The Detailed Scope Of Works Is Described In The Design Documentation Constituting Annex No. 1 To The Swz And In The Technical Specifications For The Execution And Acceptance Of Works Constituting Annex No. 2 To The Swz And Also Includes All Works Not Specified Directly In These Documents, But Without Which The Order Cannot Be Performed.3. The Ordering Party Pursuant To Art. 95 Section 1 Of The Public Procurement Law Requires That The Contractor Or Subcontractor Employs, Under An Employment Contract, Persons Performing Activities Related To The Execution Of The Contract, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465). In Particular: 1) The Ordering Party Requires That The Contractor Or Subcontractor Employ, Under An Employment Contract, Persons Performing The Activities Indicated Below During The Execution Of The Order: Construction Works Performed By Workers On The Basis Of Design Documentation - Operators Of Earthworks Machines, Construction Workers Performing Works Specified In The Bill Of Quantities Works.2) During The Execution Of The Order, The Ordering Party Is Entitled To Perform Inspection Activities Towards The Contractor Regarding The Contractors Or Subcontractors Compliance With The Requirement Of Employing Persons Performing The Activities Indicated In Point 1 Under An Employment Contract. The Ordering Party Is Entitled In Particular To: A) Request Declarations And Documents Confirming Compliance With The Above-Mentioned Requirements. Requirements And Assessing Them, B) Requesting Explanations In Case Of Doubts Regarding Confirmation Of Compliance With The Above-Mentioned Requirements. Requirements, C) Carrying Out On-Site Inspections Of The Performance Of The Service.3) During The Execution Of The Order, At Each Request Of The Ordering Party, Within The Deadline Specified In The Request, The Contractor Will Submit To The Ordering Party The Evidence Indicated Below In Order To Confirm The Fulfillment Of The Requirement Of Employment Under An Employment Contract By The Contractor Or Subcontractor Of Persons Performing Activities During The Execution Of The Order Indicated In Point 1: • Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing The Activities Referred To In The Ordering Partys Request. This Declaration Should Include In Particular: Precise Identification Of The Entity Submitting The Declaration, Date Of Submission Of The Declaration, Indication That The Activities Covered By The Request Are Performed By Persons Employed Under An Employment Contract, Together With An Indication Of The Number Of These Persons, Their Names And Surnames, The Type Of Employment Contract And The Salary. Full-Time Position And The Signature Of The Person Authorized To Submit A Declaration On Behalf Of The Contractor Or Subcontractor. The First Declaration Will Be Submitted To The Ordering Party No Later Than 7 Days After The Conclusion Of The Contract, The Subsequent Declarations In Accordance With The Provisions Contained Above.4) Due To The Failure Of The Contractor Or Subcontractor To Meet The Requirement Of Employing Persons Under An Employment Contract Performing The Activities Indicated In Point 1, The Ordering Party Provides For A Sanction In The Form Of The Contractors Obligation To Pay A Contractual Penalty In The Amount Specified In The Relevant Provisions Of The Public Procurement Contract. Failure By The Contractor To Submit The Evidence Requested By The Ordering Party To Confirm That The Contractor Or Subcontractor Has Met The Employment Requirement Under The Employment Contract Within The Deadline Set By The Ordering Party Will Be Treated As The Contractors Or Subcontractors Failure To Meet The Requirement To Employ Persons Performing The Activities Indicated In Point 1 Under The Employment Contract. 4. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate.
