As Part Of These Proceedings, The Ordering Party Limited The Scope Of Construction Works To Be Performed In Relation To The Attached Design Documentation Only To The Works Indicated In The Bill Of Quantities.4. Moreover, The Contractors Obligations Related To The Implementation Of The Order Are Also Specified In The Draft Provisions Of The Contract Attached To The Swz, Which Will Be Introduced Into The Content Of The Public Procurement Contract.5. The Prepared Offer Must Be Consistent With The Subject Of The Order, Design Documentation And Technical Specifications For The Execution And Acceptance Of Works.6. Where A Trademark (Brand), Manufacturer, Supplier, Patent, Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor Is Indicated In The Swz, Including Design Documentation, Technical Specification For The Execution And Acceptance Of Works Or Other Procurement Documents Or Standards, European Technical Assessments, Common Technical Specifications Or Other References Referred To In Art. 101 Section 1 Point 2 Or Section 3 Of The Act, Public Procurement Law, The Ordering Party In Accordance With Art. 99 Section 5 Of The Public Procurement Law Allows The Submission Of An Equivalent Offer Or In Accordance With Art. 101 Section 4 Of The Public Procurement Act, Offering Solutions Equivalent To Those Indicated In The Documentation, Provided That They Ensure Technical Parameters Not Worse Than Those Assumed In The Documentation And Are Consistent In Terms Of: A) Dimensions And Construction (Size, Type, Physical Properties, Number Of Components ),B) Functional Character (Identity Of Functions),C) Material Characteristics (Type And Quality Of Materials),D) Technical Parameters (Strength, Durability, Technical Data, Structure),E) Safety Parameters Of Use,F) Emission Standards, And Under Provided That The Contractor Proves In Accordance With Art. 101 Section 5 Or 6 Of The Pzp.7 Act. At Each Request Of The Ordering Party, The Contractor Is Obliged To Present Safety Signs For The Indicated Materials, A Declaration Of Conformity Or Technical Approval Or A Certificate Of Compliance With The Polish Standard Transposing European Standards Or The Standard Of The Member States Of The European Economic Area Transposing This Standard Or The Polish Standard In The Absence Of A Polish Standard Transposing This Standard. Whenever The Technical Specification For The Execution And Acceptance Of Works And Design Documentation Mentions Polish Standards, It Should Be Understood As Polish Standards Transposing European Standards Or Standards Of Other Member States Of The European Economic Area Or Other Standards Or Documents Referred To In Art. 101 Section 1 Point 2 Of The Pzp.11 Act. The Materials And Equipment Used To Perform The Contract Should Meet The Quality Requirements For Products Approved For Trading And Use In Construction Specified In The Act Of July 7, 1994, Construction Law (Consolidated Text: Journal Of Laws Of 2022, Item 1768), The Act Of April 16, 2004 On Construction Products (Consolidated Text: Journal Of Laws Of 2021, Item No. 1213 And The Requirements Of Technical Specifications, Execution And Acceptance Of Works And Swz.12. Before Installing The Materials, The Contractor Will Submit Their Patterns, Technical Cards, Approvals Or Certificates For Approval To The Supervision Inspector Confirming Compliance Of Technical Parameters With The Design Documentation. 13. The Valid Form Of Remuneration Is The Cost Estimate. Due To The Cost Estimate Nature Of The Remuneration For The Execution Of The Subject Of The Order, The Settlement Of The Works Will Be Based On The As-Built Cost Estimate, I.E. The Actual Measurements Of The Works Performed. 14. The Contractor Is Obliged To Provide A Warranty For The Subject Of The Contract For A Period Of Not Less Than 36 Months From The Date Of Final Acceptance Of The Works.15. The Warranty Period For The Subject Of The Order Is 60 Months.16. Obligation To Employ Under An Employment Contract. In Order To Fulfill The Obligations Specified In Art. 95 Of The Public Procurement Act, The Ordering Party Requires That, As Part Of The Implementation Of The Contract, Activities Directly Related To The Subject Of The Contract Falling Within The So-Called Direct Costs Resulting From The Bill Of Quantities Attached To The Swz Were Performed By Persons Employed Under An Employment Contract In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text, Journal Of Laws Of 2023, Item 1465, As Amended), Regardless Of Whether The Work Will Be Performed By The Contractor, Subcontractor Or Further Subcontractor (So-Called .
