The Subject Of The Order Are Services Called: Chimney Sweeping Services In The Resources Administered By Zgkim In Police, Related To Cleaning Smoke, Exhaust And Ventilation Ducts In Residential And Commercial Buildings, Providing Commissioned Services And Carrying Out Inspections Of The Technical Condition Of Chimney Ducts, Divided Into Parts: Part I - Chimney Sweeping Services In The Resources Administered By Zgkim In Police, Related To Cleaning Smoke, Exhaust And Ventilation Chimneys In Residential And Commercial Buildings, Providing Commissioned Services And Carrying Out Inspections Of The Technical Condition Of Chimney Flues (Including Attachments) - In Area I, Part Ii - Chimney Sweeping Services In The Resources Administered By Zgkim In Police, Related To Cleaning Smoke, Exhaust And Ventilation Chimneys In Residential And Commercial Buildings, Providing Commissioned Services And Carrying Out Inspections Of The Technical Condition Of Chimney Flues (Including Attachments) - In Area Ii2. Detailed Description Of The Subject Of The Order: The Subject Of The Order Includes In Particular: 1) Permanent Services (Part I, Part Ii): A) Periodic Inspection Of Construction Facilities In Accordance With Art. 62 Section 1 Point 1C Of The Construction Law Act Of July 7, 1994 (Consolidated Text: Journal Of Laws Of 2023, Item 553, As Amended) And Chapter V And Vi Section 1-5 Of The Technical Specification For The Execution And Acceptance Of Services (Once A Year), Consisting In Checking The Technical Condition Of All Chimney Ducts (Smoke, Exhaust And Ventilation) In The Entire Building. The Contractor Is Not Responsible For The Actual Technical Condition Of The Chimney Flues, But For The Substantive Value Of The Attached Inspection Reports. During Periodic Inspections, The Ordering Party Does Not Require The Contractor To Prepare An Inventory Of Chimney Flues. B) Cleaning Of Chimney Flues In Accordance With 34.1 Of The Regulation Of The Minister Of Interior And Administration Of June 7, 2010 On Fire Protection Of Buildings, Other Facilities And Areas (Journal Of Laws 2010 No. 109, Item 719) And The Technical Specification For The Performance And Acceptance Of Services. After Completing The Service, The Contractor Is Obliged To Select And Remove Soot And Impurities From The Ducts.2) Commissioned Services - Performed At The Written Request Of The Ordering Party (Chapter Ix Of Stwiou): A) Checking The Patency Of Chimney Flues After Re-Bricking The Chimneys And Roofing Works, Performed By The Ordering Partys Employees Or Commissioned As Part Of External Contracting, Together With The Issuance Of An Opinion Or Report Confirming The Approval For The Operation Of Ducts (Smoke, Exhaust, Ventilation), B) Preparing Chimney Inspection Opinions (Including For The Needs Of Technical Documentation, Renovated Premises, Projects Related To The Replacement Of Installations Gas, Etc.) Along With Determining The Causes Of Malfunctions In The Operation Of Heating Devices Discharging Exhaust Gases And Ventilation In The Premises, Including The Lack Of Proper Air Circulation, With The Issuance Of Expert Opinions Containing Indications Of Technical Solutions, C) Determining The Cause Of The Malfunction Of: - Heating Devices Discharging Exhaust Gases, With Issuing An Opinion Containing Indication Of Technical Solutions, - Determining The Cause Of Malfunction Of Ventilation In The Premises, Including Lack Of Proper Air Circulation, Together With Issuing An Opinion Containing Indications Of Technical Solutions, 3) Detailed List Of Residential And Commercial Buildings In Which Smoke, Exhaust And Ventilation Ducts Should Be Cleaned, And Inspect The Technical Condition Of The Chimney Flues (Including Attachments) As Specified In The Lists Of Buildings Constituting Attachments No. 6, 6A, 8 - Area I And Appendix No. 7, 7A, 8 - Area Ii To This Swz.3. Detailed Description Of The Subject Of The Order And Scope Of Work - In Accordance With The Contract Template Constituting Annex No. 4 To This Swz And The Technical Specification For The Performance And Acceptance Of Services, Constituting Annex No. 9 To This Swz (Hereinafter Referred To As Stwiou).4. Legal Basisthe Scope Of Periodic (Annual) Inspections Of The Technical Condition Of Buildings Is Specified In Art. 62 Of The Construction Law Of July 7, 1994 (Consolidated Text: Journal Of Laws Of 2021, Item 2351, As Amended) And In The Regulation Of The Minister Of Internal Affairs And Administration Of August 16, 1999 On The Technical Conditions For The Use Of Residential Buildings (Journal Of Laws Of 1999, No. 74, Item 836). - Periodic (Annual) Inspections Of The Technical Condition Of Chimney Flues - Within The Scope Specified In The Construction Law Act Of July 7, 1994 (Consolidated Text: Journal Of Laws Of 2021, Item 2351). As Amended) Art. 62 Section 1 Point 1 Letter C, Excluding Gas Installations.5. Protocol Regarding The Inspection Of Chimney Ducts (Smoke, Exhaust And Ventilation) Carried Out Pursuant To Art. 62 Section 1 Point 1 Letter C) Should Be Prepared In The Form Of An Electronic Document (So-Called E-Protocol), Using The It System Supporting The Central Register Of Building Emission, Referred To In Art. 27A Section 1 Of The Act Of November 21, 2008 On Supporting Thermal Modernization And Renovations And On The Central Register Of Building Emission (Journal Of Laws Of 2022, Items 438, 1561, 1576, 1967 And 2456). The Minister Responsible For Construction, Spatial Planning And Development, And Housing Determines The Template Of The Protocol In The Form Of An Electronic Document Within The Meaning Of The Act Of February 17, 2005 On The Computerization Of The Activities Of Entities Performing Public Tasks.6. The Ordering Party Does Not Introduce A Reservation Indicating The Obligation Of The Contractor To Personally Perform Key Parts Of The Order.7. The Contractor May Entrust The Execution Of The Order To A Subcontractor(S).8. The Ordering Party Does Not Allow The Submission Of Variant Offers. 9. The Ordering Party Does Not Provide For The Possibility Of Awarding The Contract Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Act, Consisting In The Repetition Of Similar Services Consistent With The Subject Of The Basic Contract. The Order Will Be Awarded Provided That The Ordering Party Has The Necessary Financial Resources And, In Particular, If The Need To Change The Scope Of Services Results From Changes In Conditions Affecting The Implementation Of The Subject Of The Order. The Awarded Order Will Be Performed On The Basis Of The Basic Contract. 10. It Is Not Planned To Conclude A Framework Agreement.11. The Ordering Party Does Not Plan To Convene A Meeting Of Contractors.12. The Ordering Party Does Not Provide For An Electronic Auction.13. In This Procedure, The Ordering Party Provides For The Possibility Of Negotiating The Content Of The Offers In Order To Improve Them.
