The Subject Of The Order Must Be Performed In Accordance With The Provisions Contained In The Swz And The Annexes Attached To The Swz. The Contractor - In Order To Submit The Offer Correctly, Is Obliged To Use The Offer Form - Appendix No. 2, Which Should Be Submitted Together With The Cost Estimate - The Assortment And Price Form Constituting Appendix No. 1 To The Offer Form. The Contractor Is Obliged To Apply The Prices Proposed On The Assortment And Price Forms Throughout The Duration Of The Agreement. The Ordering Party Does Not Allow The Submission Of Offers That Do Not Include All Items Of A Given Part Of The Order - Failure To Complete Any Item Of The Assortment And Price Form Results In Rejection Of The Offer. The Subject Of The Public Procurement Is The Supply Of Beef, Pork, Cold Cuts And Poultry According To The Assortment And In The Quantities Specified In The Assortment And Price Form - Annex No. 1 To The Offer Form, Which Should Be Attached To The Offer - Annex 2. Deliveries Will Be Made Every Day From Monday To Friday Between 7:00 A.M. And 7:30 A.M., Based On Telephone Orders Placed The Previous Day. The Ordering Party Reserves The Right To Place An Urgent Order On A Given Day If Necessary. The Delivered Meat And Cold Cuts As Well As Poultry Must Be Fresh, Not Frozen, Free Of Foreign Odors, Damage To Casings And Packaging, Free Of Coatings, Bruising, Greenness And No Stickiness. Organoleptically Perfect. Produced And Delivered In Accordance With The Requirements Of The Sanitary Inspectorate And The Haccap System And In Accordance With The Veterinary Regulations Of The Piw. The Subject Of The Order Presented In The Offer Should Be Compliant With Polish And European Standards. Each Delivered Assortment And Each Delivery Batch Must Be Delivered In Original, Undamaged Packaging Bearing The Expiration Date, Name, Raw Material Composition, Name And Address Of The Manufacturer, In Polish. It Is Not Allowed To Deliver Goods Whose Expiration Date Is Close To The Delivery Date. The Contractor Must Have All Legally Required Veterinary Documents Regarding The Origin And Slaughter Of Animals That Were Used To Prepare The Delivery Assortment And Make Them Available At The Request Of The Ordering Party Or Authorized Services. The Meat Range Cannot Be Obtained From Sick Animals, Boars, Sows, Or From Emergency Slaughter. The Presence Of Msm - Mechanically Separated Meat - Is Not Allowed In Cold Cuts. The Ordering Party Has The Right To Question The Quality Of The Delivered Products (The Content Of Meat, Fat, Water And Other Additives In The Products As Well As Their Taste, And The Contractor Is Obliged To Replace The Goods With Those Of The Same Quality As The Ordering Party. The Ordering Party May Request At The Stage Of The Procedure To Provide Samples Of Selected Products For Tasting In Order To Confirm Their Quality And Compliance With The Swz. Delivery And Unloading On Provided Trolleys To The Kitchen Warehouse Will Be Carried Out By Force And At The Expense And Risk Of The Contractor In A Way That Allows The Ordering Party To Calmly And Thoroughly Check The Quantity, Quality And Compliance Of The Delivered Goods With The Order. In Checking The Quantity And Quality Of The Goods The Contractors Representative (Convoy, Driver) Is Involved In Checking The Delivery. The Driver/Convoy Of The Contractor And The Representative Of The Ordering Party Are Involved In Checking The Delivery. Delivery Of The Goods By Courier And Failure To Unload The Goods Onto The Provided Carts Is Not Allowed. If The Supplier Does Not Unload The Goods Onto The Provided Carts, The Goods Will Not Be Accepted. , And The Delivery Was Considered Unrealized. If The Ordering Party Discovers Defects In The Goods During The Shelf Life That Could Not Be Detected At The Time Of Acceptance Of The Goods, The Contractor Undertakes To Replace The Goods With Defect-Free Ones Within A Maximum Of 1 Day. In The Event Of Untimely Or Lack Of Deliveries Due To The Fault Of The Contractor Or Delivery Goods Of Poor Quality By The Contractor, The Ordering Party Will Order The Goods From Another Supplier And Charge The Costs To The Contractor. And In The Event Of A Repeated (3 Times) Situation With Untimely Or Lack Of Deliveries Or Deliveries Of Goods Inconsistent With The Swz And Of Poor Quality, The Ordering Party Will Terminate The Delivery Contract With Immediate Effect, And The Contractor Will Not Be Entitled To Any Claims In This Respect. The Ordering Party Reserves The Right To Purchase The Goods As A Substitute Outside The Applicable Contract And To Charge The Contractor With The Purchase Costs If The Contractor Does Not Deliver Or Is Unable To Deliver The Ordered Product In Accordance With The Description Included In The Swz Or Its Appropriate Equivalent Within The Specified Period. 4. The Ordering Party Reserves The Right To Change The Quantity Of Ordered Items, The Given Value Is An Estimated Quantity And The Change May Result From A Change In The Number Of People Fed Or The Diversity Of The Menu, Which Cannot Be Predicted At The Time Of Preparing The Offer.5. Settlements Between The Contractor And The Ordering Party Will Be Based On Unit Prices Resulting From The Assortment And Price Form Constituting An Annex To The Offer, According To Successive Orders Placed By The Ordering Party.6. All Information Necessary To Prepare The Offer Is Available For Inspection At The Registered Office Of The Ordering Party And Made Available On The Website Of The Proceedings On The E-Procurement Platform.
