The Subject Of The Order Is The Design And Implementation (Execution) Of Construction Works As Part Of The Investment Construction Or Reconstruction Of Access Roads To Agricultural And Forest Land And Access Roads To The Buildings Of Individual Consolidation Participants, From The Operation Entitled: Consolidation Of Agricultural Land In The Village Of Rudniki, Włodowice Commune , Zawiercie County As Part Of The Sub-Measure Support For Investments Related To The Development, Modernization And Adaptation Of Agriculture And Forestry Covered By The Rural Development Program For 2014-2020 Included In The Scope Of The Order Called: Reconstruction Of Ul. Skarżycka And Ul. Krótka And Construction Of A Municipal Road - Road No. 5 As Part Of Post-Consolidation Works Within Rudniki, Włodowice Commune - 2 Parts.2. Division Of The Order Into Parts: The Ordering Party Divides The Order Into 2 (Two) Parts, Thus Allowing The Submission Of Partial Offers. Each Contractor Has The Right To Submit Only One Offer For One Or Both Lots. A Situation In Which The Same Entity Appears In Two Offers Submitted Jointly Or Is An Independent Contractor And At The Same Time Participates In A Joint Offer Will Be Considered Equivalent To The Submission Of More Than One Offer By The Same Contractor. The Scope And Adopted Technical Parameters Of The Designed Road Covered By The Order: Ul. Skarżycka Section Length: 543 M Road Class Road Width: 5.0 M One-Sided Slope: 2% Road Width: 0.75 M Traffic Category / Surface: Kr1 / Asphalt Street. Short Length Of The Section: 381 M Road Class Internal Road Road Width: 3.0 - 3.5 M Slope: Roof To The Axis 2% And One-Sided 2% Road Width: 0.5 M Surface: Concrete Cubes The Description And Method Of Execution Of The Subject Order Are Also Specified In The Draft Provisions Of The Future Contract Constituting Annex No. 2A To The Swz. Requirements Related To The Implementation Of The Subject Of The Order:4. Due To The Implementation Of The Investment In The Design And Build Formula, The Subject Of The Contract Was Divided Into Two Stages: 1/ Stage I - Design Work Phase, Which Includes Preparation On The Basis Of The Functional And Utility Program (Constituting Respectively For Part No. 1 - Annex No. 9A To The Swz And For Part No. 2 - Annex No. 9B To The Swz), Complete Design And Cost Estimate Documentation For The Investment In Question, Along With Obtaining The Necessary Administrative Decisions For Their Implementation (Building Permits And/Or Notification Of Construction Works); 2/ Stage Ii - Implementation Phase – I.E. Execution Of Construction Works Described In The Prepared Design Documentation And Stwiorb, And Exercising The Designers Supervision Over The Implementation Of Construction Works.5. Guarantee: The Contractor Is Obliged To Provide The Ordering Party With A Guarantee Of The Quality Of Workmanship Of The Subject Of The Contract For The Works Performed (Including Materials And Equipment) For A Period Of 60 Months, Which Starts From The Date Of Signing The Final Acceptance Protocol For The Works.6. Insurance: During The Entire Period Of Implementation Of The Subject Of The Order (I.E. From The Date Of Conclusion Of The Contract To The Date Of Final Acceptance Of The Works) The Contractor Is Obliged To Have Valid Civil Liability Insurance (Oc) For Material Damage (Third Party Property And Entrusted Property) Arising In Connection With The Implementation Subject Of The Order, For A Guarantee Sum Not Lower Than The Gross Value Of The Contract Expressed In Polish Zlotys [Pln] Or For Foreign Currencies In An Equivalent Amount, Converted At The Average Exchange Rate Of Pln In Relation To Foreign Currencies Announced By The National Bank Of Poland On The Last Business Day Preceding The Date Of Conclusion Of The Contract.Contractor Will Be Obliged To Submit An Appropriate Document In This Respect, No Later Than On The Day Of Signing The Public Procurement Contract, In Accordance With The Provisions Of Chapter Xxi Section 3 Point 1/ Swz.7. The Subject Of The Order Should Be Performed In Accordance With Applicable Regulations And Principles Of Technical Knowledge, Including: The Act Of July 7, 1994. Construction Law And The Act Of September 11, 2019. Public Procurement Law And In Accordance With The Regulation Of The Minister Of Development And Technology Of December 20, 2021. Regarding The Detailed Scope And Form Of Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works And The Functional And Utility Program, Regulation Of The Minister Of Development And Technology Of December 20, 2021 On Determining The Methods And Basis For Preparing An Investors Cost Estimate, Calculating The Planned Costs Of Design Works And The Planned Costs Of Construction Works Specified In The Functional And Utility Program And The Functional And Utility Program And Include All Necessary Opinions, Arrangements And Design Checks8. Equivalent Solutions: 1/ If In The Description Of The Subject Of The Order The Ordering Party Has Indicated Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described In This Respect, Provided That They Maintain Such The Same Minimum Technical, Quality And Functional Parameters, Etc. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.2/ If The Description Of The Subject Of The Order Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described.9. The Ordering Party Informs That The Description Of The Subject Of The Order Takes Into Account The Provisions Of Art. 100 Paragraph 1 Of The Public Procurement Law, I.E. It Takes Into Account The Requirements Regarding Accessibility For Disabled People And Design For All Users.10. Electromobility: The Ordering Party Requires The Contractor To Also Provide The Subcontractor Or Further Subcontractor With Vehicles For The Execution Of The Subject Order In Accordance With The Provisions Of The Act Of January 11, 2018. On Electromobility And Alternative Fuels. This Requirement Will Be Subject To The Employers Right To Perform Inspection Activities Towards The Contractor. By The Date Of Handing Over The Construction Site, The Contractor Will Submit To The Ordering Party A Declaration On The Adaptation Of The Fleet Of Motor Vehicles Used To Carry Out This Order To The Above-Mentioned Requirements. (The Declaration Should Be Submitted In Accordance With The Template Of Annex No. 3 To The Pppu, Constituting Respectively: For Part No. 1 - Annex No. 2A To The Swz And For Part No. 2 - Annex No. 2B To The Swz). The Contractor Will Be Obliged To Submit The Above Declaration Whenever It Is Necessary To Update The Information Provided To The Ordering Party In The Initial Declaration (Before Handing Over The Construction Site).
