5.1 The Subject Of The Order Is The Execution Of The Task Entitled: Reconstruction Of Part Of The Zss Building In Rzyki, Including Kindergarten Rooms. 5.2 The Scope Of The Subject Of The Order Includes In Particular: 5.2.1 Architectural And Construction Industry: 5.2.1.1 Disassembly And Demolition Works, 5.2.1.2 Horizontal Moisture Insulation, 5.2.1.3 Reinforced Concrete Structural Elements, 5.2.1.4 Steel Structural Elements, 5.2.1.5 Supplementation And Repairing Walls, Bricking Up Openings,5.2.1.6 Partition Walls,5.2.1.7 Window And Door Joinery (Internal And External),5.2.1.8 System Walls (Sanitary Facilities),5.2.1.9 Internal Plasters And Cladding,5.2.1.10 Painting Works,5.2. 1.11 Floors, Floor Coverings And Insulation, 5.2.1.12 Other Internal Works, 5.2.1.13 External Works: 5.2.1.13.1 Securing The Construction Site, 5.2.1.13.2 Facade Works, 5.2.1.13.3 Reconstruction Of External Stairs. 5.2.2 Installation Industry:5.2.2.1 Boiler Room,5.2.2.2 Internal Sanitary Sewage System,5.2.2.3 White Installation,5.2.2.4 Water Installations,5.2.2.5 Fire Protection Installations,5.2.2.6 Gas Installation,5.2.2.7 Water Installation In The Ground,5.2.3 Electrical Industry:5.2.3.1 Switchboards, Boards, Electrical Devices,5.2.3.2 Cables And Wires,5.2.3.3 Cable Routes,5.2.3.4 Installation Of Lighting Installation Accessories,5.2.3.5 Installation Of Lighting Fixtures,5.2.3.6 Electrical Sockets,5.2.3.7 Installation Of Equalizing Connections,5.2.3.8 Tests And Measurements5.2.4 Boiler Room Ii:5.2.4.1 Central Heating Installation,5.2.4.2 Boiler Room 2Nd Floor,5.2.4.3 Fire Protection Installation,5.2.4.4 Gas Installation,5.2 .4.5 Construction And Water Installation Works. -Kan.5.2.5 Other Works And Works Necessary For The Proper Performance Of The Subject Of The Contract, 5.2.6 Other Works And Works Necessary For The Proper Performance Of The Subject Of The Contract, Including: 5.2.6.1 Marking And Securing The Taken Over Construction Site For The Duration Of The Works, 5.2.6.2 Organization Of The Facilities, Including Access Roads To The Construction Site, 5.2.6.3 Organization Of Walks And Access Roads To The Property During The Works, 5.2.6.4 Preparation Of Full As-Built Documentation With Changes Made During The Works (If Required), 5.2.6.5 Preparation Of Photographic Documentation Of Each Stage Of The Implementation Of The Subject Of The Order, 5.2.6.6 Current Removal Of Unusable Materials From The Construction Site, 5.2.6.7 Carrying Out All Control Measurements, 5.2.6.8 Carrying Out Repair Works Of Technical Infrastructure, The Technical Condition Of Which Has Deteriorated As A Result Of The Works, Including Reconstruction Works.5.3 A Detailed Description And Scope Of The Subject Of The Order Is Specified In The Attached Design Documentation, Technical Specification For The Execution And Acceptance Of Construction Works To The Extent That Relates To The Subject Of The Order And In The Bill Of Quantities. 5.4 The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Draft Contract. 5.5 The Contractor Is Obliged To Implement The Subject Of The Order In Accordance With Applicable Standards And Technical Knowledge, Specified, Among Others, Act Of July 7, 1994 Construction Law, While Maintaining Due Diligence, Proper Organization Of Work And Occupational Health And Safety Rules.5.6 If The Tender Materials Contain Clear Names Of Patents, Trademarks, Materials, Products Or Devices Indicating The Manufacturer And Specific Catalog Types - All Such Names Should Always Be Read With The Clause Or Equivalent With The Same Or No Worse Technical, Qualitative, Functional And Aesthetic Parameters. If Specific Types Of Materials, Products And Devices Are Provided In The Above-Mentioned Documents, This Should Be Treated As An Auxiliary Indication Of The Minimum Quality Level (Standard). 5.7 The Use Of Equivalent Materials Is Conditional On Obtaining Quality Parameters And Functional Features At Least At The Level Indicated In The Description Of The Subject Of The Order. