1. The Subject Of The Order Is To Equip The Playground At Ul. Modrzewskiego 3 In Bytom Into A Multifunctional Play Set.2. A Detailed Description Of The Subject Of The Order Is Included In The Annexes To The Swz, I.E.: 1) Detailed Design; 2) Technical Specification For The Execution And Acceptance Of Works; 3) Bill Of Quantities; 3. The Contractor Is Obliged To Provide The Ordering Party With: 1) At Least 60 Months Of Warranty And Warranty For The Construction Works Performed And Construction Materials Used, And 2) At Least 36 Months Of Warranty And Warranty For The Installed Devices And Equipment Elements, Counted From The Date Of Final Acceptance Of The Works. The Contractor May Offer Longer Warranty And Warranty Periods, Which Will Be Assessed As Part Of The Offer Evaluation Criteria (See: Part Xviii Of The Swz).4. The Contractor Is Obliged To Employ, On The Basis Of An Employment Relationship Within The Meaning Of The Provisions Of The Labor Code, All Persons Performing Construction Works Such As Earthworks, Paving, Assembly, Surfacing Works And Other General Construction Works Listed In The Bill Of Quantities, For The Performance Of Which No Qualifications Are Required. Above The Obligation Does Not Apply To Entrepreneurs Personally Performing Any Of The Above. Works, Collaborators Within The Meaning Of The Act Of October 13, 1998 On The Social Security System, As Well As Members Of The Contractors Management Or Supervisory Bodies, Partners Of A General Partnership Or Partnership To The Extent That They Will Personally Perform Work For The Ordering Party Or The Contractor. The Above Applies Accordingly To Subcontractors. The Method Of Documenting The Employment Of These Persons, The Employers Rights To Control Compliance With And Sanctions For Failure To Meet These Requirements Are Specified In The Draft Contractual Provisions. 5. Detailed Terms And Conditions Of The Contract Are Included In The Draft Contractual Provisions - Constituting Annex No. 5 To Swz.6. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform A Key Part Of The Order. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance He Intends To Entrust To Subcontractors And Provide The Names Of Any Subcontractors, If They Are Already Known. Entrusting The Performance Of Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of The Order.7. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Ordering Party Did Not Divide The Procedure Into Parts Because The Subject Of The Contract Is Uniform, And Dividing It Into Parts Would Involve The Necessity Of Separating A Technologically Coherent Whole, A Threat To Obtaining The Final Effect Of The Required Quality And The Division Of Liability For Guarantees And Warranties Among Different Contractors. At The Same Time, The Ordering Party Indicates That The Value Of The Contract Was Estimated At A Level Not Exceeding The Eu Threshold And The Terms Of The Contract Were Set At A Minimum Level. The Order Is Therefore Fully Available To Small And Medium-Sized Enterprises. Moreover, This Order Is One Of The Parts Constituting Separate Proceedings. 8. The Ordering Party Does Not Allow The Possibility Of Submitting A Variant Offer.9. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law.
