Tenders Are Invited For Comprehensive Purchase Of Gas Fuel For Facilities Administered By The Housing Management Plant In Miko w

1. The Subject Of The Order Is The Purchase Of Gas Fuel By The Ordering Party With A Total Estimated Volume Of 2,473,896 Kwh During The Delivery Period, I.E. For A Period Of 21 Months From April 1, 2024. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 5 To The Swz - Description Of The Subject Of The Order. 2. Common Procurement Vocabulary Cpv: 09123000-7 Natural Gas 60300000-1 Pipeline Transmission Services 3. The Contractor Will Make All Actions And Arrangements With The Dso Necessary To Carry Out The Procedure For Changing The Supplier And Effectively Starting Sales Of Gas Fuel, Including In Particular: Termination Of Existing Comprehensive Agreements, Notification Of New Gas Fuel Sales Agreements To The Dso. The Contractor Will Perform These Activities On The Basis Of Appropriate Powers Of Attorney Granted When Concluding Gas Fuel Sales Contracts. 4. As Part Of The Proceedings In Question, The Ordering Party May Exercise The Option Right To Increase The Ordered Volume Of Gas Fuel By A Maximum Of 15%. Details Regarding The Rules For Exercising The Option Right Are Included In The Draft Provisions Of The Contract. 5. The Supply Of Gas Fuel Will Take Place Under The Conditions Specified In The Energy Law Act Of April 10, 1997 (Consolidated Text: Journal Of Laws Of 2023, Item 1385) And On The Basis Of The Implementing Provisions Of This Act, In Particular The Regulation Of The Minister Economy Of July 2, 2010 On Detailed Conditions For The Operation Of The Gas System (Journal Of Laws Of 2018, Item 1158, As Amended), Regulation Of The Minister Of Energy Of March 15, 2018 On Detailed Rules For Shaping And Calculating Tariffs And Settlements In Gas Fuel Trade (Journal Of Laws Of 2021, Item 280), In Accordance With The Osd Gas Fuel Tariff, The Rules Specified In The Licenses, In Accordance With The Provisions Of The Contract Terms And Conditions, As Well As In Accordance With The Contractors Offer And In Accordance With The Provisions Of The Civil Code . 6. A List Of All Consumption Points Along With Data On Historical Consumption Of Gas Fuel, Current Distribution Parameters And The Current Status Of Contracts Is Provided In The List Constituting Appendix No. 5 To The Swz. 7. Data On The Amount Of Purchased Gas Fuel Are Estimates And Are Calculated On The Basis Of Current Gas Consumption. The Forecast Of Gas Fuel Consumption Indicated In The Swz Is Only An Approximate Value, Which May Increase Or Decrease During The Execution Of The Contract. Regardless Of The Volume Of Consumption, The Contractor Is Obliged In Each Case To Apply The Unit Prices Of Gas Fuel Offered In The Tender Or The Prices Resulting From The Contractors Tariff (If The Provisions Indicated In Section 17 Apply). The Contractor Will Make Financial Settlements Based On The Actual Consumption Of Gas Fuel Indicated By Measurement And Settlement Devices And May Not Make Any Financial Claims If, During The Duration Of The Contract, The Ordering Parties Participating In The Proceedings Purchase A Total Amount Of Gas Fuel From The Contractor That Is Smaller Than The Forecast Amount. 8. Each New Ppg Created During The Term Of The Contract Must Have A Unit Price Of Gas Fuel In Accordance With The Offer Of The Contractor Selected In This Tender Procedure. The Supply Of Gaseous Fuel For The New Ppg Not Covered By The Annex To The Agreement Will Be Made On The Basis Of An Amendment To The Annex For A Given Agreement, Without The Need To Renegotiate The Terms Of The Agreement. 9. The Supplied Gas Fuel Must Meet Technical Standards In Accordance With The Provisions Of The Energy Law, Implementing Acts And Polish Standards. 10. The Contractor Is Obliged To Comply With Quality Standards Of Customer Service. 11. The Contractor Is Obliged To Receive From The Ordering Party, Within The Agreed Time, Notifications And Complaints Regarding The Supplied Gas Fuel. 12. The Contractor Should Have A Secure Access Portal For Recipients Enabling Downloading Invoice Images And Observing Gas Fuel Consumption No Later Than On The Date Of Commencement Of Deliveries. The Platform Should Enable The Creation Of Individual Accounts For Recipients Using The Same Nip Number. Using The Platform Should Be Free Of Charge For The Recipient. 13. The Ordering Party Requires That Contractors Applying For The Contract On The Date Of Submission Of Offers Have A Valid Contract Concluded With The Local Distribution System Operator, Based On Which Gas Fuel Can Be Sold Via The Distribution Network Of These Dsos To All Gas Consumption Points Indicated By The Ordering Party. 14. The Distribution Fee Rates Used By The Ordering Party To Calculate The Amount Indicated In Annex No. 1 Come From The Current Tariff Of The Local Dso. They May Change During The Execution Of The Order If The Tariff Of The Local Dso Changes. 15. The Condition For Commencement Of Gas Supplies On The Specified Date Is The Successful Completion Of The Supplier Switching Procedure And The Effective Termination/Expiration Of The Existing Contracts For The Supply Of Gas Fuel. 16. The Contractor Will Apply The Unit Settlement Price For The Delivered Gas Fuel In Accordance With The Regulations Contained In The Act Of January 26, 2022 On Special Solutions For The Protection Of Gas Fuel Consumers In Connection With The Situation On The Gas Market (Journal Of Laws Of 2022, Item 202, As Amended) For Gas Intake Points For Which The Ordering Party Will Submit Appropriate Declarations Required By Law If The Contractors Tariff Is Lower Than The Submitted Offer Prices. 17. The Ordering Party Does Not Require The Contractor To Visit The Site Or Check The Documents Necessary To Complete The Order.
