3.1. The Subject Of The Order Is The Reconstruction Of Some Rooms In The Dormitory Building And The Change Of Use To A Childrens Club. The Building Is Located In Kamieńsk, Commune. Kamieńsk, Plot No. 205/2, District 6. A Detailed Description Of The Subject Of The Order Is - Architectural And Construction Design With Land Development, Technical Design, Executive Design, Stwiorb Equipment List And Bills Of Quantities. Note: Due To The Adopted Nature Of The Contractors Remuneration (Lump Sum), The Bills Of Quantities Are For Information Purposes Only And Do Not Constitute The Basis For Calculating The Price By The Contractor.3.2. The Ordering Party Requires That Activities Related To The Performance Of Works In The Construction Industry, Sanitary Industry, Electrical Industry And Road Industry Be Performed By Persons Employed By The Contractor And Subcontractor On The Basis Of An Employment Relationship Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (I.E.: Journal Of Laws Of 2023, Item 1465, As Amended). The Persons Mentioned In The First Sentence Cannot Perform Any Activities On The Construction Site Without Employment Under An Employment Relationship With The Contractor, Subcontractors Of Works Or Services. This Requirement Does Not Apply To Construction Managers, Work Managers, Suppliers Of Construction Materials, Surveyors, And Persons Providing Equipment And Transport Services, Unless These Activities Constitute An Employment Relationship Under The Provisions Of The Labor Code (E.G. Self-Employment). 3.3. The Ordering Party Informs That Where In The Tor The Subject Of The Contract Is Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Allows Solutions Equivalent To Those Described, Provided That They Meet The Requirements Specified In Description Of The Subject Matter Of The Contract, Criteria Used To Assess Equivalence. For These Solutions, The Ordering Party Indicates As Equivalence Criteria The Allowance Of A Tolerance Of +/- 2% For All Parameters Required For Them. Where The Ordering Party Described The Subject Of The Order By Reference To Standards, European Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. . 101 Section 1 Point 2 And Section 3 Pzp, The Ordering Party Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent. The Ordering Party Indicates That The Obligation To Submit In The Offer Solutions Equivalent To Those Described In The Description Of The Subject Of The Contract And To Demonstrate Equivalence Lies With The Contractor. If The Requirements In The Description Of The Subject Of The Contract Refer To A Trademark, Patent Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Ordering Party Requires That The Contractor, In The Event Of Offering Equivalent Solutions, Already Present Proof Of Equivalence In Its Offer. Supplementary Works Required By The Ordering Party: 1) Performing Full Surveying Services For The Investment, 2) Preparing Acceptance Documentation In Two Copies In Polish, Divided Into Industries (Bound In Binders With A Detailed List Of Contents) Containing At Least: A) Permit For Use Or Application For Use To Pinb Accepted Without Objection, A) Original/Photocopy Of The Construction Log, B) As-Built Geodetic Maps With Stamps Confirming Contribution To The Geodetic Resource, C) Original Written Statement Of The Construction Manager: • On The Execution Of Works In Accordance With The Design Documentation, The Final Decision Of The Construction Permit And The Construction Law Act, • On The Execution Of Works In Accordance With Architectural Standards Constituting Part Of Annex No. 2 To The Guidelines On The Implementation Of Equality Principles Under Eu Funds For 2021-2027, • On Ensuring The Proper Condition And Order Of The Construction Site, As Well As Roads And Streets , Neighboring Properties, Buildings And/Or Premises, • Appropriate Development Of The Areas Adjacent To The Construction Site Enabling Proper Operation Of The Constructed Facility.
