Work Detail
1. The Subject Of The Public Procurement Is The Performance Of Works And Activities Related To The Implementation Of The Task Entitled: Reconstruction Of The Playground In The City Park In Brzeziny. The Subject Of The Order Will Consist In Particular In: - Preparation And Protection Of The Playground; - Removal Of Tree Stumps; - Dismantling And Disposal Games For Games Made Of Concrete Slabs; Carrying Out Earthworks Related To The Preparation Of The Area For The Installation Of Devices; Carrying Out Earthworks Related To Preparing The Area For Fall-Absorbing Surfaces; Delivery And Installation Of Concrete Edges; Making A Permeable Foundation Made Of Mechanically Stabilized Aggregates; Delivery And Installation Of Playground Equipment; ​​Construction Of A Polyurethane Surface In The Safety Zone Of The Swing Swing And Integration Scale; Construction Of A Sand Surface In The Safety Zone Of The Multi-Functional Play Set And 2 Rockers; Delivery And Installation Of A Fence Separating The Playground With 1 Gate; Construction Of A Sidewalk;  Preparing The Ground For Laying Lawns; - Establishing A Lawn With Sowing; - Cleaning Works. The Investment Area Is Located In Conservation Protection Zone B And An Archaeological Site. Archaeological Supervision Should Be Provided As Part Of The Subject Of The Order. 2. The Contractor Will Be Obliged To Perform The Subject Of The Order In Accordance With: 1) The Design Documentation Held By The Ordering Party (Appendix No. 9 To The Swz), 2) Technical Specification For The Execution And Acceptance Of Works (Appendix No. 11 To The Swz), 3) Decision Of The Łódź Provincial Conservator Of Monuments ( Annex No. 12 To Swz), 4) Conditions Resulting From Applicable Legal Provisions, 5) Requirements Resulting From Applicable Standards And Technical Approvals, 6) Principles Of Technical Knowledge And Construction Skills. Due To The Lump Sum Remuneration Adopted In The Contract, The Bills Of Quantities Are Only Auxiliary And Serve To Detail The Description Of The Subject Of The Order, Are Intended To Illustrate The Scale Of The Construction Work And Help Contractors Estimate The Investment Costs. In Order To Make A Full Valuation Of The Works, Each Contractor Is Obliged To Read The Design Documentation, Stwior And The Provisions Of This Swz Before Submitting The Offer. Documents Describing The Subject Of The Contract Should Be Treated As Mutually Explanatory And Complementary In The Sense That In The Event Of Any Ambiguities Or Ambiguity, The Contractor Will Not Be Able To Limit The Scope Of Its Obligation Or The Scope Of Due Diligence. If The Design Documentation Does Not Provide Detailed Information About The Technology For Performing The Works Or The Execution Of A Specific Element Of The Entire Order, Or Does Not Sufficiently Specify The Type And Standard Of Materials Or Devices, The Contractor Is Obliged To Obtain A Prior Decision In This Respect From The Ordering Party Each Time.3. The Contractor Will Also Be Obliged To: 1) Allow Representatives Of Authorized Bodies To Enter The Construction Site And Inspect The Construction Documentation; 2) Organize And Secure The Work Site; 3) Ensure Appropriate Occupational Health And Safety Conditions And Environmental Protection At The Work Site And Its Surroundings ;4) If Necessary, Ensuring Work In The Afternoon, On Saturdays, Sundays And Holidays;5) Installing Materials That Meet The Quality Requirements Specified In The Act Of April 16, 2004 On Construction Products (Consolidated Text: Journal Of Laws Of 2021, Item 1213);6) Removal Of Unnecessary Waste Generated During The Execution Of The Order Outside The Work Site In Accordance With The Principles Of Disposal And Storage Of Waste Materials Specified In The Act Of December 14, 2012 On Waste (Consolidated Text: Journal Of Laws Of 2023). ., Item 1587, As Amended);7) Ensuring Appropriately Qualified Persons To Perform The Order In Accordance With The Requirements Of The Construction Law (I.E. Journal Of Laws U Of 2023, Item 682, As Amended);8) Ensuring Your Own Supply Of Water And Electricity To The Extent Necessary To Perform The Order, And Bearing The Costs Of Their Consumption;9) Marking And Securing The Place Of Work At Your Own Expense - In Accordance With The Applicable Legal Provisions In This Matter ,10) Preparation Of As-Built Documentation, Including As-Built Surveying Inventory In 2 Copies.4. A Necessary Condition Is That The Contractor Provides A Minimum 60-Month Quality Guarantee For The Completed Subject Of The Contract And A Minimum 60-Month Warranty. The Guarantee And Warranty Period Will Be Counted From The Date Of Final Acceptance Of The Subject Of The Contract. 5. Materials And Devices Used To Implement The Subject Of The Order Must Be New, Marked With The Ce/B Mark, Have Appropriate Certificates, Be Free From Defects And Defects And Meet The Quality Standards Of Products Approved For Trading And Use In Construction, Specified In Art. 10 Of The Construction Law. 6. All Devices, Elements And Materials Used To Build The Playground Must Be Brand New, Free From Defects And Have Approvals And Certificates Indicated In The Design Documentation. Before Starting The Assembly, The Contractor Will Submit Certificates And Technical Sheets Of The Above-Mentioned Devices, Elements And Materials To The Ordering Party For Approval.7. The Contractor Will Use Its Own Materials, Machines And Devices (Own Within The Meaning Of Those Provided By The Contractor) To Perform The Subject Of The Order. The Contractor Will Provide The Ordering Party, At Its Own Expense, With Certificates Confirming Compliance With The Standard For The Materials Used To Complete The Subject Of The Order.8. During The Implementation Of The Works, At The Request Of The Ordering Party, Including The Supervision Inspector, The Documents Referred To Above Are To Be Presented To The Ordering Party Within 3 Days From The Date Of Receipt Of The Written Request. The Cost Of The Above Shall Be Borne By The Contractor.9. When Performing The Subject Of The Order, The Applicable Provisions Of Construction Law, Occupational Health And Safety Regulations, Fire Protection Regulations As Well As Other Regulations Related To The Subject Of The Order Must Be Complied With.10. The Ordering Party Is Not Liable For Any Damage Caused By The Contractor While Performing The Subject Of The Order.11. The Contractor Will Tidy Up The Work Area After Completion.12. The Contractor Will Bear The Costs Of Repairing Any Damage Caused While Performing The Works.13. The Contractor Will Include In Its Offer All Costs Related To The Execution Of The Subject Of The Order. 14. Pursuant To Art. 95 Section 1 Of The Public Procurement Act, The Ordering Party Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Activities Specified By The Ordering Party In The Scope Of Contract Execution, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 §1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465), I.E. Persons Performing Tasks Related To The Execution Of The Order.15. Pursuant To The Content Of Art. 95 Section 1 Of The Public Procurement Act, The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing The Following Activities In The Scope Of The Execution Of The Order: - In The Scope Of Activities Directly Related To The Performance Of The Works, I.E. The So-Called Employees Performing General Construction Works And Employees Performing Equipment Assembly.16. The Contractor Undertakes That The Employees Performing The Activities Listed Above Will Be Employed On The Basis Of An Employment Relationship Within The Meaning Of The Provisions Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2023, Item 1465).
