1. The Subject Of The Order Is The Performance Of Construction Works Related To The Renovation Of Ul. Żeromskiego In Dzierżoniów On The 617M Section As Part Of The Investment Project Entitled: Renovation Of Municipal Road No. 117136D - Ul. Żeromskiego In Dzierżoniów. The Project Is Co-Financed By The Government Road Development Fund. The Scope Of The Subject Of The Order Concerns The Performance Of Construction Works Related To The Renovation Of The Asphalt Surface And The Replacement Of Curbs On Both Sides Based On The Bill Of Quantities And The Certificate Of No Grounds For Objection Of July 12, 2023. Issued By The Staroste Of Dzierżoniów, Which Include: 1) Marking The Boundaries Of The Road; 2) Dismantling And Disposal Of Existing Curbs And Concrete Footings - 1125 M; 3) Building New Concrete Road Curbs (15X30x100) And Driveway Curbs In The Amount Of 1200 M Along With A Footing And Concrete Abutment With B-15 Concrete (Inrun Curbs Should Be Used On The Entire Right Side Of The Canal And At The Entrances To The Property. The Remaining Sections Are From The Road Curb) Road Curb With A Clearance Of 12 Cm And An Inrun Curb Of 2 Cm; 4) Milling Of The Bituminous Surface To A Depth Of 5 Cm With The Delivery Of Milling Material To The Site Indicated By The Ordering Party At A Distance Of Up To 3 Km; 5) Trenching To An Average Depth Of 8 Cm With Material Removal Up To 5 Km; 6) Construction Of 2 New Rain Inlets De 500, 1.5 M Deep, With A Sedimentation Tank And Drainage Channels De 200, With Integration Into The Existing Culverts Under The Road;7) Construction Of The Upper Layer Of The Foundation From A 0/31.5 Stone Mixture In Order To Shape The Foundation For The Bitumen Layer;8) Compaction Of The Existing Sub-Base To Achieve A Load-Bearing Capacity Of 120Mpa;9) Sprinkling The Sub-Base With Bituminous Emulsion;10) Constructing A Mineral-Bituminous Surface 0/11, 5 Cm Thick;11) Constructing 4 Bituminous Speed Bumps With Base Dimensions Of 3.5 M X 2 M With Vertical Markings And Horizontal (Thick Layer) With Cats Eyes.12) Execution And Introduction Of Traffic Organization For Speed Bumps;13) Construction Of An Earthen Roadside With A Diameter Of 1 M And Sowing With Grass;14) Preparation Of An As-Built Geodetic Inventory. 2. The Detailed Scope Of The Subject Of The Order Was Specified In: 1) Certificate Of Lack Of Grounds For Objection No. Ba.6743.1.136.2023 Of July 12, 20223, Issued By The Starosta Of Dzierżoniów; 2) Bill Of Quantities For The Renovation Of Ul. Żeromskiego;3) Technical Specification For The Execution And Acceptance Of Construction Works;4) Time And Target Traffic Organization. The Contractor Is Obliged To Perform The Scope Of Works Indicated In The Agreement, In The Bill Of Quantities, Which Is Specified In The Form Of A Technical Description Or In The Drawings Or Simultaneously In The Description And In The Drawings. Both The Technical Description And The Drawings (Graphic Part) Of The Documentation Are Equivalent And Describe The Subject Of The Order. The Contractor Is Obliged To Perform Construction Works In Accordance With The Construction Practices, Recommendations Of The Investors Supervision, And The Documentation Referred To In Section 3 Of This Paragraph, Taking Into Account The Elimination Of Architectural Barriers For People With Disabilities. 3. The Contractor Is Obliged To: 1) Take Over The Construction Site In A Protocol, Secure It And Properly Mark It, And Apply To The Network Operators For A Protocol Transfer Of The Devices For The Duration Of The Works, And After Completion Handing Over The Works To Their Owners In A Protocol, As Well As Making The Construction Site Available To Network Operators So That They Can Carry Out Renovation Works On Their Resources If Necessary; 2) Ensuring Access To Properties Located Within The Investment During The Works, Including Access For Rescue Services ;3) Organization Of Construction Facilities, Social And Sanitary Rooms For Employees And Material Storage Areas; 4) Ensuring The Supply Of Necessary Utilities To Carry Out The Works And Payment For Their Delivery. The Contractor Shall Provide The Necessary Utilities On Its Own To Ensure The Proper Performance Of The Works; 5) Bear All Costs Related To The Implementation, Supervision And Fulfillment Of All Obligations Arising From The Decision On The Construction Permit And Obligations Arising From The Decisions, Arrangements And Opinions Obtained And Those That The Contractor Is Obliged To Obtained During The Implementation Of Construction Works;6) Carrying Out Examinations, Tests And Measurements During The Performance Of Construction Works And Acceptance Tests In Accordance With The Technical Specification And Construction Knowledge And Practice; 7) Provide The Ordering Party, Before Signing The Contract, With Declarations On The Assumption Of Duties By The Construction Manager And Documents Resulting From The Terms Of Reference; 8) Regular Cleaning Of The Surface Of The Adjacent Area And Streets In The Event Of Spreading Mud From The Construction Site On The Wheels Of Machines, Cars And Other Technical Devices; 9 ) Tidying Up The Construction Site And Restoring The Adjacent Area To Its Original Condition After Completion Of The Works; 10) Removing Material And Rubble From Demolition, Unnecessary Materials And Unnecessary Equipment To The Landfill And Incurring The Costs Of Their Storage And Disposal; 11) Surveying Services During The Implementation Of Construction Works, As Well As To Perform Post-Construction Geodetic Measurement With A Title Page And Legend In Paper And Electronic Form On A Cd; 12) Protection Of Geodetic Control Points, And In The Event Of Their Destruction Or Damage Or The Need To Transfer The Order To An Authorized Geodetic Contracting Unit, To Recreate Them Or Establish New Ones; 13) Implementation Of The Safety And Health Protection Plan; 14) Participation Of The Construction Manager In Construction Councils Held At Least Once A Week; 15) Preparation Of Ongoing Construction Settlements And Invoices According To The Ordering Partys Recommendations; 16) Other Necessary Activities Required By Law And Related To With The Implementation Of The Subject Of The Order;17) Fulfillment Of Obligations, Including Those Of The Investor (Municipality) Resulting From Opinions, Arrangements, Permits And Decisions, As Well As Those That Will Be Issued In The Course Of The Implementation Of The Works;18) (If Necessary) Replacement Of Land, Perform Drainage Of Excavations And Perform Any Temporary Works Necessary To Protect The Construction Site And Adjacent Areas Against Damage Or Contamination;19) Be Liable For Any Damage Occurring On The Construction Site From The Date Of Its Acceptance.
