1. The Subject Of The Order Is The Execution Of A Task Called: Construction Of A Sports Hall At The Secondary School Complex In Żelechów. The Scope Of The Task Includes: 1) Securing The Site Of Construction Works By Separating The Area Covered By Construction Works, 2) Demolition And Dismantling Of Development Elements Colliding With The Planned Investment, 3) Tidying Up The Area After The Works, 4) Earthworks - Removing The Topsoil Layer And Excavation For The Footings And Foundation Footings,5) Execution Of Formwork And Reinforcement Of Footings And Footings,6) Construction Of Foundations,7) Execution Of Moisture/Waterproof Insulation On Footings, Footings And Foundation Walls,8) Thermal Insulation Of External Foundation Walls,9) Partial Backfilling Of The Building And Filling The Free Spaces In The Area Of The Foundation Walls With Soil,10) Making A Base Of Compacted Natural Aggregate And Lean Concrete For The Actual Floor,11) Making Reinforced Concrete Columns,12) Making External Walls,13) Making Reinforced Concrete Ceilings,14) Building The Roof Structure,15) Construction Of Roof Covering,16) Installation Of External Joinery And Joinery,17) Construction Of Partition Walls,18) Internal Installation Works,19) Internal Finishing Works: Floors, Plasters, Ceramic Cladding, Painting Works, Etc.20) Installation Of Internal Joinery And Joinery,21 ) Façade Works,22) Installation Of Fittings And Permanent Equipment,23) Development Of The Area Around The Investment: Hardened Surfaces, Greenery, External Installations, A Ramp For People With Disabilities Has Been Designed In The Sports Hall Building, Enabling Free Access To The Facility For People In Wheelchairs. The Building Also Includes Communication Routes And Bathrooms Adapted For People With Disabilities. The Detailed Scope Of The Subject Of The Order Is The Design Documentation - Annex No. 10 To The Swz And The Bills Of Quantities Constituting Annex No. 9 To The Swz, On The Basis Of Which The Contractors Are Obliged To Prepare A Bid Cost Estimate - Simplified. The Ordering Party Informs That In Accordance With Art. 99 Section 5 Of The Act Of 11 September 2019 Public Procurement Law (Journal Of Laws Of 2023, Item 1605, As Amended), That If Trademarks, Patents Or Origins, Sources Or Specific Processes Are Indicated In This Technical Documentation, Characterize Products Or Services Provided By A Specific Contractor, If The Ordering Party Cannot Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way, And Such An Indication Is Accompanied By The Words Or Equivalent. The Ordering Party Informs That Each Time Referring To Standards, Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And/Or Section 3 Of The Public Procurement Act, Allows Solutions Equivalent To Those Indicated, Provided That The Contractor Proves That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Ordering Party. In This Case, The Ordering Party Allows Equivalent Solutions Provided That They Meet The Same Level Of Quality, Technology And Efficiency (Or Better ) From That Indicated In The Tender Documents. This Means That The Offered Devices And Materials Must Have Basic Parameters No Worse Than Those Indicated In The Order Documentation, Which Will Be Decided Each Time By The Ordering Party. Replacement Solutions Based On Products From Other Manufacturers Are Allowed, Provided They Meet The Same Or Higher Technical Properties. Additional Information On The Financing Of The Task. The Ordering Party Anticipates Financing The Task In Individual Years In The Following Gross Amounts: 2024 - Pln 4,000,000.00. 2025 - Pln 14,000 Pln .000.00 The Above Investment Financing In Individual Years Must Be Included By The Contractor In The Material And Financial Schedule. The Contractor Will Present The Material And Financial Schedule To The Ordering Party For Approval After Signing The Contract.2. Requirements Referred To In Art. 95 Section 1 Of The Public Procurement Act: 1) The Ordering Party Requires That, Throughout The Entire Order Execution Period, Persons (Manual Workers) Performing Activities Directly Related To The Implementation Of Construction Works That Are The Subject Of The Order Are Employed By The Contractor Or Subcontractor Under An Employment Contract Within The Meaning Of The Provision Art. 22 § 1 Of The Act Of June 26, 1974 Labor Code (Journal Of Laws Of 2023, Item 1465). 2) The Ordering Party Leaves It To The Contractor To Determine The Number Of Employees, With The Reservation That The Ordering Party Requires That Each Employed Person Takes An Active Part In The Implementation Of The Subject Of The Order. 3) During The Execution Of The Order, The Ordering Party Is Entitled To Carry Out Inspection Activities Towards The Contractor Regarding The Contractors Compliance With Or A Subcontractor Of The Employment Requirement Under An Employment Contract Of Persons Performing The Activities Specified In Point 1. The Ordering Party Is Entitled In Particular To: A) Request Declarations Confirming Compliance With The Above-Mentioned Requirements And Assessing Them, B) Requesting Explanations In Case Of Doubts Regarding Confirmation Of Compliance With The Above-Mentioned Requirements. Requirements, C) Carrying Out On-Site Inspections. 4) During The Execution Of The Order, At Each Request Of The Ordering Party Within The Deadline Specified In The Request, The Contractor Will Submit To The Ordering Party The Evidence Indicated Below In Order To Confirm The Fulfillment Of The Employment Requirement Under The Employment Contract By The Contractor Or Subcontractor Persons Performing The Activities Indicated In Point 1 Activities During The Execution Of The Order; A) Declaration Of The Employed Employee, B) Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing The Activities Referred To In The Ordering Partys Request. This Declaration Should Include, In Particular, The Precise Identification Of The Entity Submitting The Declaration, The Date Of Submission Of The Declaration, An Indication That The Activities Covered By The Request Are Performed By Persons Employed Under An Employment Contract, Together With An Indication Of The Number Of These People, The Type Of Employment Contract And The Working Hours, As Well As The Signature Of The Person Authorized To Submit The Declaration. Declarations On Behalf Of The Contractor Or Subcontractor; (Or /I)C) A Certified True Copy Of The Employment Contract(S) Of Persons Directly Providing The Service To Which The Above Applies. Declaration Of The Contractor And Subcontractor (Together With A Document Regulating The Scope Of Obligations); A Copy Of The Contract(S) Should Be Anonymized In A Way That Ensures The Protection Of Employees Personal Data, In Accordance With The Provisions Of Regulation (Eu) 2016/679 Of The European Parliament And Of The Council Of 27 April 2016 On The Protection Of Natural Persons With Regard To The Processing Of Personal Data And On The Freedom To The Flow Of Such Data And The Repeal Of Directive 95/46/Ec (General Data Protection Regulation) - I.E. In Particular Without The Address, Pesel Number Of The Employee; The Employees Name And Surname Are Not Anonymized; Information Such As: The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Duties Must Be Included And Readable. D) Other Documents. 5) In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 6) In The Event Of Failure To Provide The Ordering Party, Within The Deadline Specified In The Request Referred To In Point 4, With Evidence Confirming The Fulfillment Of The Employment Requirement Under The Employment Contract By The Contractor Or Subcontractor Of The Persons Performing The Work Indicated In Point. 1 Activities During The Execution Of The Order - The Contractor Will Pay The Ordering Party Contractual Penalties Specified In § 11 Section 1 Point 9 Of The Draft Provisions Of The Public Procurement Contract.
