1. The Subject Of The Order Is The Delivery To The Ordering Party Of A New, Factory-Free Agricultural Tractor (Hereinafter Referred To As The Vehicle) In The Form Of Operational Leasing With A Purchase Option. 2. The Description Of The Subject Of The Order Is Included In Annex No. 2 To Swz.3. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Subject Matter Of The Contract Constitutes An Inseparable Whole, Which Means That It Cannot Be Divided Into Parts For Technical, Organizational And Economic Reasons, And The Failure To Divide The Contract Into Parts Does Not Distort Competition In The Procedure. 4. The Place Of Execution (Delivery) Of The Subject Of The Order Is The Registered Office Of The Ordering Party. 5. The Parameters Of The Subject Of The Order Presented In The Description Of The Subject Of The Order (Appendix No. 2 To The Swz) Constitute The Technical And Qualitative Minimum Expected By The Ordering Party. Any Indicated Names Of Products And Their Manufacturers Are Only Intended To Approximate Requirements That Could Not Be Described Using Sufficiently Precise And Understandable Terms. 6. The Ordering Party Allows The Delivery Of Equipment Equivalent To The Description Of The Subject Of The Order, Which Means That The Offered Subject Of The Order Will Have The Same Or Higher Technical, Quality, Functional And Utility Parameters. 7. Any Trademarks, Proper Names, Etc. Indicated In The Description Of The Subject Of The Order, As Well As In Possible Subsequent Explanations To The Swz And Amendments To The Swz (If Any) Constitute Only A Qualitative Standard Regarding The Subject Of The Order. In All Cases Where Names Of Materials Are Indicated Due To The Specification Of The Subject Of The Order, The Use Of Equivalent Materials Is Allowed, I.E. Any Materials Mentioned By Name Used In The Description Of The Subject Of The Order Serve Only To Determine The Standard And May Be Replaced By Others With No Worse Performance Parameters And Qualitative. In The Case Of Offers Containing Equivalent Solutions, The Ordering Party Will Verify Them In Terms Of Meeting The Requirements Of Individual Items Of Technical Requirements Contained In The Annexes To The Swz. The Contractor Is Obliged To Prove In The Offer The Equivalence Of The Offered Product Range. The Burden Of Proving Equivalence Is The Responsibility Of The Contractor. The Ordering Party Will Not Accept Equivalent Solutions If The Minimum Quality Requirements Are Lower Than Those Indicated In The Annexes To The Swz. 8. Any Names Of Manufacturers Included In The Description Of The Subject Of The Order Were Used Only For Example Purposes. Any Indicated Names Of Products And Their Manufacturers Are Not Intended To Violate The Principle Of Fair Competition And Equal Treatment Of Contractors. Wherever They Are Indicated, They Should Be Read As Accompanied By The Words Or Equivalent. The Term Or Equivalent Is Understood By The Ordering Party As Offering Materials That Guarantee The Execution Of The Order In Accordance With The Ordering Partys Expectations. The Use Of Equivalent Solutions May Not Lead To A Deterioration Of The Properties Of The Subject Of The Order, Nor To A Change In Price Or To A Violation Of Legal Provisions. 9. The Concept Of Equivalence Also Applies When The Ordering Party Described The Subject Of The Order Using Standards, Approvals, Technical Specifications And Reference Systems. 10. The Conditions For The Implementation Of The Subject Of The Order Are Also Included In The Draft Provisions Of The Agreement, Constituting Annex No. 7 To The Swz.
