According To Art. 162 Of Zut Authors Supervision During Construction Is Carried Out By The Designer On The Basis Of A Contract Concluded Between The Client And The Designer/A Natural Or Legal Person, Including In Its Composition Natural Persons Possessing The Necessary Design Legal Capacity/, And Authors Supervision In All Parts Is Mandatory For Constructions From The First To The Fifth Category Inclusive. According To The Provision Of Art. 3, Para. 1, Item 8 Of The Copyright And Related Rights Act (Cpa), The Subject Of Copyright Is Any Work Of Literature, Art And Science That Is The Result Of Creative Activity And Is Expressed In Any Way And In Any Form And Be An Objective Form, Such As Designs, Maps, Schemes, Plans And Others Relating To Architecture, Territorial Planning, Geography, Topography, Museum Work And Any Field Of Science And Technology. According To Art. 2 Of The Zapsp, The Copyright On Works Of Art And Science Arises For The Author With The Creation Of The Work. The Prepared Investment Project For Each Object, Included In The Subject Of The Relevant Separate Item, Undoubtedly Represents An Object Of Copyright Within The Meaning Of Art. 3, Para. 1, Item 8 In Connection With Art. 2 Of The Zapsp. In View Of The Above And On The Basis Of Art. 162, Para. 2 Of The Zut And In Order To Protect The Right Of Intellectual Property On The Investment Project, The Obligation To Exercise Copyright Supervision Should Be Imputed To Its Author. In View Of The Above, The Basis Of 79, Para. 1, Item 3, B. C Of The Public Procurement Act And The Contracting Authority May Conduct A Negotiation Procedure Without Prior Notice For Awarding The Public Contract.
