1. The Subject Of The Order Is The Successive Delivery Of Food Products For The Primary School. Szarech Szereg w In P ochocin, O ar w Mazowiecki Commune In The Assortment And Quantities (Subject To Point 4.3 Of The Swz) Given In Annex No. 1 To The Swz.Part A: Meat2. A Detailed Description Of The Scope Of The Subject Of The Order Is Included In Annex No. 1 To The Swz And Point 4 Of The Swz. The Quantities Of Supplies Given In The Above-Mentioned Attachment Are The Estimated Demand For A Maximum Period Of 9 Months, Counting From The Date Of Signing The Contract, Provided That The Contract Period Ends On December 31. 2024 (Suspension Of Deliveries During The Holiday Months: July Or August 2024 - School Break - To Be Determined During The Order Execution)3. The Scope Of The Subject Of The Order May Change, I.E.: A) The Given Quantities Of Products In Individual Parts Are Estimates And May Be Reduced (By A Maximum Of 35%). They Will Be Used Only To Compare Offers And Select The Most Advantageous Offer, I.E. They Do Not Constitute The Final Size Of The Order, And As A Result, They Cannot Constitute Grounds For Filing Claims For Unrealized Deliveries Or For Refusing Deliveries. The Ordering Party Will Not Bear Any Negative Financial Consequences Caused By A Reduction In The Quantity And Value Of Deliveries. The Ordering Party Reserves The Right To Change The Quantity Of Deliveries Between Items In The Subject Of The Order. B) The Ordering Party Also Allows For The Possibility Of Increasing The Ordered Quantities Of Individual Products Specified In Annex No. 1 To The Swz. Therefore, The Ordering Party, Referring To The Provisions Of Art. 441 Section 1 Of The Act Provides For The Possibility Of Applying The Option Right. If, During The Execution Of The Contract, It Turns Out That The Ordering Partys Demand For Supplies Of Food Products Will Increase, Not Included In Annex No. 1 To The Swz, The Contractor Reserves The Right To Exercise The Option And Increase Deliveries At Lump-Sum Gross Unit Prices Specified In The Contractors Offer. . The Delivery Covered By The Option Right May Not Exceed 35% Of The Total Gross Bid Amount Of The Subject Of The Order.4. The Ordering Party Allows Price Indexation Of The Products Included In The Contractors Offer During The Implementation Of The Contract, In Accordance With The Provisions Contained In The Contract.5. Price Changes As A Result Of Indexation Must Be Made In Writing Under Pain Of Nullity.6. The Subject Of The Order Must Meet The Requirements Of Polish Pn Standards Or European Harmonized Standards, In Accordance With The Regulation Of The Minister Of Health Of July 26, 2016 On The Group Of Foodstuffs Intended For Sale To Children And Adolescents In The Education System And The Requirements That Must Be Met By Foodstuffs Used Within The Framework Of Mass Catering For Children And Adolescents In These Units (Journal Of Laws 2016.1154) And Any Other Requirements Arising From Applicable Regulations And Be Admitted To Marketing In The Eu.7. Each Product Should Be Produced And Marketed In Accordance With The Standards Of The Haccp And Gmp/Ghp Systems.8. The Quality Of The Delivered Products Should Be Consistent With Applicable Regulations And Certificates For First Grade/Class Products.9. The Contractor Must Meet The Hygienic And Sanitary Requirements In The Food Production Process And Trade, In Accordance With The Act Of August 25, 2006 On Food And Nutrition Safety (Consolidated Text: Journal Of Laws 2022.2132).10. Deliveries Will Be Made Successively, On Working Days From Monday To Friday, From 6:45 A.M. To 7:00 A.M., As Needed, Excluding Interruptions In The Canteens Operations Related To The Organization Of The School Year. The Ordering Party, Each Time In Its Request, Will Specify: The Assortment , Quantity And Delivery Date, By Submitting The Order By Phone Or E-Mail. Requests For Individual Deliveries Will Be Submitted By 3.00 P.M. In Writing Or By Phone, At Least One Day In Advance.11. The Contractor Will Deliver Fresh Products With Appropriate Expiration Dates. The Products Will Be Delivered No Later Than Half Of The Shelf Life Intended For A Given Product, Provided That: - The Meat Will Be A Fresh Product From Current Production, Not Foiled, With A Shelf Life Not Shorter Than Than 5 Days From Delivery. 12. The Contractor Will Each Time Deliver Such Quantities Of Food Products As Required By The Ordering Party. The Ordering Party Will Not Collect Food Products Exceeding The Ordered Limit. 13. With Each Delivery Of Goods, The Contractor Is Obliged To Attach A Commercial Identification Document And Take Into Account The Loss Of Goods For Packaging, E.G. Strings, Foils, Nets, Seals. In The Case Of An Order For Part A Of The Subject Of The Order, I.E. Delivery Of Meat, The Contractor Guarantees That The Meat Is Always Examined , And At The Request Of The Ordering Party, Present An Appropriate Certificate From A Competent Veterinarian.14. The Contractor Will Provide Containers, Boxes, Etc. Free Of Charge With Each Delivery Of Goods To The Ordering Partys Headquarters For The Period Until The Next Delivery. All Products Covered By The Order Must Be Delivered In Appropriate Packaging And Boxes (Packaging Material Approved For Contact With Food). Each Product Range Must Be Delivered In Separate Container. Food Products Should Be Delivered In Original, Intact Packaging, Marked In Accordance With The Requirements Of The Regulation Of The Minister Of Agriculture And Rural Development Of December 23, 2014 On The Labeling Of Individual Types Of Foodstuffs (Journal Of Laws 2015.29). Packaging Of Food Products Should Contain Information Such As: Name Of The Product, Name And Address Of The Manufacturer Or Entrepreneur Packing The Food, List And Quantity Of Ingredients Or Categories Of Ingredients, Net Content In The Packaging, Date Of Minimum Durability Or Expiry Date, Storage Conditions. The Packaging Should Be Appropriate To The Type Of Transport And Will Protect The Goods Against All Possible Factors/Conditions That Can Be Expected During Transport. With Each Meat Delivery, The Ordering Party Requires The Presentation Of A Commercial Identification Document (Hdi) In Accordance With The Act On Products Of Animal Origin (I.E. Journal Of Laws 2020.1753 ) And Regulation Ec 853/2004 Of The European Parliament And Of The Council Of 29 April 2004 Laying Down Specific Hygiene Rules For Food Of Animal Origin (Oj L139 Of 30 April 2004). 15. Transport Costs Should Be Included In The Contractors Offer Price. The Contractor Will Deliver The Subject Of The Order To The Ordering Partys Headquarters At His Own Expense. The Means Of Transport Must Meet Applicable Sanitary Requirements For The Transport Of Food. Unloading Takes Place From The Means Of Transport To The Place Indicated By The Ordering Partys Employee: - Ul. Lipowa 3, 05-860 P ochocin (Registered Office Of The Ordering Party). The Building Does Not Have An Elevator.16. Persons Performing The Delivery Must Have A Valid Medical Certificate For Sanitary And Epidemiological Purposes, Which They Present At Each Request Of The Ordering Party.
