The Subject Of The Order Is: Execution In The Design And Build Formula Of The Task Entitled: Construction Of A Brine Graduation Tower In The Town Of Jad w1) The Subject Of The Order Is: Development Of A Construction And Executive Design Together With Obtaining The Legally Required Arrangements/Approvals/Permits, And Then Performing The Works Specified Therein Construction, Related To The Construction Of A Brine Graduation Tower In Jad w, Plot No. 480/2; 2) The Contractor Is Obliged To Keep The Ordering Party Informed About The Progress Of Work On The Preparation Of The Study And To Agree It With The Masovian Voivodeship Conservator Of Monuments; 3) Preparation Of Design And Construction Documentation (Including Preparation Of The Investors Cost Estimate In Accordance With The Submitted Offer) Along With Obtaining A Building Permit And Presenting The Ordering Party Of The Financial And Material Schedule Of The Investment; 4) Proper Execution Of The Investment In Accordance With The Principles Of Construction Art. In Particular, The Implementation Of The Investment Consists In Carrying Out Construction And Assembly Works Based On The Completed Designs, As Well As Securing The Area;5) Conducting The Required Tests And Examinations And Preparing Documents Related To Putting The Completed Works Into Use And Obtaining An Operating Permit (If Required);6 ) Providing A Set Of Equipment, Markings, Instructions, Collective Protection Measures In The Field Of Occupational Health And Safety And Fire Protection, Required By Detailed Regulations For The Proper Operation Of The Works Performed;7) Fees For External Supervision, Tests, Etc.;8) Surveying And Geotechnical Services;9) Inventory As-Built;10) Marking Of Buildings And Installations In Accordance With The Requirements Of Detailed Regulations;11) Designers Supervision12) The Scope Of Work Covered By The Order Is Included In The Functional And Utility Program (Ffu) Constituting Annex No. 1 To Swz.13) All Requirements Specified In The Ffu Constitute Minimum Requirements , And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law.14) If The Pfu Indicates Names, Trademarks, Patent Or Origin, Source Or A Specific Process Characterizing The Product Or Service Provided By A Specific Contractor, If This Could Lead To Privileges Or Elimination Of Certain Contractors Or Products - They Should Be Treated As Exemplary Solutions Specifying Standards, Appearance And Technical Requirements. The Ordering Party Allows The Offer Of Equivalent Materials Or Devices Described In The Swz, Provided That They Ensure Technical Parameters Not Worse Than Those Specified In The Technical Documentation.15) The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified In By The Ordering Party In The Swz. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.16) The Contractor Is Obliged To Offer A Product With Similar Properties, Functionally Suitable For The Necessary Application. All Materials, Devices And Equivalent Solutions Must In Particular: Have The Same Strength And Durability, Have The Same Level Of Aesthetics, Have The Technical Parameters Of Materials And Devices If Specified In The Technical Documentation, Must Be Compatible With The Existing And Planned Infrastructure, Fulfill The Same Functions , Meet Construction Safety, Occupational Health And Safety And Fire Protection Requirements And Have Appropriate Documents Allowing For Use In Construction, Certificates And Technical Approvals.17) The Contractor Is Obliged To Perform The Subject Of The Order In Accordance With The Swz And The Documents Attached Thereto, The Submitted Offer And Applicable Legal Regulations , Standards And Construction Practices.18) Required Warranty Period For The Subject Of The Order (Materials And Labor): Minimum 3 Years From The Date Of The Mutually Signed Final Acceptance Protocol, Maximum 5 Years From The Date Of The Mutually Signed Final Acceptance Protocol, In Accordance With The Contractors Declaration Submitted In Offer. The Warranty Period Is One Of The Criteria For Evaluating Offers.19) The Description Of The Ordering Partys Requirements Regarding Implementation And Acceptance Is Specified In The Draft Provisions Of The Contract Constituting Annex No. 8 To The Swz.
