1. The Subject Of The Order Includes The Execution Of Construction Works Related To The Construction Of Cable Road Lighting.2. The Scope Of The Order In Question Includes: Installation Of Lighting Fixtures Equipped With A Zhaga D4i Or Nema Connector, Installation Of Lighting Poles, Excavation For The Cable, Laying Of The Lv Lighting Cable, Laying Of Protective Pipes, Execution Of Connections, Measurements, Protection Against Measurements, Electric Shocks, Overvoltage Protection And Grounding.3. A Road Lighting Control System Has Been Implemented In The Zgorzelec Municipality As Part Of The Task Implemented In 2022-2023 Entitled: Modernization Of Street Lighting In The Western And Southern Parts Of The Lower Silesian Voivodeship. Management Takes Place In The Cloud Via The Urban Application, Produced And Supplied By Biot Sp. Z O. O. The Lighting Control System Is Based On Direct Communication Between Controllers Installed On The Luminaires And The System Servers (Cloud). During The First Start-Up, The Controller Configuration Process Is Automatically Performed And Data Regarding The Luminaires On Which The System Controller Is Installed Is Transferred. During Automatic Configuration, On The Website Or In The Application Through Which It Is Possible To Manage The Operation Of The Luminaires, The Location Of Their Installation Will Be Automatically Indicated Using The Built-In Gps Module. The Control System Enables Integration With Superior Systems Via The Api Interface, Which Can Control The Appropriate Lighting Level Of The Luminaires Based On Data From Other Measurement Systems. Under The Subject Order, The Contractor Is Obliged To Ensure That The Installed Lighting Fixtures Are Incorporated Into The Existing Lighting Control System And Its Use At No Cost To The Ordering Party. The Contractor Bears The Costs Related To The Use Of The Interface, License, Server Fees, Data Transmission, Training, Etc., For A Minimum Period Of 10 Years.4. The Works Will Be Carried Out On Plots With Registration Numbers: 1.37 Obr. Xi, Owned By The Zgorzelec Municipality. The Area Where Construction Works Will Be Carried Out Has A Local Spatial Development Plan Approved By Resolution No. 175/2016 Of The Zgorzelec City Council Of June 28, 2016 On The Adoption Of The Local Spatial Development Plan For The Ujazd Południe District In Zgorzelec.5. A Detailed Description And Scope Of The Subject Of The Order Is Included In The Technical Specifications For The Execution And Acceptance Of Construction Works And In The Design Documentation, Which Includes: 1) Construction Design With Technical Design, 2) Executive Design, 3) Certificate Of Acceptance Of The Construction Notification With Design No. Ab .6740.6.35.2022.4 Of September 8, 2022, Issued By The Starosta Of Zgorzelec, 4) Bill Of Quantities The Bill Of Quantities Is Of An Auxiliary Nature. Due To The Lump Sum Remuneration Adopted In These Proceedings, The Contractor, When Pricing The Offer, Should Rely On The Scope Resulting From The Design Documentation Referred To In This Section. The Occurrence Of Works Not Included In The Bill Of Quantities During The Execution Of The Contract Or In The Event Of Works Occurring In A Larger Quantity Than In Any Item Of The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration - If These Works Are Included In The Design Documentation, The Contractor Will Perform These Works Under The Standard Contractual Risk . Due To The Above, The Contractor Is Obliged To Carefully Check The Number Of Works Against The Design Documentation. The Description Of The Subject Of The Order Includes Requirements Regarding Accessibility For Disabled People And Design For All Users, In Accordance With The Provisions Of The Construction Law And Implementing Regulations - Hereinafter Referred To As Part Of The Swz Documentation, Constituting Annex No. 6 To The Swz. 6. Requirements Regarding The Warranty:1) The Ordering Party Requires A Minimum 36-Month Warranty Period For The Construction Works Performed And Materials Used In The Execution Of The Order.2) The Warranty Periods Start From The Moment Of Signing The Final Acceptance Protocol With The I Accept Clause.3) If For In Order To Maintain The Validity Of The Terms Of The Warranty, Inspections, Maintenance Or Other Service Activities Related To The Proper Use (Of Materials, Devices, Etc.) Are Required; All These Activities Must Be Provided By The Contractor And Included In The Offer Price.4) Warranty Period For The Works Performed Construction And Materials Used In The Execution Of The Order Is One Of The Criteria For Evaluating Offers. The Ordering Party Specifies The Maximum Scored Warranty Period Of 60 Months. The Rules For Evaluating Offers Are Included In Chapter Xix Of The Swz.5) Detailed Requirements Regarding The Granted Guarantee Are Included In The Draft Contract Constituting Annex No. 5 To The Swz.7. Equivalent Solutions: The Aim Of This Procedure Is To Obtain Construction Works Of The Quality And Functionality Specified In The Swz. When Describing The Subject Of The Order, The Ordering Party Has Exercised Due Care To Ensure That It Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, Which Could Lead To The Preference Or Elimination Of Certain Contractors Or Products. If, Despite This, It Turns Out That Such An Indication Appears In Any Part Of The Swz Or Its Annexes, They Should Not Be Treated As Requirements Relating To The Subject Of The Contract, And Should Be Considered Only As Informational Indications (Not Binding On The Contractors). For These Reasons, An Offer That Does Not Meet Such Indications Will Not Be Considered Inconsistent With The Terms Of The Order And Will Not Be Rejected For These Reasons, Provided That The Contractor Proves In The Offer That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order. The Ordering Party Allows Solutions Equivalent To Those Described In The Procedure. By An Equivalent Solution, The Ordering Party Understands A Solution That Makes It Possible To Achieve The Effect Assumed In The Description Of The Subject Of The Order Using Other Technical Solutions. If The Ordering Party Used In The Description Of The Subject Of The Order The Markings Of Standards, Approvals, Technical Specifications And Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, They Should Be Understood As Examples. The Ordering Party In Accordance With Art. 101 Section 4 Of The Public Procurement Law Allows In Each Case The Use Of Solutions Equivalent To Those Described In The Content Of The Swz. Each Time A Standard Is Indicated In This Swz Or The Annexes To The Swz, It Should Be Assumed That The Phrase Or Equivalent Was Used In Reference To It. The Ordering Party Does Not Require The Contractor To Submit The Said Evidence Along With The Offer, In Accordance With Art. 107 Section 1 Of The Public Procurement Law. 8.
