The Safety Of Users And Third Parties.13. The Area Where The Works Will Be Performed Does Not Have Access To Water And Electrical Installations, Therefore The Contractor Will Be Obliged To Provide These Utilities On His Own (Power Generators, Water Tankers).14. All Materials And Devices Used Should Be Approved For Use In Accordance With Applicable Law. At Each Request Of The Ordering Party, The Contractor Is Obliged To Present Documents Confirming Their Approval For Use In Relation To The Indicated Materials And Devices, E.G. Certificates Of Compliance With Polish Or European Standards, Declarations Of Performance Properties, Approvals.15. On The Site Of The Works, The Contractor Is Obliged To Protect All Trees, Shrubs And Perennial Plants (Also Protection Of The Root Ball), Which Are Located In Places Where They May Be Damaged, And To Carry Out The Works In A Way That Limits The Destruction Of The Biologically Active Surface To A Minimum.16. The Contractor Will Be Obliged To Restore The Biologically Active Surface And To Remove Damaged Plants And Plant New Plants In Consultation With The Greenery Inspector / Environmental Protection Department Of The Michałowice Commune Office At His Own Expense (If Applicable).17. The Contractor Is Obliged To Have An Appropriate Number Of Staff At Its Disposal Throughout The Execution Of The Order. The Ordering Party Will Not Take Into Account The Extension Of The Timely Execution Of The Order Due To The Unavailability Of Staff (Employee Absenteeism). In Such Situations, The Ordering Party Will Charge Penalties In Accordance With The Concluded Agreement.
