1. The Subject Of The Investment Is The Development Of The Area And The Construction Of A Skate Park, Elements For Small Architecture, The Construction Of A Playground On The Plot With Registration Number 402/12, District 0047, Unit. Register Of The City Of Zielona Góra.2. A Detailed Description Of The Subject Of The Order Is Included In Annex I.4 To The Swz And In The Documents Referred To In Point 3.4. Swz.3. The Subject Of The Order Must Be Performed In Accordance With The Design Documentation, Technical Specifications For The Execution And Acceptance Of Works Contained In Annex I.6 To The Swz. 4. The Contractor Will Provide A Warranty For The Completed Subject Of The Order And Warranty For Defects In The Works Covered By The Contract For A Period Of Min. 36 Months From The Date Of Signing The Acceptance Protocol. Note: Additional Warranty For Works (Warranty Extension Period) Is Subject To Scoring In Accordance With The Offer Evaluation Criteria Specified In Point 30.2. Swz.5. The Ordering Party Informs That The Indications Of Common Names, Trademarks, Manufacturers Names, And Photos That May Appear In The Swz Together With Annexes In The Included Elements Of The Description Of The Subject Of The Order Serve Only To Determine The Visual, Technical And Qualitative Features. Product Names, Trademarks, Patents Or Origins Used In The Swz Together With Attachments Should Be Treated As Examples - The Ordering Party Allows The Use Of Equivalent Products (Materials, Equipment). An Equivalent Product Is A Product That Has The Same Functional, Visual, Material And Technical Features As The Specific Product Indicated In The Swz But Is Marked With A Different Trademark, Patent Or Origin. The Quality Of An Equivalent Product Cannot Be Worse Than That Described In The Subject Of The Order, Cannot Lower The Standard In Any Way And Cannot Change The Principles And Technical Solutions Adopted In This Tor, And Thus Deprive The User Of Any Performance, Functionality Or Usefulness Described Or Resulting From The Tor. The Contractor Who Accepts Equivalent Solutions (Products) For The Valuation Of The Offer Is Obliged To Prove The Equivalence Of The Adopted Solutions, Including Equipment And Materials. In Order To Confirm That The Offered Equivalent Solution Meets The Requirements Specified In The Tor, The Contractor Is Obliged To Submit, Along With The Offer, A Detailed Description/List Of The Offered Equivalent Procurement Subject Matter, Which Will Specify For Each Solution The Features Enabling Unambiguous Identification Of The Offered Solution And Confirmation Of Compliance With The Description Of The Subject Matter Of The Procurement Contract. . Note: Failure To Submit Such A Description/List Will Be Tantamount To Accepting The Solutions Indicated In The Swz And The Annexes To The Swz.6. The Ordering Party Informs That In The Event Of Reference To The Description Of The Subject Of The Order Contained In The Swz Together With Annexes To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, Solutions Equivalent To Those Described Are Allowed, Which Means Such Technical, Operational And Utility Solutions That Ensure Meeting The Minimum Requirements At A Level Not Worse Than Those Specified In The Above-Mentioned Documents, Enabling The Achievement Of The Effect Intended By The Ordering Party Using The Technical Solutions Indicated In The Swz And Its Annexes. In The Event Of A Reference In The Swz Together With Annexes To Specific Standards Or Other Regulations That Materials, Equipment, Devices And Other Goods As Well As Performed And Examined Works Are To Meet, The Provisions Of The Latest Edition Or Revised Edition Of The Referenced Standards Or Regulations Will Apply, Unless The Documents The Order Is Not Otherwise Indicated. 7. The Information On Parameters And Functions Contained In This Swz Together With The Annexes Is The Minimum Data - The Ordering Party Allows The Offer Of Products With Extended Functions And Better Parameters, Provided That They Meet The Minimum Requirements Specified In This Order.8. Pursuant To Art. 100 Paragraph 1 Of The Public Procurement Law, The Ordering Party Requires That The Subject Of The Order Be Implemented Taking Into Account The Requirements Regarding Accessibility For Disabled People And Design For All Users, In Particular In Accordance With The Principles Of Universal Design Referred To In The Convention On The Rights Of Persons With Disabilities Of December 13, 2006 (Journal Of Laws Of 2012, Item 1169, As Amended).9. The Ordering Party Requires That The Persons Indicated By The Contractor Who Will Participate In The Execution Of The Order And Contact The Ordering Party During The Execution Of The Subject Of The Order Must Have A Communicative Level Of Polish. In Case The Above-Mentioned Persons Will Not Speak Polish, During The Term Of The Contract And For The Purposes Of Implementing The Subject Of The Order, The Contractor Is Obliged To Provide An Interpreter At Its Own Expense And With Its Own Efforts.10. Pursuant To Art. 95 Of The Public Procurement Law, The Ordering Party Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities Related To The Implementation Of The Order, Consisting Of: Construction And Construction Works, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (Journal Of Laws Of 2023, Item 1465), Unless These Activities Are Performed By These Persons As Part Of Their Business Activity. The Selected Contractor Is Obliged To Implement The Subject Of The Order In Accordance With The Requirements For Electromobility Referred To In Point 43 Of Swz.12. The Selected Contractor Is Obliged To Submit To The Ordering Party, Before Signing The Contract, A Copy Of The Current Civil Liability Insurance Policy To The Extent Consistent With § 11 Section 7 Of The Contract Template.13.
