The Ordering Party Informs That In Accordance With Art. 99 Section 5 Of The Act Of 11 September 2019 Public Procurement Law (Journal Of Laws Of 2023, Item 1605, As Amended), That If Trademarks, Patents Or Origins, Sources Or Specific Processes Are Indicated In This Technical Documentation, Characterize Products Or Services Provided By A Specific Contractor, If The Ordering Party Cannot Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way, And Such An Indication Is Accompanied By The Words Or Equivalent. The Ordering Party Informs That Each Time Referring To Standards, Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And/Or Section 3 Of The Public Procurement Act, Allows Solutions Equivalent To Those Indicated, Provided That The Contractor Proves That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Ordering Party.
