1. The Subject Of The Order Is The Successive Delivery Of Cleaning Products, Towels And Waste Bags.2. The Offered Goods (Point 3.1 Of The Swz) Must: 2.1. Meet The Conditions For Placing On The Market And Putting Into Service Provided For In The Medical Devices Act Of April 7, 2022 (Journal Of Laws Of 2022, Item 974, As Amended - Hereinafter Referred To As The Medical Devices Act), Confirmed By The Current Documents (I.E.: Complete Applications Or Notifications To The President Of The Office For Registration Of Medicinal Products, Medical Devices And Biocidal Products, Safety Data Sheets, Ce Certificate, Declarations Of Conformity, Approvals) - For Those Goods That Require It In Accordance With Applicable Law;2.2. Have Documents Allowing Them To Be Traded And Used In Poland - Including A Ce Certificate And Documents Confirming That These Goods Meet The Standards Required By Law - In The Case Of Goods Not Subject To The Provisions Of The Medical Devices Act Or The Pharmaceutical Law;2.3. For Products Classified As Cosmetics In Accordance With Regulation Of The European Parliament And Of The Council / Ec / No. 1223/2009 Of November 30, 2009, Have A Notification On The Cosmetic Products Notification Portal (Cpnp Portal);2.4. Be New, Free From Defects, Packed In Original Packaging. The Labels And Packaging Of The Goods Should Contain All Required Information In Accordance With The Medical Devices Act, The Pharmaceutical Law Or Other Provisions Of Generally Applicable Law Relating To Them;2.5. Have A Validity Period Of At Least 12 Months From The Date Of Its Delivery, With The Exception Of Preparations Indicated In Part 1 Of The Order, Items 26 And 34 Of Annex No. 3 To The Swz (Sopz), In The Case Of Which This Period Must Be Not Less Than 3 Months From The Date Of Their Deliveries - In The Case Of Goods With A Limited Validity Period.2.6. Have An Unchanged Spectrum Of Action Throughout The Shelf Life Of The Preparation.3. The Contractor Is Obliged To Absolutely Guarantee The Fulfillment Of The Quality Conditions Specified In The Production Permit Or Other Decisions Established By The Ministry Of Health, Based On Which The Goods Were Admitted To Trading In The Territory Of The Republic Of Poland, And To Comply With The Expiry Dates For The Delivered Goods.4. In The Case Of Each Part Of The Order Referred To In Point 3.1 Of The Swz, The Contractor Is Obliged, Free Of Charge, To: 4.1. Delivering The Goods Successively To The Registered Office Of The Ordering Party (Ul. Montelupich 4, Kraków), Based On Orders Specifying The Assortment And Quantity, Within No Longer Than 5 Business Days From The Moment Of Placing The Order, Provided That Deliveries Will Be Accepted On Business Days (From Monday To Friday, Excluding Public Holidays), From 8:00 A.M. To 2:00 P.M..4.2. Bringing In And Unloading The Goods In The Warehouse (Location 07C) At The Ordering Partys Headquarters.5. A Detailed Description Of The Subject Of The Contract (Sopz) Constitutes Annex No. 3 To The Swz And Will Be Introduced As An Annex To The Public Procurement Contract, The Template Of Which Is Annex No. 4 To The Swz. This Description Should Be Analyzed Together With Any Changes To The Content Of The Swz, E.G. As A Result Of Responses To Inquiries.6. The Numbers Of Ordered Goods Given In Annex No. 3 To The Tor Are Estimates And Are Used To Calculate The Offer Price (Contractors Remuneration). In The Event Of A Decrease Or Increase In The Number Of The Ordering Partys Patients During The Term Of The Contract, The Ordering Party May Purchase From The Contractor A Smaller Or Larger Number Of Goods Than Specified In Annex 3 To The Swz, And In The Case Of Each Goods The Difference Will Not Be Higher Than 10% Of The Number Indicated In Annex No. 3 To The Swz. The Above Circumstance Will Also Affect The Final Amount Of Remuneration Due To The Contractor, And The Difference In Its Amount Will Not Be Higher Than 10% Of Its Original Value (Determined On The Basis Of The Contractors Offer, Assuming That The Contractor Has Completed All Deliveries Covered By The Offer). Detailed Rules For Reducing Or Increasing The Number Of Purchased Goods, As Well As Detailed Conditions For The Execution Of The Order, Are Described In The Template Of The Public Procurement Contract, Which Constitutes Annex No. 4 To The Swz. 7. Detailed Terms And Conditions Of The Contract Are Included In The Public Procurement Contract Template Constituting Annex No. 4 To The Swz. As Part Of The Offer Submitted By The Contractor, The Ordering Party Will Allow Other Quantities Of Items In The Packaging Of The Subject Of The Order Than Those Indicated In Annex 3 To The Swz, But Only After Their Appropriate Conversion In Relation To The Ordering Partys Needs. The Contractor Is Obliged To Make The Appropriate Calculation Himself And Indicate It In Annex No. 1A To The Swz, Which He Submits In His Offer.8. Pursuant To Art. 101 Section 4 Of The Public Procurement Law, In Cases Where The Provisions Of The Swz Refer To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent. The Contractor Should Attach Documentation Confirming This Equivalence To The Offer. In Particular, The Contractor Is Required To Ensure That The Qualitative And Quantitative Composition Of The Substance Meets The Requirements Contained In This Swz.9. If The Description Of The Subject Of The Order Includes: Names Of Trademarks, Patents Or Origin, This Should Be Treated Only As An Aid In The Description Of The Subject Of The Order. In Each Case, Products Equivalent In Terms Of Parameters, Structure, Purpose, Etc. Are Allowed.
