Smart Cards – Open House Procedure For Electronic Healthcare Professional Cards And Security Module Card Type B. The 17 German Pharmacists Chambers Are Legally Obliged To Ensure The Issuance Of Electronic Healthcare Professional Cards And So-Called Security Module Cards Type B By Qualified Trust Service Providers (Qvda). To Cover Demand, The 17 Pharmacists Chambers Carry Out A So-Called Open House Procedure. Potential Contractual Partners Are Exclusively The Individual Pharmacists Chambers And Not The Law Firm Named In This Announcement, Which Is Only Commissioned With The Central Management Of The Procedure; A Contractual Relationship Of Any Kind With The Law Firm Does Not Come About Through Participation In The Process. The Open House Procedure Carried Out Represents A Type Of Procedure Outside (European) Public Procurement Law (See, Among Other Things, Ecj, Judgment Of March 1, 2018 - Case C-9/17). The Current Procedure Does Not Constitute A Tendering Procedure Within The Scope Of Public Procurement Law Because There Is No Selection Decision Between Different Applicants Or Providers. Rather, Every Provider Who Meets The Requirements Set Out In The Framework Agreements (See Appendix 1) In § 3 And Proves This To The Relevant Chamber Of Pharmacists Is Entitled To Conclude A Framework Agreement With Each Of The 17 Chambers Of Pharmacists For The Entire Duration Of The Open House Procedure The Provider Is Entitled To Issue Electronic Healthcare Professional Cards And/Or So-Called Security Module Card Type B For The Term Of The Framework Agreement. The Use Of The European Official Journal Or Similar Platforms As A Publication Platform Has No Legal Effect In Such A Way That The Pharmacists Associations Want To Subject Themselves To The Scope Of (European) Procurement Law. The Use Of These Platforms Serves – Without Prejudice – Exclusively To Create The Greatest Possible Transparency. In Particular, The Terms Used In This Announcement Form That Indicate The Applicability Of Public Procurement Law Have No Prejudicial Effect. The Terms Are Only Used Because The Announcement Form Requires Mandatory Entries In Some Cases. The Same Applies To The Naming Of The Submission Date For The Offer And The Naming Of Deadlines In This Announcement Form. Process: Every Interested Company Can “Enter The Open House” During The Entire Duration Of The Open House Process By Submitting To One, Several Or All Pharmacists Associations The Requirements For One Or Both Of Them As Set Out In Section 3 Of The Framework Agreements In Annex 1 Types Of Cards (Electronic Medical Profession Card And/Or So-Called Security Module Card Type B) Are Informally Verified To The Respective Pharmacist Chamber(S).
