The Subject Of The Public Procurement Is The Successive Delivery Of Dairy Products For The Canteen Of The Forestry Technical Secondary School In Tuchola, Located In Tuchola At Ul. Pocztowa 11. The Subject Of The Order Must Meet All Requirements Regarding Food Products Specified In Applicable Regulations, In Particular: 1) The Act Of August 25, 2006. On Food And Nutrition Safety (Journal Of Laws Of 2023, Item 1448);2) Act Of December 21, 2000 On The Commercial Quality Of Agri-Food Products (Journal Of Laws Of 2023, Item 1980, Consolidated Text) And Its Implementing Acts. The Subject Of The Order Must Be Performed In Accordance With The Provisions Contained In The Swz And The Annexes Attached To The Swz. The Contractor - In Order To Submit The Offer Correctly, Is Obliged To Use The Offer Form - Appendix No. 2, Which Should Be Submitted Together With The Cost Estimate - The Assortment And Price Form Constituting Appendix No. 1 To The Offer Form. The Contractor Is Obliged To Apply The Prices Proposed On The Assortment And Price Forms Throughout The Duration Of The Agreement. The Ordering Party Does Not Allow The Submission Of Offers That Do Not Include All Items Of A Given Part Of The Order - Failure To Complete Any Item Of The Assortment And Price Form Results In Rejection Of The Offer. 1. The Subject Of The Public Procurement Is The Supply Of Dairy Products According To The Range And Quantities Specified In Annex No. 1 To The Order Offer Form (Which Must Be Completed And Submitted With The Offer) According To Orders Placed By The Ordering Party, Delivered To The Kitchen/Food Warehouse At The Ordering Partys Headquarters, Ul. Pocztowa 11 In Tuchola, Within 12 Months From The Date Of Signing The Contract. Deliveries Will Take Place Every Day From Monday To Friday Between 5:00 A.M. And 5:30 A.M., And In Occasional Cases At Other Times Agreed With The Ordering Party And The Contractor, Based On Telephone Orders Placed On The Previous Day.2. The Delivered Articles Must Be Packed In Original Packaging With The Product Name, Manufacturers Data, Raw Material Composition And Expiration Date. They Must Be Fresh, Have An Appropriate Shelf Life, And Have The Required Approvals And Certificates. They Must Be Manufactured And Delivered In Accordance With The Requirements Of The Sanitary Inspectorate And The Haccap System, And Must Comply With Polish And European Standards. Deliveries, Transport And Unloading On Provided Trolleys To The Warehouse At The Contractors Expense, Forces And Risk In A Way That Allows The Ordering Party To Calmly And Thoroughly Check The Quantity, Quality And Compliance Of The Delivered Goods With The Order. The Contractors Driver/Convoy And The Ordering Partys Representative Take Part In Checking The Delivery. Delivery Of Goods By Courier And Unloading Of Goods Onto Provided Carts Is Not Allowed. If The Supplier Does Not Unload The Goods Onto The Trolleys Provided, The Goods Will Not Be Accepted And The Delivery Will Be Considered As Not Completed. The Means Of Transport Must Meet Sanitary Requirements In Accordance With Haccp And Sanepid Requirements And Be Intended Only For Transporting Food, And The Driver/Convoy Must Have A Valid Health Booklet, Be Equipped With Clean, White Protective Clothing And Have Completed Training In The Minimum Sanitary Procedure In The Field Of Food Safety. And Food Haccp And Sanepid. The Means Of Transport Must Be Able To Monitor The Temperature Of The Cargo Space. The Names Of Some Products Are Provided To Specify The Quality Parameters Of A Given Product. The Contractor May Offer Equivalent Products With No Worse Parameters, The Same Weight, The Same Organoleptic Features - Taste, Smell, Consistency. There Is No Minimum Quantity Or Value Of The Ordered Batch Of Goods. The Contractor Whose Offer Is Selected As The Most Advantageous Will, No Later Than On The Day Of Signing