The Subject Of The Order Is: Supply Of High-Methane Natural Gas Type E, Including Sales And Distribution Services Of Gas Fuel For Facilities Managed By Mpgm Tbs Sp. Z O. O. In The City Of Ruda l ska From April 1, 2024 To March 31, 2025. Names And Codes Of The Common Procurement Vocabulary (Cpv): 09123000-7, 65210000-81. The Natural Gas Supplied By The Contractor Must Meet The Requirements Specified In Applicable Regulations, In Particular The Energy Law (Consolidated Text: Journal Of Laws Of 2022, Item 1385) And Implementing Acts Issued On Its Basis, As Well As Other Related Acts Of Applicable Law And Polish Standards. 2. The Ordering Party Currently Has Concluded Comprehensive Agreements For The Sale Of Gas Fuel With Pgnig Obr t Detaliczny Sp ka Z Ograniczon Odpowiedzialno ci With Its Registered Office In Warsaw At Ul. Jana Kazimierza 3, 01-248 Warszawa For The Sale And Distribution Of Natural Gas To The Consumption Points Specified In The Table. The Contracts Are Concluded For A Fixed Period Until March 31, 2024. A. The Selected Contractor Will Be Obliged To Complete All Formalities And Activities Necessary To Take Over The Obligations Of The Gas Fuel Seller In Time To Start Purchasing Gas Fuel From April 1, 2024. The Condition For Commencement Of Gas Fuel Deliveries On The Specified Date (In Relation To Individual Consumption Points) Is The Successful Completion Of The Supplier Switching Procedure, The Recipients Possession Of A Valid Contract For The Provision Of Gas Fuel Distribution Services And The Effective Expiry Of The Existing Contracts3. All Points Covered By The Proceedings Are Subordinated To Polska Sp ka Gazownictwa, Zak ad Gazowniczy Branch In Zabrze.4. The Ordering Party Informs That It Is The Final Recipient. In The Event Of A Change Of The Seller, The Ordering Party Will Grant The Contractor A Power Of Attorney To Change The Seller On Behalf Of The Ordering Party.5. The Ordering Party Currently Does Not Have Promotional Offers And Is Not A Member Of Loyalty Programs.6. The Ordering Party Expects The Application Of A Unit Price For The Supplied Gas Fuel In Accordance With The Regulations Contained In The Act On Special Solutions For The Protection Of Gas Fuel Consumers In Connection With The Situation On The Gas Market (Journal Of Laws Of 2022, Item 202) For Gas Intake Points Covered By Conduct.7. The Ordering Party Agrees To Change The Rates For Gas Fuel And Subscription From September 1, 2024 In The Event Of Approval Of The New Tariff By The Energy Regulatory Office, After Informing The Ordering Party About The Change In The Rate And Concluding An Applicable Annex To The Contract.8. The Ordering Party Is In Possession Of The Connection Conditions Issued By The Dso. 9. The Ordering Party Plans To Introduce Additional Consumption Points In 2024 For Which Conditions For Connection To The Gas Network Have Been Issued.10. Settlements Will Be Based On Actual Gas Consumption In Individual Facilities, In Accordance With Meter Readings, In Settlement Periods Consistent With The Distribution System Tariff And According To The Unit Price Resulting From The Contractors Offer.11. In Case Of Discrepancies, The Contractor Is To Accept The Contractual Force. 12. The Ordering Party Does Not Consent To Receiving Forecast Invoices.13. The Ordering Party Is Not A Payer Of Excise Duty.14. The Structure Of Gas Fuel Consumption, Together With Information On What Purpose The Purchased Gas Fuel Will Be Used For, Is Described By The Ordering Party In Swz.15. The Indicated Consumption Is Estimated And Indicative, Which Is Used Only For Valuation And Then Comparison Of Offers, And Consequently Does Not Constitute An Obligation Of The Ordering Party To Purchase Gas In The Given Quantity, Which May Increase Or Decrease (+/- 20%) During The Period Of Contract Implementation, And Settlement Will Be Made According To The Actual Gas Consumption In Individual Facilities, In Accordance With Meter Readings, In The Settlement Periods Adopted For A Given Tariff.16. After Selecting The Contractor, The Contractor Will Prepare A Contract Template Taking Into Account The Provisions Of The Swz And Present It To The Ordering Party For Approval. 17. The Planned Consumption Of Natural Gas For The Facilities In Question, Including The Facilities That The Ordering Party Plans To Turn On In 2024, Is: 2,773,000 Kwh.18.