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents Authenticating These Materials In Order To Prove That The Offered Quality Parameters And Functional Features Are Equivalent Or Better Than Those Submitted In The Documentation. It Is The Contractors Responsibility To Prove That The Materials, Items Or Goods Used Have Parameters Equal To Or Better Than The Materials, Items Or Goods Referred To In The Description Of The Subject Of The Order. The Costs Related To Demonstrating The Equivalence Of Solutions Are Borne By The Contractor. 5.8 It Is Not Allowed To Make Changes To The Assumptions Of The Design Documentation, The Effects Of Which Would Affect The Architectural Conditions And Technological Parameters Adopted In The Design. 5.9 The Contractor Submitting An Equivalent Offer Bears Full Responsibility For The Proper Functioning Of The Technical Solutions Provided For In The Design Documentation. 5.10 The Kindergarten Facility Conducts Teaching Classes For Children Until June 24, 2024, At From 7.00 A.M. To 4.00 P.M. .5.11 Before Handing Over The Construction Site, The Contractor Will Present The Hourly Schedule Of Construction Works And The Method Of Securing The Construction Site At Individual Stages Of Work For Approval To The Stewards Management In Rzyki. Undertaking Work During The School Year, I.E. Before June 24, Requires Consent From The Facilitys Management. Any Security Measures For The Facility During Construction Works Must Take Into Account The Safety Of Building Users, Especially Children. 5.12 Deadline: July 31, 2024 Is Not Exceedable For Construction Works, Because The Kindergarten Must Be Equipped And Start Operating From September 1, 2024.5.13 The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Elements Of The Order.5.14 The Ordering Party, Pursuant To Art. 95 Section 1 Of The Public Procurement Act Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Activities Specified By The Ordering Party In The Scope Of Contract Execution, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465), I.E.: Physical Work On The Construction Site, Including: Performance Of Construction And Installation Works. 5.15 The Contractor, If Recognized Offer As The Most Advantageous One, Is Obliged To Employ, Under An Employment Contract In Its Own Company Or By A Subcontractor, Persons Performing The Works Specified In Point 5.14.5.16. The Contractor Is Obliged To Submit To The Ordering Party, Upon Each Request And Within The Deadline Specified In The Request, The Following Evidence Confirming The Fulfillment Of The Employment Requirement Based On Employment Contracts By A Contractor Or Subcontractor Of Persons Performing The Tasks Indicated In Point 5.14. Activities During The Execution Of The Order: 5.16.1 Declaration Of The Contractor Or Subcontractor On The Employment Under An Employment Contract Of Persons Performing The Activities Referred To In The Ordering Partys Request. This Declaration Should Include In Particular: Precise Identification Of The Entity Submitting The Declaration, Date Of Submission Of The Declaration, Indication That The Activities Covered By The Request Are Performed By Persons Employed Under An Employment Contract, Together With An Indication Of The Number Of These Persons, Their Names And Surnames, The Type Of Employment Contract And The Salary. Full-Time Position And The Signature Of The Person Authorized To Submit A Declaration On Behalf Of The Contractor Or Subcontractor, 5.16.2 Declarations Of Employed Employees Containing Information, Including Personal Data, Necessary To Verify Employment Under An Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract Work, Type Of Employment Contract And Scope Of Employees Duties,[...]5.22 The Minimum Warranty Period Required By The Ordering Party Is 60 Months And Is One Of The Criteria For Evaluating Offers In Accordance With The Provisions Of Chapter 19, Point 19.1 Of This Tor. If The Contractor Does Not Specify The Warranty Period In The Offer Form Or Declares A Warranty Period Shorter Than 60 Months, The Offer Will Be Rejected Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law.