The Contract, Provide Product Specification Cards - Labels With The Detailed Raw Material Composition And Possible Allergens Of Each Product Included In The Offer Form In The Form Of A Printout Or In An Electronic Version On A Cd Or Dvd.3. The Goods Offered In The Range And Price Offer Cannot Be Changed To Another One During The Term Of The Contract, Nor Their Prices Changed.4. During Holidays And Holidays, The Ordering Party May Limit Or Suspend Orders Depending On The Number Or Lack Of Consumers, Which Cannot Be Predicted At The Stage Of The Procedure.5. In The Event Of A Complaint About The Poor Quality Of The Delivered Goods Or The Non-Compliance Of The Goods With The Order Or With The Swz, The Ordering Party Demands, Under The Warranty, The Replacement Of The Goods Within No Longer Than 1 Hour In Order To Maintain The Possibility Of Punctual And Proper Feeding Of Its Consumers. If The Ordering Party Discovers Defects In The Goods During The Shelf Life That Could Not Be Detected At The Time Of Acceptance Of The Goods, The Contractor Undertakes To Replace The Goods With Defect-Free Ones Within A Maximum Of 1 Day.6. In The Event Of Late Delivery Or Lack Of Deliveries Due To The Fault Of The Contractor Or Poor Quality Goods Delivered By The Contractor, The Ordering Party Will Order The Goods From Another Supplier And Charge The Costs To The Contractor. And In The Event Of A Repeated (3 Times) Situation With Untimely Or Lack Of Deliveries Or Deliveries Of Goods Inconsistent With The Swz And Of Poor Quality, The Ordering Party Will Terminate The Delivery Contract With Immediate Effect, And The Contractor Will Not Be Entitled To Any Claims In This Respect. 7. Attention! 1) In The Event Of Interruptions In Teaching Due To The Introduction Of Restrictions, Suspension Of Teaching, Introduction Of Hybrid Teaching Or Other Natural Disasters, The Ordering Party Reserves The Right To Suspend Or Reduce The Order(S), The Contractor Will Not Be Entitled To Any Claim For This Reason. 2) The Ordering Party Requires Contractors Comply With Sanitary Requirements And Perform Deliveries In A Sanitary Regime Consistent With The Current Guidelines Of The Minister Of Health And Sanitary Epidemiology.8. The Goods Offered In The Assortment And Price Offer Cannot Be Changed To Another One During The Term Of The Contract, Nor Their Prices Changed. The Markings Of Some Materials Or Their Producers Have Been Provided To Specify The Parameters Of The Subject Of The Order And Are Indicative Only, I.E. Contractors May Offer An Equivalent Range Of Other Brands, But Maintaining The Percentage Composition Of Raw Materials And Not Lower Technical, Quality And Taste Parameters With The Same Performance. , Consistency And The Same Organoleptic Characteristics, With The Same Grammage.9. The Ordering Party Reserves The Right To Purchase The Goods As A Substitute Outside The Applicable Contract And To Charge The Contractor With The Purchase Costs If The Contractor Does Not Deliver Or Is Unable To Deliver The Ordered Product In Accordance With The Description Included In The Swz Or Its Appropriate Equivalent Within The Specified Period. 10. The Ordering Party Reserves The Right To Change The Quantity Of Ordered Items, The Given Value Is An Estimated Quantity And The Change May Result From A Change In The Number Of People Fed Or The Diversity Of The Menu, Which Cannot Be Predicted At The Time Of Preparing The Offer.11. Settlements Between The Contractor And The Ordering Party Will Be Based On Unit Prices Resulting From The Assortment And Price Form Constituting An Annex To The Offer, According To Successive Orders Placed By The Ordering Party.12. All Information Necessary To Prepare The Offer Is Available For Inspection At The Registered Office Of The Ordering Party And Made Available On The Website Of The Proceedings On The E-Procurement Platform.
