1) The Subject Of The Order Is The Performance Of Construction Works As Part Of The Task Titled: Smoke Removal At The Xxxiii Bilingual Secondary School. Mikołaja Kopernika At Ul. J. Bema 76” In Warsaw. 2) The Building Is Entered In The Provincial Register Of Immovable Monuments Under Registration Number A - 1301. The Building Is Located In Warsaw In The Wola District At Ul. J. Bema 76, On Plot No. 12/6. The Building Has A U-Shaped Plan, Dimensions Approx. 73.6 M By 70.2 M, And Has A Longitudinal Wall Structure. It Has A Basement, Has Four Floors Above Ground And A Technical Floor At Roof Level.3) The Subject Of The Order Includes, In Particular, The Installation Of A Smoke Exhaust System In The Staircases, The Reconstruction Of Two Fragments Of The Ceiling In Staircases No. 2 And 3 And The Dismantling Of The Partition Wall In Staircase No. 4, Installation Of New Windows And Doors. 4) A Detailed Description Of The Subject Of The Order, Scope Of Work And Requirements Regarding The Execution And Acceptance Of The Subject Of The Order Are Specified In: A) Design Documentation, Constituting Annex No. 10 To The Swz: - Architectural And Construction Design; - Architectural And Construction Design - Annexes And Bioz Information; - Technical Design For The Architecture Industry; - Technical Design For The Construction Industry; - Technical Design For The Electrical Industry; - Expert Opinion In The Field Of Fire Protection; - Technical Specification For The Execution And Acceptance Of Construction Works; - Bills Of Quantities For Information Purposes; - Decision Of The Mayor Of The Capital City Of Warsaw No. 20/Wol/Pb/2024 Of January 26, 2024, Approving The Architectural And Construction Design And Granting A Building Permit; - Decision Of The Masovian Voivodeship Monument Conservator Of November 9, 2023, Case Number Wzwl.5142.1484.2023.Ka. B) Draft Provisions Of The Contract, Hereinafter Also Referred To As The Contract Template - Constituting Annex No. 6 To The Swz.5) The Works Will Be Carried Out In An Operational Facility. The Ordering Party Does Not Envisage Exclusion Of The High School Facility From Operation, Except For The Holiday Period (July - August). The Contractor Should Plan For Staging Construction Works Performed Outside The Holiday Period.6) The Ordering Party Informs That The Area Of Józefa Bema Street Is Covered By A Paid Unguarded Parking Zone. The User Has An Internal Parking Lot On His Premises, But Reserves The Right To Make The Parking Lot Available Only For One Passenger Car And One Delivery Vehicle Of The Contractor. The Above Does Not Apply To The Above. Holiday Period, During Which No Educational Classes Will Be Conducted At The Facility. 7) Information About The Division/Lack Of Division Of The Order Into Lots. The Ordering Party Did Not Divide This Order Into Parts, As Such A Division Would Pose A Risk Of Excessive Technical Difficulties And Excessive Costs Of Execution Of The Order. The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract Could Seriously Jeopardize The Proper, Timely And Efficient Execution Of The Contract Or Even Make It Impossible To Complete The Contract. It Is Also Not Possible To Divide The Area Into Two Construction Facilities And Two Work Areas. The Ordering Party Has A Decision Granting A Building Permit Covering The Entire Scope Of The Subject Of The Order. The Ordering Party Will Be Obliged To Appoint A Construction Manager. As Part Of One Construction Project Covered By A Building Permit, In Accordance With The Provisions Of The Construction Law, The Investor Should Appoint One Construction Manager. The Legislator Does Not Exclude The Possibility Of Appointing More Than One Construction Manager For Each Of These Works Within One Construction Project Covering Several Separate Works. Such A Situation Would Be Permissible Only If These Works, Although Covered By One Construction Project, Could Be Implemented Separately And Independently Of Each Other, And The Ordering Party Would Carry Out Individual Works Within One Project At Significant Intervals. In The Case Of Construction Works Covered By The Subject Of The Contract , Implemented At The Same Time And In The Same Area Of The Xxxiii Secondary School Of The Above-Mentioned. Circumstances Do Not Occur. Taking The Above Into Account, The Ordering Party Envisages Appointing One Construction Manager. At The Same Time, The Scope Of Work Covered By The Order And The Value Of The Order Indicate That Contractors From The Small And Medium-Sized Enterprise Sector May Apply For The Order. Due To The Above, Dividing The Awarded Contract Into Smaller Parts Is Unjustified. 8) Pursuant To § 3 Section 7 Of The Contract Template, The Contractor Is Obliged To Have A Civil Liability Insurance Policy In Respect Of His Business Activities With An Insured Amount Of Not Less Than Pln 1,000,000.00 (In Words: One Million Pln 00/100), Throughout The Duration Of The Contract, Which Will Cover His Liability. Contractual And Tortious. 9) The Ordering Party Informs That It Intends To Allocate The Gross Amount Of Pln 922,904.30 To Finance The Awarded Order. 10) Warranty. The Contractor Will Provide A Warranty For The Completed Subject Matter Of The Order For A Minimum Period Of 36 Months. The Contractor May Propose Extending The Warranty Period For The Completed Subject Matter Of The Order To 60 Months. The Warranty Period For The Completed Subject Of The Contract Is The Criterion For Evaluating Offers - See Chapter Xiv Of The Tor. 11) The Ordering Party Does Not Require An On-Site Visit. 12) Subcontractors: All Regulations And Requirements Regarding Subcontracting Have Been Included In The Contract Template Constituting Annex No. 6 To The Swz.
