The Scope Of The Subject Of The Order Includes: 1) Maintenance And Operational Works Aimed At Maintaining The Constant Technical Efficiency Of City Fountains And Drinking Fountains In The City Of Szczecin, Including Historic Buildings, Specified In Annex No. 6 To Swz, 2) Damages, Defects Or Failures, As Well As Maintenance And Operational Works Aimed At Maintaining The Constant Technical Efficiency Of City Fountains And Drinkers In The City Of Szczecin, Other Than Those Specified In Annex No. 6 To Swz.2. The List Of Facilities, Equipment And Location Is Attached As Annex 7 To Swz.3. In The Case Of Works Referred To In Point 3 Section 2 The Contractor Will Be Obliged To: 1) In The Scope Of Removing Defects Or Failures - Immediately Take Steps To Remove The Defect Or Failure, Including: A) Taking Protective Measures Related To Removing The Defect Or Failure No Later Than Within 90 Minutes From The Moment Of Receiving Notification Of The Failure Or Failure. The Ordering Party Will Inform The Contractor About Defects And Failures In Writing, By Phone Or E-Mail. The Date Of Notification Is The Day On Which The Information Is Provided By The Ordering Party, B) Removal Of The Fault Or Failure Within 24 Hours Of Receiving The Notification. If A Complex Defect Or Failure Is Found, The Parties To The Contract May Set A New Date For Its Removal. After Removing The Defect Or Breakdown, A Work Acceptance Report Will Be Prepared, Which Will Be Signed By Both Parties, 2) In The Scope Of Removing Damage And Performing Maintenance And Operational Works Aimed At Maintaining The Constant Technical Efficiency Of City Fountains And Drinking Fountains In The City Of Szczecin, Other Than Those Specified In Annex No. 6 To The Swz - Perform The Work Within The Time Agreed With The Ordering Party, After Previously Determining The Scope Of The Work And The Method Of Its Implementation; After Completing The Above-Mentioned Of The Works, A Work Acceptance Report Will Be Prepared - Which Will Be Signed By Both Parties - Based On The As-Built Cost Estimate Submitted By The Contractor, Which Will Constitute The Basis For Settlement.4. The Contractor Will Be Obliged To Implement The Subject Of The Order (Including In The Scope Of Damage, Faults, Failures And Performance Of Maintenance And Operational Works Aimed At Maintaining The Constant Technical Efficiency Of City Fountains And Drinking Fountains In The City Of Szczecin, Other Than Those Specified In Annex No. 6 To Swz), On All Days Of The Validity Of The Contract (Including Saturdays, Holidays And Non-Working Days) 24 Hours A Day. Therefore, The Contractor Will Also Be Obliged To Provide The Ordering Party With 24-Hour Telephone Contact And Readiness To Immediately Remove Any Damage, Fault Or Failure.5 . The Contractor Will Be Obliged To Inform The Ordering Party (On An Ongoing Basis) About Changes And Damages, Including: Installed Technical Devices Of Fountains, Structures Of Chambers And Fountain Basins And Drinking Fountains.6. The Contractor Is Fully Liable For Any Damage Caused By His Fault During The Execution Of The Subject Of The Order.7. The Contractor Will Perform The Subject Of The Order Using Materials That Are Its Property, For Which - Before Starting The Service - It Will Provide The Ordering Party With Attestations, Certificates, Declarations Of Conformity Or Certificates Of Approval For Use.8. The Contractor Will Be Obliged To Carry Out Operation-Related Works In Accordance With Occupational Health And Safety Regulations, Especially In The Case Of Chemicals Dosed Into The Technological Systems Of Fountains. All Work In Chambers/Rooms And In Water Should Be Carried Out With Appropriate Protection.9. If The Ordering Party Finds Any Irregularities Or Defects In The Repairs Performed, The Contractor Will Be Obliged To Remove Them Within The Period Specified By The Ordering Party, On Its Own And At Its Own Expense. The Ordering Party Reserves The Right To Substitute An Order To Remove Irregularities Or Defects In The Repairs Performed, At The Contractors Expense In The Case Of The Above. Orders.10. The Contractor Will Be Obliged To Maintain The Facilities In An Aesthetic, Efficient And Technically Undamaged Condition.11. The Contractor Is Obliged To Monitor All Facilities And Equipment Covered By The Order And Submit To The Ordering Party By September 30, 2024, A Detailed Report/Description On Their Technical Condition, On The Basis Of Which The Priority Of The Work Performed Will Be Determined.12. Waste:1) The Contractor Is Obliged To Conduct Waste Management In Accordance With The Act Of December 14, 2012 On Waste (Consolidated Text: Journal Of Laws Of 2023, Item 1587, As Amended),2) The Contractor Is Obliged To Document The Method Of Waste Management,3 ) The Ordering Party Reserves The Right To Conduct Inspections Regarding Waste Management During The Implementation Of This Contract.13. Employment: 1) Ordering Party, In Accordance With Art. 95 Of The Act Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Physical Activities Related To The Execution Of The Order, 2) The Employment Referred To In Point 1 Should Last Throughout The Entire Period Of Execution Of The Order, 3) At Each Request Of The Ordering Party, The Contractor Or Subcontractor Undertakes To Provide Evidence Of Employment Under An Employment Contract (E.G. Declaration Of The Employed Employee, Declaration Of The Contractor Or Subcontractor On The Employment Of The Employee Under An Employment Contract, A Certified Copy Of The Employment Contract Of The Employed Employee) Of The Persons Referred To In Point 1, In Accordance With Art. 438 Section 2 Of The Act, 4) In The Event Of Lack Of Employment On The Basis Of The Employment Relationship Of The Persons Referred To In Point 1 Or Failure To Provide Evidence Confirming Their Employment, The Contractor Will Be Charged A Contractual Penalty Specified In 5 Of The Contract.14. The Contractor Will Be Obliged To Perform The Subject Of The Order With The Utmost Care Required From An Entity Professionally Providing This Type Of Services, On The Basis Of Ensuring The Highest Quality Of Work, Making Every Effort To Prevent Maximum Nuisance To Residents (Especially In Terms Of Noise, Dust And Other) In Accordance With The Provisions Of Generally Applicable Law. Applicable, As Well As With The Swz And The Offer, Which Will Constitute An Integral Part Of The Contract.15. The Contractor Will Ensure, In The Fleet Of Vehicles Used To Perform The Subject Of The Order, At Least A 10% Share Of Electric Vehicles Or Vehicles Powered By Natural Gas Within The Meaning Of The Act Of January 11, 2018 On Electromobility And Alternative Fuels.
