Part Of Order No. 1: Delivery And Commissioning Of A Building Automation System1. As Part Of Order Part No. 1 - The Contractor Will Be Obliged To Deliver, Install And Launch A Building Automation System, And Also Train A Group Of At Least 6 Teachers In The Scope Of Operating Teaching Stations, Programming And Creating Projects Using The Provided System, For A Minimum Of 10 Hours.2. The Detailed Scope Of The Subject Of Part Of The Order No. 1 Is Specified In Annex No. 4 To The Swz - Description Of The Subject Of The Order, And The Requirements For The Implementation Of The Order Are Specified In Annex No. 5 To The Swz - Draft Contract. 3. Equivalence Clause: 1) The Ordering Party, In Accordance With The Provisions Of Art. 99 Section 5 And Art. 101 Section 4 Of The Act Allows For Equivalent Solutions For Supplies, Works, Materials And Systems That Meet The Requirements Specified In The Procurement Documents. The Ordering Party Reserves That Wherever Trademarks, Patents Or The Origin Of Devices Or Materials Are Indicated In The Description Of The Subject Matter In Appendix No. 5 To The Swz - Description Of The Subject Of The Order, They Should Be Treated Only As Proposals. The Ordering Party Allows Methods, Materials, Devices, Systems, Technologies, Etc. Equivalent To Those Presented In The Description Of The Subject Of The Order. Therefore, It Is Allowed To Propose In The Offer Any Equivalent Market Equivalents With Properties Not Worse Than Those Indicated By The Ordering Party. The Parameters Indicated In The Procurement Documents Determine The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Procurement. The Offer May Include Methods, Materials, Devices, Systems, Technologies, But With Technical And Quality Parameters As Well As Performance And Functional Properties. At The Request Of The Ordering Party, The Contractor Is Obliged To Prove That The Solutions Used Will Allow To Achieve All Technical Assumptions For The Investment Task In Question, Taking Into Account The Entire Investment, And Not A Selected Fragment Of The Whole. The Burden Of Proving That The Material Or Device Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. If The Materials And/Or Equipment Offered By The Contractor As Equivalent Are Not Equivalent In The Light Of The Documents Submitted By The Contractor, The Contractors Offer Will Be Rejected As Not Corresponding To The Content Of The Swz. In The Case Of Describing The Subject Of The Order By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Ordering Party Allows The Execution Of The Order Using Solutions Equivalent To Those Described. In Such A Case, The Procedure Described In The Previous Content Of This Point Shall Apply Accordingly; 2) In The Case Of Technologies, Systems, Materials Or Equivalent Devices Adopted By The Contractor For The Valuation, The Offer Must Be Accompanied By A List Of These Technologies, Systems, Devices Or Materials, Which Will Be It Included The Following Information: Type And Description Of The Technology Or System Used, Name Of The Device/Material Used, Name Of The Manufacturer, Precise And Unambiguous Type Of Device Or Material;3) In Addition, For Equivalent Technologies/Systems/Devices/Materials, The Ordering Party Requires Documentation Of Equivalence, M .Among Others Using The Technologies/Systems/Equivalents/Equivalent Materials Included In The List; Calculations, Detailed Technical Drawings, Certificates, Approvals, Declarations Of Compliance With Regulations And Standards, And Data Sheets Of Manufacturers Of Equivalent Devices/Materials. These Documents Must Clearly State The Equivalence Of The Proposed Technologies/Systems/Devices/Materials; 4) In Case Of Doubts As To The Equivalence Of Equivalent Technologies/Systems/Devices/Materials Proposed In The Offer, The Ordering Party May Require Equivalence To Be Demonstrated (Documented) At The Offer Examination Stage. In Particular, For This Purpose, The Contractor May Request That The Contractor Present Catalogs Of The Manufacturer Of A Given Technology/Systems/Devices/Equivalent Materials. In Particular, Technology/Systems/Devices/Equivalent Materials Will Be Assessed In Terms Of The Possibility Of Achieving The Level Of Functionality, Operating Costs And Operational Reliability Specified For The Technology/Systems/Devices/Materials.
