The Subject Of The Order Under The Name: Development Of A Functional And Utility Program For Construction Works Carried Out Within The Scope Of The Project: Consolidation Of Land Located In The Village Of Chłopice, Chłopice Commune Under The Rural Development Program For 2014-2020 Is The Development And Preparation Of A Functional And Utility Program Along With A Summary Of The Planned Costs Of Design Works And Planned Costs Of Construction Works, Within The Meaning Of The Act Of July 7, 1994, Construction Law (Consolidated Text: Journal Of Laws Of 2023, Item 682, As Amended) For Post-Consolidation Development In The Area Of ​​The Village Of Chorzów, Roźwienica Commune Consisting On: 1) Construction Or Modernization Of Agricultural Transport Roads And Access Roads To The Farm Buildings Of The Participants Of The Consolidation Proceedings, Together With The Necessary Preparatory Works, Including The Installation Of Culverts And Bridges; 2) Correction Of Water Drainage Facilities (Route, Location And Improvement Of Their Technical Parameters), Which Are Necessary To Facilitate The Development Of Cultivated Areas;3) Adapting Newly Designated Plots To Undertake Rational Agrotechnical Works On Them, Including The Removal Of Unnecessary Balks, Recultivation, And Anti-Erosion Protection.3. The Purpose Of Developing And Preparing The Functional And Utility Program Constituting The Subject Of The Order Is: 1) Description Of The Construction Task Along With The Purpose Of The Completed Construction Works And The Technical, Economic, Architectural, Material And Functional Requirements Imposed On Them; 2) Determining The Planned Costs Of Design Works And The Planned Costs Of The Works Construction;3) Including Information On The Obligation For The Contractor Carrying Out Design And Construction Works To Obtain Decisions, Arrangements, Opinions And Permits For The Ordering Party, If Obtaining Them Will Be Necessary At The Stage Of Design Preparation And Implementation Of Construction Works Performed In The Design And Build System.4. For The Performance Of Construction Works For The Task Titled: Consolidation Of Land Located In The Area Of ​​The Village Of Chłopice, Chłopice Commune Under The Rural Development Program For 2014-2020, Implemented In The Design And Build Formula. The Ordering Party Intends To Allocate Funds In The Gross Amount Of Pln 5,061,440.03 (Pln 4,114,991.90 Net + Vat At The Rate Of 23%).5. The Contractor Will Be Obliged To: 1) Provide The Ordering Party With A Warranty And Quality Guarantee For The Completed Subject Of The Order For The Period Declared By The Contractor In The Submitted Offer, Counted From The Date Of Final Acceptance Of The Subject Of The Contract Without Reservations, Which Cannot Be Shorter Than 36 Months; Note: The Contractor In The Offer Form Will Be Able To Declare A Warranty And Quality Guarantee Period Longer Than 36 Months And, In Accordance With The Provisions Of The Swz, Receive Points In This Offer Evaluation Criterion.2) Bear All Costs Necessary For The Proper Performance Of The Order/Contract, Including All Fees Related To The Performance Of The Contract, Previously Unforeseen, A Arising During Or As A Result Of The Execution Of The Order/Agreement;3) Not To Disclose To Third Parties Information Obtained During The Performance Of The Subject Of The Contract And To Treat The Information Obtained As A Result Of The Execution Of The Contract As Confidential;4) Prepare In Writing Proposals For Answers To Questions Submitted To The Contractor By The Ordering Party During Public Procurement Procedures For Design And Construction Works, Which Will Be Implemented On The Basis Of The Functional And Utility Program Prepared By The Contractor, Until The Entity To Which These Design And Construction Works Will Be Commissioned To Carry Out These Works Is Selected; 5) Consult With The Ordering Partys Representative On All Actions Taken During The Execution Of The Order And To Take Into Account The Ordering Partys Recommendations, Comments And Guidelines During The Execution Of The Contract And The Performance Of Its Subject; 6) Inform The Ordering Party In Writing About Emerging Threats During The Implementation Of The Subject Of The Contract, The Removal Of Which May Be Helpful Action Of The Ordering Party;7) Consult With The Ordering Party The Preliminary Version Of The Documentation (Concept) And Submit To The Ordering Party For Approval The Preliminary Version Of The Documentation (Concept) Prepared In Accordance With The Ordering Partys Guidelines, And Include Any Comments Of The Ordering Party Resulting From This Submission In The Final Version;8) Include In The Developed Version Documentation Constituting The Subject Of The Order/Contract Any Comments Submitted By The Ordering Party, Including During The Implementation Of The Subject Of The Order (Performance Of The Contract) And During The Warranty And Guarantee Period;9) Agree And Obtain The Ordering Partys Acceptance In Terms Of The Type Of Technologies Used And Materials Expected To Be Used, Approved For Circulation And Common Use In Construction, Which Will Be Taken Into Account By The Contractor In The Design Solutions Using Standard Technical Terms By Specifying Their Minimum Parameters For Materials Or Devices; Providing Trademarks Or The Origin Of The Goods In The Study Without Justifying It By The Specific Nature Of The Subject Of The Order (Works) Or Demonstrating That It Cannot Be Described Using Sufficiently Precise Terms, The Ordering Party Will Consider It A Defect Of The Study, And At The Same Time Demand That This Defect Be Removed At The Contractors Expense.8.
